File 96-05 Mr. Edell said the parcel was created on January 20, 1967, without access. The applicant has been trying to obtain access. Legal and traversable access would be required as conditions. Howard Johnson was present representing Lyle Johnson. Mr. Nelson asked for clarification of the application. Mr. Edell explained the procedure for issuing Certificates of Compliance for parcels which were not properly created, and cannot obtain development permits otherwise. The criteria which is normally applied is that which would have been applied at the time of creation of the parcel. Current criteria can be applied as in the case of requiring compliance with PRC 4290. In 1967 legal and traversable would have been required as well as certain water and septic requirements. Basically this committee is concerned with deciding what would it take to make a legal division so the property owners can obtain necessary permits to develop their property. What would have been required at the time of parcel creation or at the current time, to make this a legal parcel? Normally the reason for an application for determination is to allow development of a property with a single family residence. In this case, a legal recorded easement to Cohasset Road and traversable access on the easement will be required. Mr. Farrel said that more staff material should be supplied in writing to the members of the Development Review Committee, so they can understand the situation. Mr. Johnson said that they had previously recorded an easment deed, but came up a few feet short. The amended deed has been sent out to all the signatories. He distributed a copy of the easement deed to the committee. He said it contains a legal description, tying it to a corner marker and so on. He said the notarized signatures have not been received back yet for the amended deed although that should not be a problem. Apparently the last few sentences of the legal description were in question. There is now a semi-improved road across the bottom of Parcel 101 into the subject parcel. It needs to be improved. That would be the legal access. They also have actual road access on Ponderosa Way. Mr. Erickson said that it would be necessary to verify adequate quantities of domestic water for a single family dwelling. Mr. Johnson said that they cannot execute the well permit until they obtain the Certificate of Compliance. Mr. Farrel asked when the access details would be cleared? Mr. Johnson said that would probably be done within a week. ■ Butte County Development Review Committee Minutes ■ December 14, 1995, ■ Page 1 ■ Mr. Farrel said he would prefer to continue the item until the easement is worked out. Mr. Edell said that a better procedure it to issue a conditional Certificate of Compliance with verification of legal access as a condition of approval. When the condition is met, a clear Certificate of Compliance can immediately be recorded rather than wait two weeks for hearing. It is more efficient to conditionally approve a Certificate of Compliance and then the applicant and the various departments can work on meeting the conditions and recording the Certificate as fast as possible. Mr. Johnson said their main concern is to get a well drilled while the "dry period" is still in effect for groundwater, rather than drilling during the wet period and getting a well that will by dry in June. HEARING CLOSED TO THE PUBLIC It was moved by Mr. Erickson, seconded by Mr. Crawford, and carried unanimously, for issuance i of a conditional Certificate of Compliance for a parcel owned by Lyle Johnson identified as AP 056-150-036, finding that available evidence indicates the parcel was created January 20, 1967, without access. The motion was made finding that the parcel meets zoning and Health Dept. requirements and that issuance of a conditional Certificate will not be detrimental to the health, safety or welfare of the people of Butte County or other properties in the territory in which the property situated providing the following conditions are complied with: 1. Provide traversable access to the property from a publicly maintained road. 2. Verify legal access to the property from a publicly maintained road. 3. Pay $6.00 recording fee. 2. Verify adequate quantities of domestic water are available for a single family dwelling. A note will be placed on the certificate as follows: "All new structures must meet the Fire Safe Requirements of Butte County and Public Resources Code 4290 and 4291."
