09, a request for a Certificate of Compliance for a 5 acre parcel located on the west end of Blazeford
Gulch, at 245 Blazeford Gulch, approximately 4000 feet west of Mission Olive Road, in the Bangor
area.
Mr. Edell said the parcel is in a Ben Culet court judgement area.
Mr. Betts said the parcel meets the current zoning and the zoning at the time of creation.
Mr. Crawford said the correct wording of the Fire Department Note is: "All new structures must meet the Fire
Safe Regulations of Butte County and Public Resources Code 4290."
It was moved by Mr. Erickson, seconded by Mr. Sanders, and carried unanimously for approval of the
Application for Determination for Burdette Dolan Peterson Jr. on AP 028-360-017, subject to the conditions
of the Agenda Report dated December 4, 1996, with the changes noted above.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review under the General Rule exemption;
and
Section 2: Zoning and General Plan Findings.
A. The parcel was in conformance with the Butte County zoning and General Plan at the time of creation;
and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, recommend the Development
Review Committee approve this Determination and issue a Certificate of Compliance for Burdette
Dolan Peterson Jr., on APN 028-360-017 subject to the following conditions.
Conditions:
1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee
is $6.00 for the first sheet plus $3.00 for each additional sheet. The estimated current cost for
recording this Certificate is $9.00 without conditions, $12.00 with conditions. This cost estimate is
based on 1 page notification (first sheet), 1 page of legal description attached as Exhibit"A", and 1

017:This is a request for a Determination for a Certificate of Compliance for a 5 acre parcel located
on the west end of Blazeford Gulch, at 245 Blazeford Gulch, approximately 4,000 ft. west of Mission
Olive Road, in the Bangor area. This project is located in an area zoned A-5 (Agricultural-5 acre
minimum parcel size). This project is located in Supervisorial District 1.

SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of
this request.
ANALYSIS: The 5 acre parcel was created as a remainder parcel on December 7, 1971, and is recorded in Book
1718 of Official Records Page 234. This parcel is located within the Culet judgement area. The parcel was zoned
A-3 at the time of its creation and met the minimum acreage requirement of the A-3 zone. The current A-5 zoning
for the project site was established on September 7, 1975. The Land Use Element Map of the Butte County General
Plan designates the project parcel as Agricultural Residential. The size of the parcel meets the size requirement of
the A-5 zoning and of the General Plan. No improvements have been made to the parcel. Domestic water for any
future development on the project parcel will be obtained from an on-site well. Sewage disposal will be handled by
an on=site septic system.
The Butte County Department of Public Works has recommended two conditions as a part of project approval. The
first condition requires the payment of recording fees to record the Certificate of Compliance with the Butte County
Recorder's Office. The second condition requires that two-way traversable access be provided to the parcel from
a publicly maintained road or state highway as defined in the County Code.
The Butte County Fire Department has recommended that any new development on the project parcel meet the Fire
Safe Regulations of Butte County and Public Resources Code 4290. This condition will be placed as a note on the
Certificate of Compliance.
The Butte County Environmental Health Division has recommended one condition as a part of project approval. This
condition will require proof that two (2) to three (3) feet of soil over a two (2) acre area that is less than 30% slope
is available for a septic system; percolation tests may be required if soil is questionable. The Environmental Health
Division has indicated that water wells should provide adequate water quantities in this area.
ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California
Environmental Quality Act(CEQA) provisions under the General Rule exemption.
RECOMMENDATION: Staff recommends that the Development Review Committee approve the Determination for
Burdette Dolan Peterson Jr., on APN 028-360-017 subject to the following findings and conditions.
