APPLICATION SUBMITTAL REQUIREMENTS
Prior to submitting a Legal Lot Determination application, it is requested that the
applicant discuss the application requirements, County procedures, zoning provisions
and possible conditions of approval with the Development Services, Public Works and
Environmental Health staff. Please note that acceptance of your application is not
an indication of approval.
A. SPECIFIC INFORMATION
The following specific information and material shall accompany a Uniform Application
at the time of submittal. Applications will not be considered complete nor will they be
acted upon until all submittal requirements have been met. All items, maps and exhibits
submitted in support of this application shall become the property of Butte County.
The following items are required to be submitted at the time of application:
1. A completed, signed, Uniform Application. If the application is signed by an
agent for the property owner, an agent authorization form must be submitted
along with the Uniform Application. The application shall not be accepted
unless signed by the owner or authorized agent.
2. Payment of the currently required Application Fee.
3. An Application for a Legal Lot Determination must be accompanied by
verification of ownership and/or evidence of how the parcel in question was
created. This evidence may be obtained from a title company, engineer, or
land surveyor, et al.
4. A plot plan or map giving approximate locations of existing improvements on
the property.
5. Supplemental application information may be required. See attached form.
B. HEARING REQUIREMENTS
A Legal Lot Determination is placed on the consent agenda of the Development Review
Committee for approval. Notice of the time, date and place of said hearing is posted in
a public place at least 72 hours prior to hearing.
THE DEVELOPMENT REVIEW COMMITTEE DECISION IS FINAL UNLESS
APPEALED TO THE BOARD OF SUPERVISORS. WITHIN 15 CALENDAR DAYS.

5. Ted Runge,Application for Determination, on AP 068-160-123, FILE DET 97-03, a request for a
Certificate of Compliance for a .55 acre parcel located on Millow Court, approximately 170 feet south
of Oroville Quincy Highway, east Oroville area.
Mr. Betts said the parcel meets the minimum parcel size for the zoning.
HEARING CLOSED TO THE PUBLIC
Mr. Erickson said that Conditions 4 and 5 should include a phrase to provide a "will serve letter" from the
Oroville Wyandotte Irrigation Distrcict for water and sewer service, including a statement that the parcel is
within district boundaries.
It was moved by Mr. Erickson, seconded by Mr. Sanders, and carried unanimously for approval of the
Application for Determination for Ted Runge on AP 068-160-123, subject to the findings and conditions of the
Agenda Report dated December 3, 1996, with the revisions to Conditions 4 and 5 noted above.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review under the General Rule
exemption; and
Section 2: Zoning and General Plan Findings.
A. The parcel was in conformance with the Butte County Zoning and General Plan at the time
of creation; and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, recommend the
Development Review Committee approve this Determination and issue a Certificate of
Compliance for Ted Runge on APN 068-160-123.
Conditions:
1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee
is $6.00 for the first sheet, plus $3.00 for each,additional sheet. The estimated current cost for
recording this Certificate is $9.00 without conditions, $12.00 with conditions. This cost estimate is
based on 1 page notification (first sheet), 1 page of legal description attached as Exhibit"A", and 1
page of conditions attached as Exhibit"B".
2. Provide two-way traversable access to the parcel from a publicly maintained road or state highway
as defined in the County Code.
3. Provide a will serve letter from the Oroville Wyandotte Irrigation District for water service, including
a statement that the parcel is within the district boundaries.
4. Provide a will serve letter from the City of Oroville for sewer service, including a statement that the
parcel is within the district boundaries.
A note will be placed on the certificate as follows: "All new structures must meet the Fire Safe Requirements
of Butte County and Public Resources Code 4290 and 4291."

Dear Mr. Runge:
At the regular meeting of the Butte County Development Review Committee held on December 12, 1996, the
Committee granted a Conditional Certificate of Compliance for the above-referenced property. The conditions are:
1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee is$6.00
for the first sheet, plus $3.00 for each additional sheet. The estimated current cost for recording this
Certificate is $9.00 without conditions, $12.00 with conditions. This cost estimate is based on 1 page
notification (first sheet), 1 page of legal description attached as Exhibit "A", and 1 page of conditions
attached as Exhibit"B".

SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of
this request.
ANALYSIS: The .55 acre parcel was created by a Gift Deed which was recorded on April 26, 1988, under Serial
Number 88-12988, in the Office of the Butte County Recorder. The parcel is zoned AR and is designated by the
Land Use Element of the Butte County General Plan as Low Density Residential. The AR zoning for the project site
was established on January 17, 1967. The AR zone requires a minimum parcel size of 6,500 sq. ft. when connected
to a public sewage disposal service. The size of the project parcel is consistent with the zoning and with the General
Plan. There are no structures located on the subject parcel. The project area is serviced by the Oroville Wyandotte
Irrigation District for domestic water supply, and by the City of Oroville for sewer service.
The Butte County Public Works Department has requested that the applicant pay the recording fees to record the
Certificate of Determination with the Butte County Recorders Office. The Public Works Department has also
requested that two-way traversable access be provided to the parcel from a publicly maintained road or state highway
as defined in the County Code.
The Butte County Fire Department/California Department of Forestry has requested that all new structures placed
on the project parcel must meet the Fire Safe Regulation of Butte County and Public Resources Code 4290.
The Butte County Department of Environmental Health has requested that a will serve letter be obtained from the
Oroville Wyandotte Irrigation District for water service and that a will serve letter be obtained from the City of Oroville
for sewer service.
ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California
Environmental Quality Act(CEQA) provisions under the General Rule exemption.
RECOMMENDATION: Staff recommends that the Development Review Committee find that this application is in
conformity with the Butte County General Plan and approve the Determination for Ted Runge on APN 068-160-123.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review under the General Rule exemption;

on APN 068-160-123.
Conditions.
1. Pay the recording fee in effect at the time the Certificate of Compliance Is recorded. The current fee
Is $6.00 for the first sheet plus $3.00 for each additional sheet. The estimated current cost for
recording this Certificate is$9.00 without conditions,$12.00 with conditions. This cost estimate is
based on 1 page notification (first sheet), 1 page of le-gal description attached as Exhibit"A",and 1
page of conditions attached as Exhibit"B".
2. Provide two-way traversable access to the parcel from a publicly maintained road or state highway
as defined in the County Code.
3. Place the following informational note on the Certificate of Compliance: "All new structures must
