Engineer: NorthStar Engineering (SL) Mr. Edell said the parcel was created on October 21, 1971, in Book 1708 OR 472 at a time when property could be legally divided for sale, lease or finance by deeds for 4 or fewer parcels. HEARING OPEN TO THE PUBLIC Don Mendonca,of Mendonca Orchards, said the parcel was created in order to obtain a loan to build a house. The parcel does not comply with the zoning and was not originally created to be a separate lot. Now the other parcel could have a house built on it. The request is against the zoning and the greenling and what ag and farming stands for. It seems that in the past a lot could be created just to get a loan. Mr. Edell said that on or before March 3, 1972, it was legal in California to create lots for loan purposes for 4 or fewer lots. Mr. Mendonca said that creation of the lot would make the property more valuable, but farming should be in one larger piece if possible. As more people move out into the area, it makes it harder for other people to farm. If someone just wants to buy the lot to live on, it would create a hardship for the farmers. Joe Miguel said he owns the parcel with the house on 1/3 acre. His brother owns the parcel with the almond orchard of about 16 acres. Mr. Miguel said some of his neighbors are opposed to his request. The majority of the neighbors have no opinion. His closest neighbor, Jim Dalke is not opposed, nor is Elsie Mendonca, the largest landowner in the area. Other neighbors are not opposed'to the request. One neighbor said that other people in the area have been doing exactly the same type of procedure. The Miguels just want to transfer acreage from one lot to the other. Mr. Edell said the hearing for the Application for Determination is to determine whether the small lot is a legal lot. The hearing for the boundary line modification is to consider the moving of the boundary line. Mr. Miguel said that agriculture will not be changed in any way by this request. The 1/3 acre will stay in pasture. No trees will be affected by this request. His niece recently raised a steer on the small parcel. The property was bought as two lots, and taxes are paid on two lots. The property has been two separate lots since he bought it. Myles Pustejovsky, of NorthStar Engineering, asked if all the necessary paper work is available to make a determination on the request. Mr. Edell said he believes that the necessary paper work is available. Mr. Farrel said that this type of request is normally approved provided the conditions can be applied which were applicable at the time of parcel creation. The parcel was created in 1971 and the parcel width was substandard. A condition can be applied to correct the situation. Mr. Edell said that under County Code and Government Code, the conditions can be applied which were in effect at the time the parcel was created or in effect at the time the current owner purchased or acquired title to the property. Normally the conditions are applied that were in effect at the time of parcel creation. Under the Subdivision Map Act, a Certificate of Compliance cannot be denied, but reasonable conditions can be applied. There does not appear to be a conflict with the request and the Ag Element.
