DESCRIPTION OF PROPERTY
1. The real property over which the easement granted herein lies is currently owned by
GRANTORS and consists of a portion of that certain real property located in the unincorporated
area of Butte County, California (APN: 073-090-009), more particularly described in Exhibit "A",
attached hereto and incorporated herein by this reference(the"Ser%fent Tenement").
2. The real property which shall receive the benefit of the easement is currently owned
by GRANTEE and is located in the unincorporated area of Butte County, California (APN: 073-
090-008), more particularly described in Exhibit "B", attached hereto and incorporated herein by
this reference(the"Dominant Tenement").
GRANT OF EASEMENT
GRANTORS hereby grant to GRANTEE a non-exclusive easement for ingress and egress
over and across the Servient Tenement for the purpose of accessing the Dominant Tenement from
Binet Road. The exact location and description of this easement is more particularly described in
Exhibit"C", attached hereto and incorporated herein by this reference(the"Easement").
These rights are appurtenant to the Dominant Tenement and shall bind and burden
GRANTORS, in GRANTORS' capacity as Servient Tenement. The easement rights shall run with
the land and shall benefit GRANTEE as the Dominant Tenement. The benefits granted and the
burdens and obligations imposed hereunder shall inure to and be binding upon GRANTORS'
successors-in-interest. The easement granted by this Easement Deed shall only be used by the

EASEMENT DEED
THIS EASEMENT DEED is made effective theAay of 1996, by
and among CYNTHIA K. WHITE, an individual, and STANLEY REED and JANET REED,
husband and wife (collectively referred to as the "GRANTORS") and MARY B. MORRISON, an
unmarried woman(the"GRANTEE").
DESCRIPTION OF PROPERTY
1. The real property over which the easement granted herein lies is currently owned by
GRANTORS and consists of a portion of that certain real property located in the unincorporated
area of Butte County, California(APN: 073-090-010), more particularly described in Exhibit "A",
attached hereto and incorporated herein by this'reference(the"Serv-ient Tenement").
2. The real property which shall receive the benefit of the easement is currently owned
by GRANTEE and is located in the unincorporated area of Butte County, California (APN: 073-
090-008), more particularly described in Exhibit "B", attached hereto and incorporated herein by
this reference(the "Dominant Tenement").
GRANT OF EASEMENT
GRANTORS hereby grant to GRANTEE a non-exclusive easement for ingress and egress
over and across the Servient Tenement for the purpose of accessing the Dominant Tenement from
Binet Road. The exact location and description of this easement is more particularly described in
Exhibit"C", attached hereto and incorporated herein by this reference(the"Easement").
These rights are appurtenant to the Dominant Tenement and shall bind and burden
GRANTORS, in GRANTORS' capacity as Servient Tenement. The easement rights shall run with
the land and shall benefit GRANTEE as the Dominant Tenement. The benefits granted and the
burdens and obligations imposed hereunder shall inure to and be binding upon GRANTORS'
successors-in-interest. The easement granted by this Easement Deed shall only be used by the
GRANTEE, or her assigns and successors or their guests, for purposes of accessing a single-family

4. Mary Morrison, Application for Determination, on AP 073-090-008, FILE DET 96-09, a request
for a Certificate of Compliance for a 5.55 acre parcel located on the east side of Mooreville Ridge
Road, approximately 300 feet north of Binet Road in the Clipper Mills area.
Mr. Betts said the parcel does not meet current zoning requirements, but in 1965 when the parcel was
created, it did meet minimum parcel size.
HEARING CLOSED TO THE PUBLIC
Mr. Crawford said the correct wording for the Fire Department Note is: "All new structures must meet the Fire
Safe Regulations of Butte County and Public Resources Code 4290."
It was moved by Mr. Erickson, seconded by Mr. Sanders, and carried unanimously, for approval of the
Application for Determination for Mary Morrison on AP 073-090-008, subject to the findings and conditions
in the December 2, 1996, Agenda Report, with the changed noted above.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review under the General Rule exemption;
and
Section 2: Zoning Findings.
A. The parcel conformed to the A-2 zoning in force in 1965 when the parcel was created; and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, recommend the Development

REQUEST: DET 96-09-Application for Determination for Mary Morrison on APN 073-090-008: This is a
request for a Determination for a Certificate of Compliance for a 5.55 acre parcel located on the
east side of Mooreville Ridge Road approximately 300 ft. north of Binet Road in the Clipper Mills
area. This project is located in an area zoned Unclassified (20 acre minimum parcel size). This
project is located in Supervisorial District 1.

SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of
this request.
ANALYSIS: The 5 acre parcel was created January 28, 1965 in Book 1365 of Official Records 381 without access.
Access was provided November 5, 1996 in Official Record-96-042036, 037&038. The current Unclassified zoning
for the project site was established on January 6, 1987 by Ordinance No.2574. The Butte County General Plan
designates the project parcel as Timber Mountain. The size of the parcel does notmeet the 20 acre minimum parcel
size requirement of the Unclassified zoning and 40 acre minimum parcel sizes in the General Plan.
The parcel was created, however, in 1965 when the zoning in this area was A-2 (general). No improvements have
been made to the parcel. Domestic water for any future development on the project parcel will be obtained from an
on-site well. Sewage disposal will be handled by an on-site septic system.
The Butte County Department of Public Works' only comment was the requirement that the applicant pay the
appropriate recording fees. The Butte County Fire Department has recommended that any new development on
the project parcel meet the Fire Safe Regulations of Butte County and Public Resources Code 4290 and 4291. The
Butte County Environmental Health Division has no objections to this request.
ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California
Environmental Quality Act(CEQA) provisions under the General Rule exemption.
RECOMMENDATION: Staff recommends that the Development Review Committee approve the Determination for
Mary Morrison on APN 073-090-008 subject to the following findings and conditions.
Section 1: Environmental Findings.

Dear Ms. Morrison:
We have extensively reviewed your request with County Council-and have been unsuccessful
in coming up with an alternative solution to your problem.
Based on the information we have, your parcel was created by deeds, January 28, 1965, in
Book 1356 of Official Records at Page 381 . To comply with County requirements at that
time, a "right-of-way not less than 60 feet in width" to a public street or highway was
required. A public street "shall have been accepted into a street or road system maintained
by a City, County or the State".
The problem is that Mooreville Ridge Road does not meet the qualifications to be declared a
public street or highway and we have no record of this property being given a 60 foot right-of-
way to a public street. The nearest public street being Binet Road.
Based on the above information, a Certificate of Compliance would be required for this
property. All conditions stated on the Certificate of Compliance would need to be met in order
for us to issue development permits. A condition which could be a major stumbling block
would be "to provide a 60 foot wide approved access to a publicly maintained street". To
meet this condition would require easement deeds from your neighbors to your property.
