Jeffrey and Diane Vesely, Application for Determination, AP 064-380-033, FILE DET 97-05, request for a Certificate of Compliance for a parcel located on the southwest corner of Skyway and Ponderosa Way at 14133 Ponderosa Way, in the Paradise Pines area. Mr. Edell said the lot was created on March 9, 1993 by gift deed. He said that Condition 2 has been modified from that in the Agenda Report. Mr. Erickson said that Condition 2 should be replaced by a note on the Certificate of Compliance as follows: "This note is to acknowledge existing two bedroom dwelling and provide notification that usable sewage disposal area may not be available to expand uses of property." Mr. Nelson asked if there is not adequate sewage disposal area on the property. Mr. Edell said there is an existing house and sewage disposal system on a substandard lot that was originally created by a subdivision map, reverted to acreage by a parcel map, and redivided by a gift deed. The sewage disposal rules have changed since the parcel was created. Mr. Erickson said that if the applicants want to expand the use on the property, they will have to be able to meet Appendix VII sewage disposal standards and also the physical leach line area. The new criteria which must be met because of the most recent parcel split are more stringent that the criteria in existence when the parcel was originally created. This project is located in an area zoned R-1 (Low Density Residential). This project is located in Supervisorial District 5. Staff recommends approval of this request. ANALYSIS: The.25± acre(10,265 sq. ft.) parcel was created as a remainder parcel by gift deed on March 9, 1993, which was recorded under Serial Number 93-009486. The County ordinance that required maps for this type of division became effective March 13, 1993,four days after the project parcel was created.The parcel was zoned RT-1 (Residential-Mobile Home) at the time of its creation and met the minimum acreage requirement of the RT-1 zone. The parcel is currently zoned R-1 and the Land Use Element Map of the Butte County General Plan designates the parcel as Low Density Residential. The project parcel has been developed with a 960 sq. ft. mobile home. Domestic water for the dwelling unit is obtained from the Paradise rrigation District. Sewage disposal is handled by an on-site septic system. The Butte County Fire Department does not have an objection to this project and did not recommend any conditions. The Butte County Environmental Health Division has stated that the project parcel is of a size that requires proof of net usable area sewage disposal requirement per Butte County Improvement Standards Appendix VII. In order to prove standards, a series of percolation tests will be required. The Environmental Health Department recommended a condition of this project that net usable area requirements for sewage disposal be proven as set forth in County Improvement Standards (Appendix VII). ENVIRONMENTAL DOCUMENTATION: This project has beer! determined to be exempt from the California Environmental Quality Act(CEQA) provisions under the General Rule exemption.
