97-07, property located on the east side of Garner Lane approximately 300 feet
south of Stable Lane in the north Chico area.
Mr. Betts said the applicant originally paid one fee and applied for Certificates of
Compliance on three separate parcels created by gift deed, but now wants to merge all
three parcels under one certificate. The resulting five acre parcel would exceed the one
acre minimum zoning. There is an existing dwelling with water and septic. Winter
groundwater tests are being monitored.
Mr. Erickson said the existing well and septic system will be acceptable, but any new
division would have to meet new requirements. Perc tests might possibly be required if the
land is subdivided.
Mr. Mooney asked why there is not a condition to merge the parcels to eliminate underlying
lot lines.
Mr. Edell said the Certificate will be issued on all three parcels as one parcel. A legal
description will describe the entire resulting parcel and refer to the three parcels combined
as one.
HEARING OPEN TO THE PUBLIC
Steve Bickley, the applicant, asked if perc tests are necessary.
Mr. Erickson said they are not necessary.
HEARING CLOSED TO THE PUBLIC
It was moved by Mr. Nelson, seconded by Mr. Sanders, and carried unanimously, to issue
a Certificate of Compliance on AP 047-250-171, 177 and 179, as one merged parcel,
finding that it meeds zoning and Health Department requirements and is subject to the
following condition and note:
1. "Pay the recording fee in effect at the time the Certificate of Compliance is recorded.
The current fee is $6.00 for the first sheet, plus $3.00 for each additional sheet.
The estimated current cost for recording this Certificate is $9.00 without conditions,
$12.00 with conditions. This cost estimate is based on 1 page notification (first
sheet), 1 page of legal description attached as Exhibit "A", and 1 page of conditions
attached as Exhibit "B"."

At the regular meeting of the Butte County Development Review Committee held on April 24, 1997, the Committee
granted a Conditional Certificate of Compliance for the above-referenced property. The conditions are:
1. "Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee is
$6.00 for the first sheet, plus$3.00 for each additional sheet. The estimated current cost for recording this
Certificate is $9.00 without conditions, $12.00 with conditions. This cost estimate is based on 1 page

REQUEST: DET 97-07 - Application for Determination for Steven Bickley on APN 047-
250-171,177. & 179: This is a request for a Determination for a Certificate of
Compliance for one 5-acre parcel located on the east side of Garner Lane,
approximately 300 ft. south of Stable Lane in the north Chico area. This project
is located in an area zoned SR-1 (Suburban-Residential, 1-acre minimum parcel
size). This project is located in Supervisorial District 3.

SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff
recommends approval of this request.
ANALYSIS: This project is a request for a Certificate of Compliance for one parcel. Currently,
the project site consists of three separate parcels. However, the three parcels were created by
three separate gift deeds, and were all gift-deeded to the applicant. An individual can be gift
deeded one parcel, however, any further gift deeds of adjacent land made to the same person
do not result in separate legal parcels. In this project, the applicant has three adjacent gift-
deeded parcels, only one of which is a legal, developable parcel. In order to have three
separate legal parcels, the applicant has to: 1.) obtain a separate Certificate of Compliance for
each separate parcel, 2.) obtain a Certificate of Compliance for the three combined parcels, or,
3.) record a subdivision map for the three parcels. The applicant has chosen option # 2, and
this will effectively merge the three gift-deeded parcels into one legal parcel.
The parcel is 5 acres in size, and is zoned SR-1 (Suburban Residential, 1-acre minimum parcel
size). The parcel is designated by the Land Use Element of the Butte County General Plan as
Agricultural Residential. The project site is located within the North Chico Specific Plan area.
The SR-1 zoning for the project site was established on January 20, 1981, which was before the
parcels were created by the gift deeds. The project parcel is developed with a 1,536 sq. ft.
dwelling unit and a detached garage. Sewage is handled by an on-site septic system. Domestic
water for the dwelling unit is supplied by an on-site well.

Y Approval of this project will result in a Certificate of Compliance for one 5-acre parcel. The size
of the parcel will exceed the minimum parcel size required by the SR-1 zoning and is
conditionally consistent with the Butte County Gene-al Plan designation of Agricultural-
Residential.
The Butte County Public Works Department has requested that the applicant pay the recording
fees to record the Certificate of Determination with the Butte County Recorders Office.
The Butte County Fire Department/California Department of Forestry requested that an
informational note be placed on the Certificate of Compliance stating: "All new structures must
meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and
4291."
Winter ground water monitoring tests were performed on the project site. While the winter
ground water monitoring tests are required to continue until the end of April, the Butte County
Department of Environmental Health has indicated tha: there seems to be no problem with
winter ground water levels. Percolation tests have not been conducted on the project site, but
a functioning septic tank/leachfield system supports the dwelling unit on the project site. Any
further subdivision of the project site may require that percolation tests be performed.
ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from
the California Environmental Quality Act (CEQA) provisions under the General Rule exemption.
RECOMMENDATION: Staff recommends that the Development Review Committee find that
this application is in conformity with the Butte County General Plan and approve the
Determination for one five (5) acre parcel for Steven Bickley on APN 047-250-171, 177, & 179.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review under the General
Rule exemption; and
Section 2: Zoning and General Plan Findings.
A. The parcel was in conformance with the Butte County zoning and General Plan
at the time of creation; and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and.2 of this report, recommend the
Development Review Committee approve this Determination and issue a
Certificate of Compliance for one five (5) acre parcel for Steven Bickley on APN
047-250-171, 177, & 179.

Conditions.
1. Pay the recording fee in effect at the time the Certificate of Compliance is
recorded. The current fee is $6.00 for the first sheet plus $3.00 for each additional
sheet. The estimated current cost for recording this Certificate is $9.00 without
conditions, $12.00 with conditions. This cost estimate is based on 1 page
I otification (first sheet), 1 page of legal description attached as Exhibit "A", and 1
page of conditions attached as Exhibit "B".
2. Place a note of the certificate of compliance that states: "All new structures must
