Hart Martin, Application for Determination, AP 036-800-075, FILE DET 97-10, request for a Certificate of Compliance on a 1.44 acre parcel located at the end of Crane Avenue approximately 1100 feet west of Melrose Drive, Oroville. (SB) Stephen Betts said there is some doubt as to what parcel the request is for. Michael Mooney said the application is for the parcel that was the "remaining lands of owner" as created by the last phase of Copley Acres minus the piece that was gift-deeded to Paul Hart. The Assessor's Office has a mistake in the parcel numbers -- there is no record of one of the parcels, and the deed reference for Parcel 75 is identified as the deed for Parcel 76, as shown in the title report. Mr. Mooney could not get a title report for the other parcel. The application is for the large piece north of the road. The parcel is served by utility companies and has water and sewer in place. Mr. Betts said there was some confusion that the application was for Parcel 76. It was agreed the application is for Parcel 75. Mr. Edell said the applicant does not own Parcel 76 and does not have the authority to make an application for it. He said the gift deed was dated October of 1992. TED CRAWFORD ARRIVED AT THE MEETING Mr. Edell said the original subdivision conditions of approval required an access road connecting Crane Avenue westerly to Mountain View Drive. Mr. Betts said there is a recommended condition to retain the easement. Mr. Mooney said he thought there is already an existing easement, but if not, it would not be a problem to provide the easement. Mr. Betts said Condition 3 of the Agenda Report should be replaced by two conditions as follows: "Prior to recordation of the Certificate of Compliance, provide verification to the Butte County Environmental Health Division, that a Sanitary District is willing and able to provide service to the parcel, and verification that the parcel is within the District boundaries," and "Prior to recordation of the Certificate of Compliance, provide verification to the Butte County Environmental Health Division that OWID is willing and able to serve the parcel with potable water, and provide verification that the parcel is within the district boundaries." He noted that on Condition 1, the Recorder's fee is now $7.00. Hart Martin on APN 036-800-075:This is a request for a Determination for a Certificate of Compliance for a 1.44 acre parcel located at the end of Crane Ave., approximately 1,100 ft. west of Melrose Drive, Oroville. This project is located in an area zoned AR (Agricultural- Residential). This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Development Review Committee Meeting of May 22, 1997. SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of this request. ANALYSIS:The 1.44 acre parcel was created by a remainder of a Gift Deed, which was recorded on October 7, 1992, under Serial Number 92-046053, Butte County Recorders Office. The parcel is zoned AR and is designated by the Land Use Element of the Butte County General Plan as Low Density Residential. The AR zoning for the project site was established on January 16, 1967, which was before the parcel was created. The AR zone requires a minimum parcel size of 6,500 sq. ft. when connected to a public sewer system or 8,125 sq. ft. for parcels not connected to a public sewer system. The size of the project parcel is well above the minimum size required by the zoning and the General Plan. The project parcel is not developed. Sewage disposal for any future dwelling unit on the property will be by connection to the Lower Oroville Area Public Utilities District (LOAPUD). Domestic water for any future dwelling unit will be supplied by the Oroville Wyandotte Irrigation District (OWID). This parcel was part of a subdivision map that was never recorded. Crane Ave. was to be extended westerly to Mountain View Dr. as a condition of that subdivision map, and a 60 ft. right- of-way for road purpose over and across the project site was recorded.
