Staff recommends approval of this request. ANALYSIS: The .9 acre parcel was created by a remainder of a Gift Deed, which was recorded on November 7, 1984, Book 3005 Official Records Page 391, Butte County Recorders Office. The parcel is zoned AR and is designated by the Land Use Element of the Butte County General Plan as Low Density Residential. The AR zoning for the project site was established on January 16, 1967, which was before the parcel was created. The AR zone requires a minimum parcel size of 8,125 sq. ft. (.18 acres)for parcels not connected to a public sewer system. The size of the project parcel is consistent with the zoning and with the General Plan. The project parcel is developed with a 900 sq. ft. dwelling unit and a 300 sq.ft. garage. Sewage is handled by an on-site septic system. Domestic water for the dwelling unit is supplied by the Oroville Wyandotte Irrigation District. The Butte County Public Works Department has requested that the applicant pay the recording fees to record the Certificate of Determination with the Butte County Recorders Office. The Butte County Fire Department/California Department of Forestry did not have any comment regarding this project. The Butte County Department of Environmental Health has stated that the project parcel is a small lot. The Environmental Health Department has state that at the time of inspection the septic system was working adequately, and that there is room on the parcel to replace the leach lines at least once, and that the soil on the project site is poor. They are requesting that the parcel be restricted to a one bedroom maximum dwelling unit only unless soil and space for leach lines can be proven. ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California Environmental Quality Act(CEQA) provisions under the General Rule exemption.
