4. George Nelson, Application for Determination, AP 036-430-057, request for a
Certificate of Compliance on a .9 acre parcel located on the west side of Greenbank
Avenue, approximately 1,400 feet north of Foothill Blvd., at 150 Greenbank Avenue,
Oroville.
Mr. Edell said the parcel was created by gift deed as a remainder and complied with
conditions at the time of creation.
Mr. Erickson asked that the note on Condition 2 be changed as follows: "This note is to
acknowledge the one bedroom dwelling and to provide notification that usable sewage
disposal area may not be available to expand uses of property." In other words, usable
sewage disposal area would have to be proven in order to expand the residence.
It was moved by Mr. Erickson, seconded by Mr. Sanders, and carried unanimously, to
approve the Application for Determination for George Nelson on AP 036-430-057, subject
to the findings, and condition on the Agenda Report dated December 30, 1996, with the
change in the note as previously stated.
Section 1: Environmental Findings:
A. The project is categorically exempt from environmental review under the
General Rule exemption; and
Section 2: Zoning and General Plan Findings.
A. The parcel was created in conformance with the Butte County zoning and
General Plan; and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report,
recommend the Development Review Committee approve this Determination
and issue a Certificate of Compliance for George Nelson on AP 036-430-
057.
Condition.
"Pay the recording fee in effect at the time the Certificate of Compliance is recorded.

REQUEST: DET 97-06 -Application for Determination for George Nelson on APN 036-430-057: This is
a request for a Determination for a Certificate of Compliance for a .9 acre parcel located on the west
side of Greenbank Ave., approximately 1,400 ft. north of Foothill Blvd., at 150 Greenbank Ave.,
Oroville. This project is located in an area zoned AR (Agricultural-Residential). This project is
located in Supervisorial District 1.

SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of
this request.
ANALYSIS: The .9 acre parcel was created by a remainder of a Gift Deed, which was recorded on November 7,
1984, Book 3005 Official Records Page 391, Butte County Recorders Office. The parcel is zoned AR and is
designated by the Land Use Element of the Butte County General Plan as Low Density Residential. The AR zoning
for the project site was established on January 16, 1967, which was before the parcel was created. The AR zone
requires a minimum parcel size of 8,125 sq. ft. (.18 acres)for parcels not connected to a public sewer system. The
size of the project parcel is consistent with the zoning and with the General Plan. The project parcel is developed
with a 900 sq. ft. dwelling unit and a 300 sq.ft. garage. Sewage is handled by an on-site septic system. Domestic
water for the dwelling unit is supplied by the Oroville Wyandotte Irrigation District.
The Butte County Public Works Department has requested that the applicant pay the recording fees to record the
Certificate of Determination with the Butte County Recorders Office.
The Butte County Fire Department/California Department of Forestry did not have any comment regarding this
project.
The Butte County Department of Environmental Health has stated that the project parcel is a small lot. The
Environmental Health Department has state that at the time of inspection the septic system was working adequately,
and that there is room on the parcel to replace the leach lines at least once, and that the soil on the project site is
poor. They are requesting that the parcel be restricted to a one bedroom maximum dwelling unit only unless soil
and space for leach lines can be proven.
ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California
Environmental Quality Act(CEQA) provisions under the General Rule exemption.
RECOMMENDATION: Staff recommends that the Development Review Committee find that this application is in
conformity with the Butte County General Plan and approve the Determination for George Nelson on APN 036-430-
057.
Section 1: Environmental Findings.

A. The parcel was in conformance with the Butte County zoning and General Plan at the time of

A. Subject to the findings indicated in Sections 1 and 2 of this report, recommend the Development
Review Committee approve this Determination and issue a Certificate of Compliance for George
Nelson on APN 036-430-057.
Conditions.
1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current
fee is$6.00 for the first sheet plus$3.00 for each additional sheet. The estimated current cost for
recording this Certificate is$9.00 without conditions, $12.00 with conditions. This cost estimate is
based on 1 page notification (first sheet), 1 page of legal description attached as Exhibit"A", and
1 page of conditions attached as Exhibit"B".
2. Place a note of the certificate of compliance that states: "The dwelling unit on this parcel shall be
limited to a maximum of one bedroom unless sufficient soil and space for leach lines can be proven
to the satisfaction of the Butte County Environmental Health Department."

normal meeting date of December 26, 1996, but due to the upcoming holidays that meeting was canceled.
We were unable to schedule your meeting for the special DRC meeting being held on December 19, 1996 due
to State-mandated time requirements.
It appears that your application for a Certificate of Compliance should have no problem being approved by the
Butte County Development Review Committee. Your parcel was created by a gift deed,which was recorded
at the Butte County Recorder's Office on November 7, 1984, under Serial Number 3005 Official Records 391.
Your parcel exceeds the minimum parcel.size for the zoning district it is location in so it meets all the
requirements of the Butte County Zoning Ordinance.
We have received comments from two Butte County departments regarding your application for a Certificate
of Compliance. The first condition,from the Department of Public Works, will require you pay the recording
fee to record the Certificate of Compliance with the Butte County Recorder's Office. This fee is estimated to
be $12.00. The Butte County Environmental Health Department has reviewed your application and is
requesting that a condition be added to the Certificate of Compliance stating that the parcel be limited to a one
bedroom-dwelling unit due to sewage disposal limitations. This condition will also state that a dwelling unit
larger than one bedroom may be approved if the septic system is approved by the Butte County Department
of Environmental Health.
