West of Palermo Honcut Hwy., Palermo. This project is located in an area zoned ARMH-1 (Agricultural Residential Mobile Home, 1 acre minimum). This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Development Review Committee Meeting of June 26, 1997 SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of this request. ANALYSIS: The .5 acre parcel was created by deed on December 28,1971 as recorded in Book 1723 of Official Records at page 611. The current ARMH-1 zoning for the project site was established on June 26, 1990 by Ordinance No.2842. The Land Use Element Map of the Butte County General Plan designates the project parcel as Agricultural Residential. The zone at the time the parcel was created was A-2, which had a minimum lot size of 8,125 square feet. The General Plan at the time the parcel was created was Low Density Residential. The parcel meets the size requirement of the zone and the general plan at the time of creation. No improvements have been made to the parcel. Domestic water for any future development on the project parcel will be obtained from O.W.I.D. Sewage disposal will be handled by an on-site septic system. The Butte County Department of Public Works has recommended a condition of this project that requires a two-way traversable access to the parcel from a publicly maintained road or state highway as defined in the County Code. The Butte County Fire Department has recommended a condition requiring all new development on the project parcel to meet the Fire Safe Regulations of Butte County and Public Resources Code 4290 and 4291. The Butte County Environmental Health Division has stated that there is ample room on the project parcel for a sewage disposal system and that there is already O.W.I.D. water service at the parcel. ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California Environmental Quality Act(CEQA) provisions under the General Rule exemption. RECOMMENDATION: Staff recommends that the Development Review Committee approve the Determination for Jesus & Eugenia Avina, on APN 027-300-068 subject to the following findings and conditions.
