390-002: This is a request for a Determination for a Certificate of Compliance for
a 10 acre parcel located on the Northwest intersection of Maple Lane & Ooti Way.
This project is located in an area zoned M-R (Mountain Recreational). This project
is located in Supervisorial District 1.

SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff
recommends approval of this request.
ANALYSIS: The 10 acre parcel was created by grant deed, in Book 1729 of Official Records
at page 503. This parcel is one of the many parcels that are within the Don Mann judgement
area. The current M-R zoning for the project site was established on December 9, 1969 by,
Ordinance No.1058. The Land Use Element Map of the Butte County General Plan designates
the project parcel as Agricultural Residential. The size of the parcel meets the size requirement
of the M-R zoning and of the General Plan. Surrounding zoning is M-R to the west and A-5 to
the east. The parcel is within the Deer Herd Development Permitted area. No improvements
have been made to the parcel. Domestic water for any future development on the project parcel
will be obtained from a well. Sewage disposal will be handled by a septic system.
The Butte County Department of Public Works has recommended a condition of this project that
requires two-way traversable access to the parcel from a publicly maintained road or state
highway as defined in the County Code. The Butte County Fire Department has recommended
a condition of this project that requires any new development on the project parcel to meet the
Fire Safe Regulations of Butte County and Public Resources Code 4290 and 4291. The Butte
County Environmental Health Division has stated that there is ample room on the project parcel
for a sewage disposal system and that wells are usually good in the project area.
ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from
the California Environmental Quality Act (CEQA) provisions under the General Rule exemption.
RECOMMENDATION: Staff recommends that the Development Review Committee approve the
