It was moved by Mr. Erickson, seconded by Chairman Hunt, and unanimously carried for approval of the Application for Determination of Steven Kaps, on APN 047-100-053, subject to the findings and conditions of the Agenda Report dated May 17, 1998, as follows: Section 1: Environmental Findings. A. The project is a General Rule Exemption from environmental review; and B. Issuance of the Certificate will not be detrimental to the people of Butte County or other properties in the territory in which the property is situated; and Section 2: General Findings. A. The parcel is in conformance with the Butte County Zoning and General Plan; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, recommend the Development Review Committee approve this Determination and issue a Certificate of Compliance, subject to the following conditions. Road, approximately 1,800 ft. west of Meridian Road, in the Chico area. This project is located in an area zoned A-10 (Agricultural, 10 acre minimum). This project is located in Supervisorial District 3. RELATED ITEMS: None FOR: Development Review Committee Meeting of May 28, 1998. SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of this request. ANALYSIS: The 10 acre parcel was created as a remainder parcel by Deed in Book 1717 of Deeds at Page 697,recorded on December 6, 1972. The current A-10 zoning for the project site was established on May 16, 1978 by Ordinance No. 1924. The Land Use Element Map of the Butte County General Plan designates the project parcel as Agricultural Residential. The size of the parcel meets the size requirement of the A-10 zoning and of the General Plan. The parcel currently has two legally established dwellings. Domestic water for the project is obtained from an on-site well. Sewage disposal is handled by an on-site septic system. The Butte County Fire Department has recommended a note be placed on the certificate that requires any new development on the project parcel to meet the Fire Safe Regulations of Butte County and Public Resources Code 4290 and 4291. The Butte County Public Works Division has stated the applicant will need to provide two-way traversable access to the parcel from a publicly maintained road or state highway. Butte County Environmental Health Division has no comments. ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California Environmental Quality Act(CEQA)provisions of Section 15061,the General Rule exemption.
