(LP) (DET98-11) The hearing was opened to the public. Robert Berry said he filed the Record of Survey with the Country and has a septic permit. He asked that this be approved. He said a preliminary map has been filed with the County. There was a brief discussion on disclosure laws and the title companies. Chairman Hunt said that Title Companies generally do not insure for County codes. Mr. Crawford explained PRC 4290 to the applicant and what he might expect. Mr. Reid said this should be a conditional certificate. The hearing was closed. It was moved by Mr. Reid, seconded by Ms. Cage, and unanimously carried to approve a Conditional Certificate of Compliance for Robert Berry, on AP 072-380-009, subject to the conditions and findings listed below. If the applicant complies with all the conditions prior to recording the Conditional Certificate a clean Certificate maybe issued. Section 1: Environmental Findings. A. The project is exempt from environmental review under the General Rule exemption; and B. Issuance of the Certificate will not be detrimental to the people of Butte County or other properties in the territory in'which the property is situated; and Section 2: General Findings. A. The parcel is in conformance with the Butte County Zoning and General Plan; and Section 3: Action. A. This project is located in an area zoned M-R(Mountain Recreational, 5 acre minimum parcel size). This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Development Review Committee Meeting of July 9, 1998. SUMMARY: This is a report for a Determination for a Certificate of Compliance. Staff recommends approval of this request. ANALYSIS: The 7.45 acre parcel was created by deed in Book 1729 of records at page 395, recorded on January 18, 1972. The current M-R zoning for the project site was established on December 9, 1969 by Ordinance No. 1058. The Land Use Element Map of the Butte County General Plan designates the project parcel as Agricultural Residential. The size of the parcel meets the size requirement of the M-R zoning and of the General Plan. No improvements have been made to the parcel. Domestic water for any future development on the project parcel will be obtained from an on-site well. Sewage disposal will be handled by an on-site septic system. The Butte County Fire Department has recommended a note be placed on the certificate that requires any new development on the project parcel to meet the Fire Safe Regulations of Butte County and Public Resources Code 4290 and 4291. The Butte County Environmental Health Division has stated the applicant will need to show space and soil availability on the project parcel for a sewage disposal system. ENVIRONMENTAL DOCUMENTATION: This project has been determined to be exempt from the California Environmental Quality Act (CEQA)provisions under the General Rule exemption.
