(LP) (DET 99-01) Mr. Doody gave a brief summary of the project. Chairman. Edell explained that a gift deed is not a parcel created for sale, lease, or finance. Gift deeds only require compliance with zoning, Environmental Health, and' access to a County maintained road. He said a Certificate of Compliance allows the County the chance to condition this parcel and allows the owner to sell, lease, or re-finance the parcel. The hearing was opened to the public. No on was present to speak. The hearing was closed. Mr. Erickson asked that Condition 3 be deleted. He said to change Condition 4 to place the following informational note on the Certificate of Compliance, "Provide evidence that there is adequate water etc." Chairman Edell said he can issue a Certificate of Compliance with a condition on it that prior to development they meet the condition. He said if he changes #4 to a note it will not work. Mr. Erickson said to leave Condition 4 as is. It was moved by Mr. Nelson, seconded by Ms. Cage, and unanimously carried approve the Determination and issue a Certificate of Compliance,subject to the findings and conditions, deleting Condition 3 and renumbering Condition 4. Section 1: Environmental Findings. A. The project is exempt from environmental review under the General Rule exemption; and Section 2: General Findings. A. I I I i ■ BC DEVELOPMENT REVIEW COMMITTEE MINUTES'■ DECEMBER 10, 1998 ■ b ' BUTTE COUNTY DEVELOPMENT REVIEW COMMITTEE AGENDA REPORT - DECEMBER 10, 1998 Applicant: Fair Oaks Presbyterian APN: 061-630-024 Church Location: On the north side of Douna File#: DET 99-01 Countre Ln. at the intersection with Deer Request: Legal Lot Determination Meadow Rd., Oroville area G.P.: Agricultural Residential Parcel Size: 10 acres Zoning: U(Unclassified) Zone date: 11-06-87 SUMMARY: This report is for a Determination for a Certificate of Compliance. Staff recommends approval of this request. Upon approval, the subject property may be sold, leased or financed without further compliance with the Subdivision Map Act. PROJECT DESCRIPTION: A vacant 10 acre parcel created by gift deed in Book 86-04932 recorded on February 12, 1986 in the Office of the Recorder of Butte County. APPLICABLE REGULATIONS: The subject property complies with applicable provisions of the Subdivision Map Act pursuant to Section 66499.35 et. seq. and the Butte County Code. CEQA ISSUES: This project has been determined to be exempt from the California Environmental Quality Act (CEQA)provisions under the General Rule exemption. ANALYSIS: The current U (Unclassified) zoning for the project site was established on September 17, 1985 by Ordinance No. 2488. This ordinance allowed parcel sizes consistent with the General Plan. The Land Use Element Map of the Butte County General Plan designates the subject property as Agricultural Residential. The size of the parcel meets the size requirement of the U zoning at the time the parcel was created and of the General Plan. No improvements have been made on the parcel. Domestic water for any future development on the subject property will be obtained from an on-site well. Sewage disposal will be handled by an on-site septic system. The Butte County Fire Department has recommended a note be placed on the certificate that requires any new development on the project parcel to meet the Fire Safe Regulations of Butte County and Public Resources Code 4290 and 4291. The Butte County Environmental Health Division has stated the applicant has adequate space and soil availability on the project parcel for a sewage disposal system. RECOMMENDATION: Staff recommends that the Development Review Committee approve the Determination for Fair Oaks Presbyterian Church, on APN 061-630-024 subject to the following findings and conditions. Section 1: Environmental Findings. A. The project is exempt from environmental review under the General Rule exemption; and Section 2: General Findings. A.
