AYES: Commissioners Cage, Nelson, Leland, and Chairman Lambert NOES: No one ABSENT: No one ABSTAINED: Commissioner Mooney ❑ Butte County Planning Commission.Minutes- December 11, 1997 0 AGENDA REPORT TO: Honorable Chair and Planning Commission BY: Planning Division DATE: December 3, 1997 REQUEST: General Plan Amendment, File #98-02 & Rezone, File #98-02 - Department of Development Services, on APN 005-417-015: A request for a General Plan Amendment and a Rezone to change the General Plan designation from Low Density Residential to Public, and zoning from A-R (Agricultural Residential) to P-Q (Public-Quasi Public), on a 0.12 acre lot to allow future use of the site for community counseling and meeting center. The project site is located at 1010 Cleveland Avenue, in Chico. The project is located in Supervisorial District 2. RELATED ITEMS: None FOR: Planning Commission Meeting for December 13, 1997 SUMMARY: The request for a General Plan Amendment from Low Density Residential to Public and a rezone from A-R to P-Q does not conflict with the goals and policies of the General Plan, nor does this request present any environmental concerns to staff. Staff recommends the Planning Commission recommend approval of this application to the Board of Supervisors. PROJECT CHARACTERISTICS: The project site is located on the northeast corner of Cleveland Avenue and Guill Street, in Chapmantown, in the Chico area. The eastern property line abuts to the City of Chico's 20th Street Community Park. There is a single family residence with a detached garage on the project site. The site is bordered on three sides mostly by lots of similar size with one property considerably larger to the south. The neighborhood is characterized as having smaller, older homes with a mixture of constructed homes and some mobile homes. The neighborhood is a historic community with an identity separate from that of the City of Chico which nearly surrounds it. Part of this identity includes a semi-rural character, narrow roads, and moderate priced housing. In the immediate vicinity of the project site, there is an elementary school, a community center, and a large community park. Access to the project site is provided by a County maintained road, Cleveland Avenue. Traffic circulation in and around the project site is good, with considerable pedestrian traffic provided by an access to the community park at the end of Cleveland Avenue at the southeast corner of the project site. Sewer.and water will continue.to be provided to the property as it has been - from on-site systems. ANALYSIS: The request for an amendment to the General Plan Land Use Element from Low Density Residential to Public and a rezone from A-R to P-Q does not raise any policy issues of concern. The Public land use designation is to provide for government .operated facilities and for quasi-public uses such as hospitals, churches and utilities. ■ Butte County Department of Development Services■ Planning Division ■ 1 These activities are compatible with the uses found in a residential land use designated area. The purpose of such Public uses meet the needs of the residents of the community. The site design criteria for a Public designation are met with this application. These requirements include: 1. Need for public use within 20 years. 2. Adequate utilities, water supply and sewer disposal capabilities. 3. Suitable location and road access for type of use. 4. Adequate police and fire protection. 5. Sufficient space for future expansion. The site was recently purchased by the County of Butte and the proposed use of the site is as a counseling center/community meeting place. This use is consistent with the requested zoning and General Plan Amendment. The request for a rezone from A-R to P-Q does not conflict with any General Plan policies. The general nature of P-Q uses is compatible with the A-R zoning, which provides for such uses with a use permit. Rezoning this parcel to P-Q concurrently with a-General Plan Amendment to Public, will assure consistency with the Public land use designation. Staff has determined there are no environmental issues of concern related with this project. Staff has determined that a Categorical Exemption is appropriate and this project should be exempt from the provisions of the California Environmental Quality Act. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be exempt from the California Environmental Quality Act (CEQA) as it is classified as Categorically. Exempt (Class 3), and as such, is not subject to the requirements of CEQA. This Section allows for an exemption to CEQA requirements when the project consists of". . . conversion of existing small structures from one use to another . . . ". RECOMMENDATION: Staff recommends that the Planning Commission recommend that the Board of Supervisors approve the applicant's request for a General Plan amendment from Low Density Residential to Public, and approve a Rezone from A-R to P-Q (Public - Quasi Public) on the parcel APN 005-417-015, subject to the findings listed in Exhibit A. WHEREAS, a public agency, Department of Development Services has petitioned the Butte County Planning Commission and Board of Supervisors, through an appropriate application, to amend the Butte County General Plan Land Use Element, including the Chico Area Land Use Plan, for a change from Low Density Residential to Public for that property identified on Exhibit A-1 attached hereto; and WHEREAS, the proposed General Plan Amendment has been studied and reviewed by the Butte County Planning Commission and a public hearing held pursuant to law, at which time all'interested persons were heard; and WHEREAS, the Butte County Board of Supervisors has determined this project to be Categorically Exempt under California Environmental Quality Act, Section 15303, Class 3; and WHEREAS, the Butte County Board of Supervisors has held hearings on the General Plan Amendments at which all interested parties were heard; and WHEREAS, the Butte County Board of Supervisors finds the proposed amendment complies with all elements of the Butte County General Plan and comprises an overall internally consistent whole, specifically: 1. The project i$' is consistent with the goals and.policies of the Butte County General Plan and Chico Area Land Use Plan. DISCUSSION: At their December 11, 1997 ming the Planning Commission held a public hearing on this request for an amendment to the General Plan Land Use Element from Low Density Residential to Public and a rezone from A-R to P-Q. There was no discussion from the public and the project does not have any significant environmental concerns or raise any policy issues. The Public land use designation intended to provide locations for government operated facilities and quasi- public uses such as hospitals, churches, and utilities. .These uses are generally compatible with residential uses and are needed in a variety of locations throughout the community. The subject property meets the site designation criteria for a Public land use designation on page LUE-60 of the Butte County General Plan. Approval of this project will open the way for Butte County to convert an existing single family residence to a community facility to be used for counseling, meetings, and other educational purposes.
