Hogan, Planning Manager BY: Thomas Last, Senior Planner DATE: July 11, 1994 REQUEST: GPA and Rezone 94-109 - Butte County Board of Supervisors: A request to change the land use designation from Low Density Residential to Industrial and a Rezone from A-R to M-1 on .84 acres of land located on the northeast side of the Humbolt Avenue and Bartlett Street intersection, within the Chapmantown area of Chico. RELATED ITEMS: 1994 Chapmantown-Mulberry Improvement Plan FOR: Planning Commission Meeting of July 28, 1994 ABSTRACT: This proposal will provide industrial designations to an existing commercial/manufacturing use. Approval will not result in any conflicts with County regulations. No major issues have been identified. Staff recommends approval of this application. PROJECT CHARACTERISTICS: These requests are to change the land use designation on the two parcels from Low Density Residential to Industrial and rezone the .84 acres from A-R to M-1. The requests are initiated by the Board of Supervisors as part of the first step in addressing the non-conforming use issues that are found in the Chapmantown area. One parcel contains Square Deal Mattress. This business has been in operation at this location since 1920. The eastern parcel contains a homesite that appears to be abandoned. The project site is level and in an urbanized area. Surrounding development consists of residential homes with scattered commercial and industrial uses. The site presently utilizes septic tanks and leach fields. However, public sewer is available to the site. California Water Service Company provides water to the property. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING LAND USE: Direction Zoning General Plan Existing Land Use Project: A-R Low Density Residential Commercial/Manufacturing . North: A-R Low Density Residential Residential ■ Butte County,Department of Development Services - Planning Division ■ 1 AGENDA ITEM South: A-R Low Density Residential Residential East: A-R Low Density Residential Residential West: A-R Low Density Residential Residential ANALYSIS: In early 1992, the Board of Supervisors commissioned a study of the Chapmantown area. Subsequently, the Chapmantown-Mulberry Improvement Plan was presented to the Board of Supervisors on April 12, 1994. The third requested action stated "Initiate General Plan and Zoning amendments on Humbolt Avenue to encourage local businesses now desiring to expand." Square Deal Mattress was specifically identified as one of the businesses in the motion. As indicated earlier, this business is considered a non- conforming use. Current County Code requires Use Permit approval for any expansions of non-conforming uses. The requested actions will allow an existing business to expand their operations without going through the Use Permit process. The property owners have indicated their desire to expand the facility adjacent to the existing operation. Several buildings in the area currently house the Square Deal Mattress operations. The subject property is not adjacent to a similar zone. However, there are many commercial and industrial uses located in the Chapmantown area that are classified as non-conforming uses. Based on the Chapmantown-Mulberry Improvement Report, the County needs to take a lead in resolving the non-conforming use issue. The .Report recommended that the Board of Supervisors take actions to enhance expansion and improvement opportunities for local businesses. This action is the first step that will allow the area to be improved and upgraded, while minimizing the costs to the local businesses. The City of Chico and the Butte County Fire Department request several conditions be added to the rezone. The City of Chico requests full street improvements along both street frontages, storm drainage improvements, and possible connection of sewer (See attached letter). Since this is a rezone and General Plan request, road improvements would be addressed at time of building permit issuance. The City and County Public Works Department, respectively, indicate that public improvements would be required as part of an annexation to the City, or issuance of a building permit for expansion. County Fire requests payment of the Cal Water hydrant fund. Fire hydrants are in place along this site. Within local jurisdictions, outside the State Responsible Areas, the Fire Department does not have the ability to collect fees at time of building permit issuance. If the fees are not attached to the rezone, they could not be collected when building permits are requested. In the past conditional rezones have been used but are proven to be difficult to track since they are not tied to a project. Therefore, staff does not support a conditional rezone. The Industrial General Plan designation identifies manufacturing as a primary use and light commercial as a secondary use. The M-1 zone allows both commercial and industrial uses. Therefore, these requests are consistent with one another and with the existing activities occurring on the property. ■ Butte County Department of Development Services - Planning Division ■ 2 AGENDA ITEM ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. An Initial Study has been prepared by County staff. Based upon the a review of the Initial Study, staff has determined that the project will not result in any significant impacts on the environment. A Negative Declaration is recommended. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing occurred on June 23, 1994 in the Chico Enterprise Record. Twenty-four public notices were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the application on AP# 004-371-014, 015, subject to the following conditions. Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and B. The design of the subdivision and improvements will not cause environmental damage to fish or wildlife or their habitat. C. The Planning Commission has independently reviewed,analyzed, and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgement of the Butte County; and Section 2: Zoning Ordinance Findings. A. Find that the General Plan Amendment conforms with the intent of the Butte County General Plan and is consistent with the Chapmantown-Mulberry Improvement Plan. B. Find that the rezone is consistent with the Butte County General Plan. Section 3: Actions. A. Butte County Board of Supervisors - proposed Negative Declaration regarding environmental impacts, General Plan Amendment from Low Density Residential to Industrial and Rezone from A-R (Agricultural Residential) to M-1 (Light Industrial) for property located on the northeast corner of Humboldt Avenue and Bartlett Street, identified as AP x.371-014, 015, Chico. (TL) (File 94-109) The Commission waived the presentation of the Staff Report. Tom Last said this application was initiated by the Board of Supervisors to address the nonconforming use in the Chapmantown area. He gave a brief summary of the Chapmantown study that was done. Commissioner Nelson said he drove around the block of this site, and it is totally surrounded by residential homes. He said the way it is now, the applicant needs a Use Permit to expand. He was concerned with taking away the requirement for a Use Permit to expand. Mr. Last said that Square Deal Mattress has been there since 1920. Commissioner Nelson said he was concerned with spot zoning industrial in the middle of a residential area. Mr. Hogan said the use has been there for a long time, without problems. He said the expansion can not be for any use that is objectionable because of noise, odor, smoke, dust, bright light, vibration or involving the handling of explosives or dangerous materials. Commissioner Nelson said he would be more comfortable with a conditional zoning. Mr. Last said this is a proposal for the expansion of Light Industrial uses only. Commissioner Lynch said he would like to limit the permit to the owner of the property and not have the Use Permit go with the land. Mr. Hogan said he believes Supervisor Dolan will be pursuing additional requirements for the Chapmantown area with a Specific Plan. Chairman Lambert questioned Section 1, Item B, Page 3, of the Staff Report as pertaining to this project? Mr. Last said this item should be deleted. 4 The hearing was opened to the public. RELATED ITEMS: 1994 Chapmantown-Mulberry Improvement Plan FOR: Board of Supervisor meeting of October 11 , 1994 ABSTRACT: The Planning Commission recommended that the Board approve the project by a 4-0 vote. This proposal will- provide industrial designations to an existing commercial/manufacturing use. Approval will not result in any conflicts with County regulations. No major issues have been identified. Staff recommends approval of this application. PROJECT CHARACTERISTICS: These requests are to change the General Plan land use designation on two parcels from Low Density Residential to Industrial and rezone the .84 acres from A-R to M-1. Both properties are owned by Square Deal Mattress. The requests are initiated by the Board of Supervisors as part of the first step in addressing the non-conforming use issues that are found in the Chapmantown area. One parcel contains Square Deal Mattress. This business has been in operation at this.location since 1920. The eastern parcel contains a homesite that appears to be abandoned. The project site is level and in an urbanized area. Surrounding development consists of residential homes with scattered commercial and industrial uses. The site presently utilizes septic tanks and leach fields. However, public sewer is available to the site. California Water Service Company provides water to the property. ANALYSIS: In early 1992, the Board of Supervisors commissioned a study of the Chapmantown area. Subsequently, the Chapmantown-Mulberry Improvement Plan was approved by the Board of Supervisors on April 12, 1994. One of the actions approved by the ■ Butte County Department of Development Services -Planning Division ■ 1 r AGENDA ITEM Board was "Initiate General Plan and Zoning amendments on Humbolt Avenue to encourage local businesses now desiring to expand." Square Deal Mattress was specifically identified as one of the businesses in the motion. This business is now considered a non-conforming use. The property owners have indicated their desire to expand the facility adjacent to the existing operation. Several buildings in the area currently house the Square Deal Mattress operations. Current County Code requires Use Permit approval for any expansions of non-conforming uses. The requested actions will allow an existing business to expand its operations without going through that process. The subject property is not adjacent to a similar zone. However, there are many commercial and industrial uses located in the Chapmantown area that are classified as non-conforming uses. Based on the Chapmantown-Mulberry Improvement Plan, the County needs to take a lead in resolving the non-conforming use issue. The Plan recommended that the Board of Supervisors take actions to enhance expansion and improvement opportunities for local businesses. This action is the first step that will allow the area to be improved and upgraded, while minimizing the costs to the local businesses. j Several conditions were requested to be added to the rezone by commenting agencies. These issues are discussed on page 2 of the July 11, 1994, Planning Commission Agenda Report. Since a majority of the issues are addressed as part of the building permit stage, neither the Planning Commission nor staff support a conditional rezone. The Industrial General Plan designation identifies manufacturing as a primary use and light commercial as a secondary use. The M-1 zone allows both commercial and industrial uses. Therefore, these requests are consistent with one another and with the existing activities occurring on the property. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and is subject to the requirements of CEQA. An Initial Study has been prepared by County staff. Based upon the a review of the Initial Study, staff has determined that the project will not result in any significant impacts on the environment. A Negative Declaration is recommended. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement occurred in the Chico Enterprise Record. As of the date of this report we have received no public comment. Storm Drainage a To my best recollection, previous assessments have characterized that backyard reach of Dead Horse Slough from State Highway 99 westerly to Willow Street as a potential attractive nuisance and health and safety concern. Of the solutions proposed in various storm drain studies, the most straightforward was by Rolls, Anderson and Rolls to the County to intercept Dead Horse Slough immediately west of State Highway 99 and install a storm drain outfall directly south to Little Chico Creek. It was envisioned that the bulk of Dead Horse Slough could then be filled, retaining only a shallow swale, if necessary, for backyard drainage. This proposed development should be compatible with the solution to this problem and incrementally implement, to the maximum extent possible, that solution. b. Prepare a storm drain study for the future local storm•drain system serving the area tributary to Humboldt Road from Willow Street to State Highway 99. Install those portions of the storm drain system adjacent to these lots, including a•storm drain outfall to Little Chico Creek if appropriate. c. Incorporate storm drain runoff management facilities into the site design and construction. The object is no net increase in peak flow from the site to Little Chico Creek and first flush pollutant runoff control 3. To my best recollection, previous assessments have characterized that backyard reach of Dead Horse Slough from State Highway 99 westerly to Willow Street as a potential attractive nuisance and health and safety concern. Of the solutions proposed in various storm drain studies, the most straightforward was by Rolls, Anderson and Rolls to the County to intercept Dead Horse Slough immediately west of State Highway 99 and install a storm drain outfall directly south to Little Chico Creek. It was envisioned that the bulk of Dead Horse Slough could then be filled, retaining only a a shallow swale, if necessary, for backyard drainage. This proposed development should be compatible with the solution to this problem and incrementally implement, to the maximum extent possible, that solution.- b. olution:b. Prepare a storm drain study for the future local storm drain system serving the area tributary to Humboldt Road'from Willow Street to State Highway 99. Install those portions of the storm drain system adjacent to these lots, including a storm drain outfall to Little Chico Creek if appropriate. c. Incorporate storm drain runoff management facilities into the site design and construction. The object is no net increase in peak flow from the site to Little Chico Creek and first flush pollutant runoff control. 3. Sanitary Sewer Should this property remain in the County while connecting to the City sewer system, the City Code requires that public improvements and right of way dedications be in conformance with City standards. This results in many non-conforming uses. I ' Analysis and Options: a) The simplest and least time consuming way to deal with an expansion is to apply for a Use Permit. The proposal appears to be straight forward and no significant issues would occur. b) A Rezone to C-1 or C-2, either initiated by the applicant or the County, will also require a General Plan Amendment to maintain consistency. "Spot zoning"will occur if other properties, especially to the north, are not included. c) The County needs to consider the larger issue of dealing with all the non- conforming uses in Chapmantown. There are several isolated commercial uses within several blocks of the subject site. We need to consider the ramifications of any special treatment to this business. i d) An option to consider is to develop a special General Plan Policy and zone that allows mixed uses in the Chapmantown area. All legally established non- residential uses could then be classified as permitted activities, not requiring special permits, or requiring an administrative permit to minimize potential conflicts. This option would take some time to implement, but it would be. County initiated and would not cost the applicant any money.
