As you can see from the memo attached, a related General Plar Amendment and rezone were being processed, put on hold, and have been lingering in the system ever since. I'd love to close the applications out, but won't if the project is going to come back to life. The GPA/REZ appears to have been initiated by the Director of Development Services, so it can be closed by the Director. (And rein tiated if necessary in the future.) The Department of Development Services Planning Division is recommending that the Planning Commission continue the item open until the issue of the proposed fire station by the City of Chico is resolved. - wT rF O O 0 O 0 Memorandum, o UN TO: Honorable Chair and Planning Commission FROM: Mark Michelena Associate Planner SUBJECT: Butte County Department of Development Services, File# GPA/RZ 03-01, APN 007-240-078 Continue to July 10, 2003 (Tentative) DATE: May 20, 2003 This project was continued open from the April 24, 2003, Planning Commission Hearing at the request of the Department of Development Services Planning Division. The continuance was requested to allow the Planning Division to address County Counsel concerns regarding the proper procedure for imposing conditions on a General Plan Amendment and Rezone. County Counsel expressed concern with the use a Conditional Zoning Agreement to impose the conditions under consideration for this project. The proposed conditions are similar to what would be imposed through a Use Permit process; however, the County Counsel indicated that it was not appropriate to condition a General Plan Amendment in this manner. The recommended conditions are as follows: 1. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 2. Prior to issuance of building permits deed to Butte County, in fee simple, 40 feet of right-of-way from the Centerline of Eaton Road. The right-of-way shall be sufficient for installation of a standard No. S-5 at all street intersections. 3. Prior to issuance of building permits submit road and drainage improvement plans for installation and construction of the street frontage improvements on Hicks Lane to RS-2A (4-Lane) standards including but not limited to vertical P.C.C. curb, gutter and sidewalk and the required street section. Submit plans to Department of Public Works for review and approval. 4. Prior to the issuance of building permits dedicate a one foot "no access strip" or relinquish abutters rights to Butte County, along the Eaton Road frontage of parcel 007-240-078, except at approved access points. 5. Prior to the recordation of the issuance of building permits a plan for a permanent solution for drainage shall be submitted prior to and approved by the Department of Public Works. The drainage plan shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 6. Prior to the issuance of a building permit all wells not proposed to be used shall be destroyed under a valid Butte County Environmental Health Division permit. 7. Prior to the issuance of a building permit meet the requirements of the Nitrate Compliance Area 8. Prior to issuance of a building permit a landscape plan shall be submitted detailing screening between the proposed use and surrounding residential area 9. All outdoor trash storage and collection facilities shall be enclosed by a solid masonry wall or view-obscuring fence at least one (1) foot higher than the trash container. The Department of Development Services and County Ccunsel have determined that a deed restriction would be the better course of action to impose these conditions, and to ensure that they are enforced in the future. Additional structures may be placed on the site, or existing structures could be used. The proposed use is the relocation of Butte County Fire Station #42 facility which is currently located on Cohasset Road. There will be 3 to 5 full time on-site firefighters along with a varying number of volunteer firefighters that will be present when called. Access to the site will be from a driveway off either East Eaton Road or Hicks Lane,approximately 250 feet east of State Route(SR) 99. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 1 0 The project site is currently developed with five existing structures,which were used for boat repair and sales. The on-site structures may or may not be used by the proposed fire station. The site is level and does not contain any unusual physical characteristics. Non-native trees are found on the site. The site is not within a 100-year flood zone. The project is located near the Chico Municipal Airport, within Compatibility Zone "C-2". The project was reviewed by the Airport Land Use Commission and was found consistent. The parcel is not subject to a California Land Conservation Agreement contract ("Williamson Act"). Surrounding parcels to the north and east are zoned A-SR(Agricultural—Suburban Residential)and have a General Plan land use designation of Low Density Residential. Parcels to the west are zoned C-C (Community Commercial) and have a General Plan land use designation of Commercial. Parcels to the South are zoned C-1 (Light Commercial) and have a General Plan land use designation of Commercial. Surrounding and nearby parcels range in size from one-half to 2.5 acres. The predominant land uses in the project area are residential dwellings at rural/suburban densities. The project site is located to the northeast of the City of Chico(across the intersection of East Eaton Road and Hicks Lane),and is within the City of Chico Sphere of Influence and the Chico Urban Area. ANALYSIS: The site has been used for several different commercial uses over the years. The last commercial use was a boat repair and sales yard. The site is located at the intersection of two major roads,which is an appropriate location for a commercial use. The initial study for this project did not identify any significantly potential impacts,but did identify several that would have a less than significant impact. Due to the inclusion of required conditions as part of project approval,the rezone to Public/Quasi-Public is a"conditional rezone." A conditional zoning agreement, listing the conditions of project approval, must be signed and recorded by the applicants. Some of the conditions are: • The site must be developed in accordance with the future site plan. • Prior to issuance of a building permit all wells not proposed to be used shall be destroyed under a valid Butte County Environmental Health Division permit. • Drainage plans must be submitted to and approved by Caltrans and the Butte County Public Works Department. Consistency with the General Plan The proposed project does not require the extension of sewer or water and will not substantially detract from existing surrounding uses. The proposed use will not create a concentration of public uses in the area because only the proposed use will be allowed on the site and the parcel will not be able to be divided. The proposed use is compatible with and will not adversely impact surrounding land uses because the type of use will help provide better fire safety to the area north of Chico in Butte County. Finally, the site is serviced adequately by East Eaton Road, Hicks Lane and State Route(SR)99. Proposed traffic improvements on East Eaton Road,Hicks Lane and the northbound State Route (SR) 99 off-ramp will improve circulation in the area. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 2 0 Because the project is proposed for a Public General Plan land use designation, the Butte County General Plan Land Use Element's Goals and Policies apply to this project. Approval of this project will locate the Fire Station #42 and improve the level of fire service to the North Chico area. The proposed project is consistent with the following applicable policies found in the Land Use Element: 5.7.a Locate new fire stations with consideration to accessibility, future development and natural fire hazards. 5.7.b Encourage central and convenient locations for all government buildings consistent with land use plans. General Plan Criteria and Zoning Factors The Public General Plan land use designation has five criteria for inclusion of parcels into this designation. They are: 1. Needed for public development within 20 years. The purpose of this General Plan amendment and rezone is to allow for the relocation of an existing Fire Station #42 on Cohasset Road in Chico. The site would better serve the north end of the County. 2. Adequate utilities, water supply, and sewage disposal capabilities. Electrical and phone utilities already extend to the site. No other commercial uses are located near the site. The site is located in an area that contains large valley aquifers. The Butte County Environmental Health Department did not indicate that the soils on the site are inadequate for an on-site septic system. All septic systems on the site must meet the requirements of the Environmental Health Department. 3. Suitable location and road access for this type of use. The site is located on East Eaton Road and Hicks Lane, approximately 250 feet east of the northbound Highway 99 on-ramp. The project site is an appropriate location for this public use to better serve the north area of Chico. 4. Adequate fire and police protection. The use will not require any additional services to be provided due to the fact that this fire station is being relocated and not a new facility. 5. Sufficient space for future expansion. The proposed fire station site plan has not been completed at the time of the staff report. The site was chosen knowing it would handle the future needs for fire service. Zoning Factors 1. Size of'parcel and proposed use. The parcel was determined to have the necessary size to accommodate the proposed fire station. 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 3 0 2. Permanency of facility. The relocation of Fire Station #42 to this site will better serve the growing population in the North Chico Area. This location will serve as a permanent or semi-permanent location and the proposed P-Q (Public, Quasi-Public) zone would be appropriate rather than the existing Commercial zone which would allow the fire station with a Use Permit. However, there are no guarantees that this relocation will be of a permanent nature. Determination of new,or relocation of existing facilities,will depend on the demand needs of the area. 3. Protection of surrounding residences and other uses. The area is a mixture of residential, commercial and industrial uses. The addition of the Fire Station facility will not adversely affect the aesthetic character of the area. 4. Suitability of site for proposed use. This site was determined to be adequate to handle the anticipated use required for the Fire Station facility. 5. Effects on water quality, air quality, noise, traffic flow and safety, and general environmental quality. The various impacts that the proposed project may cause are addressed as follows: Water Quality All wastewater generated by proposed use would be handled by individual on-site septic systems. The Butte County Environmental Health Division does not object to the use of septic systems on the site. Septic systems placed on the site must meet the requirements of the Butte County Environmental Health Division. Less than significant impacts to surface water or ground water are anticipated from the proposed use of septic systems on the site. The proposed use will have the same or less impervious surfaces than the existing use on-site. Therefore, no increase in surface water runoff is expected due to any additional impervious surfaces being proposed. Future development of the parcel shall be performed in a manner that will not create adverse drainage conditions. The proposed use shall be served by public water and will not substantially deplete groundwater supplies or interfere substantially with groundwater recharge such that there would be a net deficit in aquifer volume or a lowering of the local groundwater table level. Air Quality Vehicle traffic generated by the project site would not result in a cumulative impact on air quality due to this being a relocated fire station,rather than an additional station. There would not be a net increase of any criteria pollutant or additional exposure to sensitive receptors to substantial pollutant concentrations since no new facilities are being added only an existing one is being relocated. The proposed will not generate objectionable odors that would affect a substantial number of people. Potential odors from the site could be from diesel and gasoline being on the property, but they would be less than significant. 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 4 ■ Noise: The uses associated with this project would not create a significant increase in ambient noise levels within or in proximity to the project site. The project site/area is subject to periodic noise generated by the sirens of the fire engines and the engines themselves. The Butte County Noise Element states the noise environment of a community has a base of steady background noise made up of many sources. The noise of individual events, such as a fire engine siren, is.superimposed on this background. Butte County Noise Element determines that noise levels up to 60 dB CNEL are normally acceptable for residential areas. The noise element also states that Ldn or CNEL are descriptions of diurnal in noise levels. They are a weighted average of daytime and nighttime sound levels, with the nighttime noise being weighted more. heavily. While the use has the potential to create noise levels of a short duration that exceed both the day and night (50 db CNEL) acceptable level, over the 24-hour time period for measuring the noise level, the use will meet the acceptable level. Since the duration of the fire engines and sirens are for short,intermittent timeframe,there will not be significant ongoing noise effect on the surrounding area. Construction activities on the site would temporarily generate high noise levels on and adjacent to the project site intermittently during project development activities, especially during grading activities. This construction noise would not have a significant impact on nearby residents because the noise would be intermittent and short-term in nature. Very little grading would be necessary due to the level topography of the site. Traffic Flow and Safety: The proposed fire station use will not result in a large amount of vehicle traffic that will impact road capacities. During an emergency, traffic would be delayed for a very brief time while the fire engines leave the station. General Environmental Quality: All of the vegetation on the site consists of non- native trees and grass. The site does not contain any wetlands or vernal pools,nor is it known to be habitat for any rare, endangered, tireatened plant, or animal species. 6. Local Desires. The relocation of the Fire Station#42 will better serve the residents in North Chico. The new location is in more of a commercial/industrial area, which will reduce impacts of residential areas. Determining that the General Plan Amendment is within the Public Interest California Government Code Section 65358 indicates that amendments to the General Plan can be approved by the legislative body when they are found to be in the public interest. In order to approve a General Plan amendment, the Planning Commission must recommend to the Board of Supervisors that this action is in the public interest. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 5 0 Aesthetic Concerns The project will not result in a significant change in the visual aesthetics on a portion of the site, with the change being from a commercial use to a fire station. Some of the existing commercial use would be removed while new structures to house the fire equipment and firefighters would be constructed. The final design of the proposed building(s) has not been determined, but will not be out of character to the area. In order to ensure that landscaping is installed,a landscape plan shall be submitted to and approved by the Planning Division prior to issuance of a building permit for the new structure/structures. The project is not expected to cause a significant visual impact due to the existing mix of uses in the area, including industrial, commercial and residential. Appropriate landscape screening will be required to soften the edge between the proposed public facility and residential area. The City of Chico commented on this project and stated development of the site should take into consideration the potential realignment of Hicks Lane. The proposed site development will be designed to work with the all potential scenarios, including the existing alignment and all potential realignments of Hicks Lane. This project is conditioned to prohibit public uses other than what is proposed from being established on the project site. The site will be minimally lighted for nighttime safety. These lights should not create any glare to spill out into residential areas. Agricultural Impacts The proposed use will not have agricultural impacts. There i3 no California Land Conservation Agreement ("Williamson Act") affecting the project site. The P-Q zoning district allows by right only a few types of uses, such as public schools, public parks,public playgrounds,public hospitals,and publicly owned buildings and land. At the present time, the site is proposed only for a fire station and potential battalion office headquarters. An additional condition of approval shall be incorporated to prohibit any land divisions of the parcel. The Butte County Agricultural Commissioner had no objections. Storm Water Drainage Impacts This project will not ultimately result in the creation of new impervious surfaces so no significant increase in surface water runoff can be expected due to the proposed use. The Butte County Public Works Department commented on the project and were concerned about the increase in surface water runoff caused by development of the site. In order to prevent any significant surface water runoff impacts,drainage plans shall be submitted to and approved by each of these agencies. With the construction of the drainage facilities as approved by these agencies,no impacts with respect to surface water drainage from the site are expected. 0 BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 6 0 Vehicle Circulation Impacts The propose project will not cause an increase in traffic which is substantial in relation to the existing traffic load and capacity of the street system(i.e.,result in a substantial increase in either the number of vehicle trips,the volume to capacity ratio on roads,or congestion at intersections). Based on the latest traffic studies by Butte County Association of Governments(BCAG)on January 29,200 1,the three day average on Eaton Avenue east of State Route(SR)99 is 9,979,which is a Level of Service"B",which is an acceptable. The proposed use is a relocation of an existing fire station located on Cohasset Road,just south of Eaton, approximately 1.9 miles away. There is no set formula to determine the number of vehicle trips/day for a fire station,the amount of trips will be determined by the number of staff on duty and the average number of emergency call per day Access to the site will be from East Eaton Road and/or Hicks Lane, and the site driveway will be approximately 250 feet from SR 99. There are no traffic signals located at the intersection of Hicks Lane and East Eaton Road, only a stop sign on Hicks Lane. There are plans for road improvements/realign of Hicks Lane in order to alleviate traffic congestion on East Eaton Avenue and SR 99. Butte County Association of Governments has prepared a Draft Chico Corridor Study on SR 99. Due to the anticipated increase in traffic volumes in the future; the widening of Eaton Road to 4 lanes will create the need for interchange improvements. The realignment of,or widening of,Hicks Lane will also affect the interchange. The proposed improvements have included short term solutions of installing signals at the State Highway and Eaton Road intersections, and mid to long term solutions of reconstructing the SR 99 and Eaton Road interchange. These proposed improvements will help the overall circulation for the area, but as discussed previously, the use proposed, will not generate a significant increase in traffic to the area. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 7 0 ACTIONS FOR CONSIDERATION: Should the Planning Commission find that the proposed conditions found in Section III of this report are satisfactory; staff recommends that the Commission take the following actions. 1. Recommend adoption of a Negative Declaration regarding environmental impacts to the Board of Supervisors, with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act,and that said study did not identify any significant environmental effects and a Negative Declaration is proposed. B. The Planning Commission has considered the proposed Negative Declaration, together with comments received during the review process. C. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Butte County Department of Development Services General Plan and Rezone, Planning Division File No. GPA/RZ 03-01, will have a significant effect on the environment. D. The proposed Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. Il. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is recommended. The collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5, is not required. The project site is not known to contain any species identified as a candidate, sensitive, or special status species in local or regional plans, policies, or regulations, or by the California Department of Fish and Game or U. S. Fish and Wildlife Service. The project will not have a substantial adverse effect on any riparian habitat; have a substantial adverse effect on federally protected wetlands as defined by Section 404 of the Clean Water Act; interfere substantially with the movement of any native resident or migratory fish or wildlife species; conflict with any local policies or ordinances protecting biological resources; or conflict with the provisions of an adopted Habitat Conservation Plan. III. Recommend to the Board of Supervisors approval of General Plan Amendment and Rezone GPA/REZ 03-01 on APN 007-240-078 from Commercial to Public and a rezone from C-2 (General Commercial) to P-Q (Public, Quasi-Public), and recommend that the Board of Supervisors adopt the Ordinance rezoning said property subject to the Conditional Zoning Agreement attached to the Zoning Ordinance as Exhibit "A", with the following findings: ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 8 ■ A. The proposed P-Q zoning is consistent with the proposed General Plan land use designation of Public. F. This General Plan Amendment is in the public interest because it allows a public use that will better serve the residents in the north area of Chico. G. Geographic areas are designated "attainment' if these standards are met and "non-attainment' if they are not met. In addition, each agency has several levels of classifications based on severity of the problem. The project is located within the Sacramento Valley Air District. According to the Butte County Air Quality Management District(BCAQMD),Butte County and all northern Sacramento Valley Air Districts have been designated as "moderate" non-attainment areas for the state standards for ozone (03) and fine particulate matter (PM10). Currently, Butte County is in attainment for all the federal (less stringent) air quality standards. Fugitive dust emissions may occur during development activities on the site, such as removal of existing structures, excavation for building foundations, which may create a temporary nuisance to persons residing or working near the project site if measures are not taken to reduce the emissions. These types of violations are investigated by the Air Quality Management District(AQMD). AQMD would investigate any complaints and ensure that measures are taken to address any substantiated nuisance conditions. Vehicle traffic generated by the project site would not result in a cumulative impact on air quality due to this being a relocated fire station, rather than an additional station. There would not be a net increase of any criteria pollutant or additional exposure to sensitive receptors to substantial pollutant concentrations since no new facilities are being added only an existing one is being relocated. The proposed will not generate objectionable odors that would affect a substantial number of people. Potential odors from the site could be from diesel and gasoline being on the property,but they would be less than significant. Animals that may be found on the project site include typical animals that have adapted to urban/rural interface including rabbits, squirrels, skunk, raccoons, opossum, and various species of birds. Based on information provided in the Butte County General Plan and Master Environmental Assessment, it is not likely that rare or endangered animal species would be found on the project site. Construction activities and the future use on the project site would cause some of the animals currently utilizing the project site to move to new areas. This is not expected to be significant because the project site with sparse vegetation and lack of surface water would not support a large number of animals and the animals typically found in this type of residential agricultural setting are not rare or endangered. This project would not have a significant impact to fish or wildlife habitat and the collection of Department of Fish and Game fees pursuant to Fish and Game Code Section 711.4(d)(3)and 14 CCR 753.5 are not required. The project would not conflict with any local policies or ordinances protecting biological resources. Impact Discussion: The Seismic Safety Element of the Butte County General Plan indicates that all of Butte County is in Moderate Earthquake Intensity Zone VIII. The site is not within an Alquist-Priolo Earthquake fault zone or an after shock epicenter region. The nearest active fault,the Cleveland Hill fault,is located approximately 2.3 miles to the east of the site. There is also the Big Bend Fault, a fault with unknown activity, located approximately 1.9 miles east of the site. The Willow Fault is located 2.5 miles southwest of the site. The intensity of ground shaking at any specific site depends on the characteristics of the earthquake, the distance from the earthquake, and on the local geologic soils and conditions. At present, there is insufficient data to predict accurately the expected ground motions at various locations in Butte County. However, strong seismic ground shaking is closely related to the proximity of active fault lines. With the site being approximately 2.3 miles from the only known active fault in the County, ground shaking and resultant building damage would not be a significant concern because the Uniform Building Code contains standards to address this seismic potential Seismic risk is'not limited to faults which have been currently identified. Some earthquakes originate from unknown sources sometimes characterized as "background seismicity" or "floating earthquakes". The Butte County Master Environmental Assessment indicates that it is reasonable to assume that background seismicity could produce earthquakes as large as Richter magnitude (modified Mercalli intensity scale) 6.5 virtually anywhere in Butte County. There is no current evidence that an earthquake larger than magnitude 6.5 would occur at this location. Earthquakes at this magnitude are generally felt by all persons,but damage is generally slight to minor,with fallen chimneys and cracked plaster the most prominent damage. Richter magnitude 6.5 is not subjectively characterized on the intensity scale, but a magnitude 7 is generally characterized by negligible damage, especially in buildings of good design and construction. Considerable damage can occur in poorly built or badly designed structures. However, the impact would be less than significant due to compliance with the Uniform Building Code. The Butte County Seismic Safety Element's Liquefaction Potential Map indicates that the site has a generally moderate potential for liquefaction. The impact would be less than significant. The Subsidence and Landslide Potential Map of the Safety Element of the Butte County General Plan indicates that there is low to none potential for landslides in this area. The Erosion Potential Map of the Safety Element of the Butte County General Plan indicates that the soil erosion potential for the project site is none. The site,which is relatively flat,is not subject to significant erosion. The Expansive Potential Map of the Safety Element of the Butte County General Plan indicates that the soil expansive potential for the project site is moderate. The Butte County Environmental Health Department does not object to the use of septic systems on the property. Septic systems installed on the site are required to comply with the County Improvement Standards. No impact is anticipated. The noise of individual events, such as a fire engine siren, is superimposed on this background. Butte County Noise Element determines that noise levels up to 60 dB CNEL are normally acceptable for residential areas. The noise element also states that Ldn or CNEL are descriptions of diurnal in noise levels. They are a weighted average of daytime and nighttime sound levels, with the nighttime noise being weighted more heavily. While the use has the potential to create noise levels of a short duration that exceed both the day and night(50 db CNEL)acceptable level,over the 24-hour time period for measuring the noise level,the use will meet the acceptable level. The Uses associated with this project would not create a significant increase in ambient noise levels within or in proximity to the project site. Construction activities on the site would temporarily generate high noise levels on and adjacent to the project site intermittently during project development activities, especially during grading activities. This construction noise would not have a significant impact on nearby residents because the noise would be intermittent and short-term in nature. Very little grading would be necessary due to the level topography of the site. No significant impact is anticipated. The project site, while within the Chico Airport Land Use Plan Traffic Compatibility Zone "C-2", will not expose people working on the site to excessive noise levels. The project is not located in the vicinity of an airstrip or within an airport land use plan. No impact would occur. Based on the latest traffic studies by Butte County Association of Governments(BCAG)on January 29,2001,the three day average on Eaton Avenue east of Highway 99 is 9,979,which is a Level of Service"B",which is an acceptable. The proposed use is a relocation of an existing fire station located on Cohasset Road, just south of Eaton, approximately 1.9 miles away. There is no set formula to determine the number of vehicle trips/day for a fire station, the amount of trips will be determined by the number of staff on duty and the average number of emergency call per day. Butte County Code Section 24-240 (b) requires at least one (1) space for each three (3) employees on the maximum shift,plus one(1)for each vehicle permanently assigned to the facility. The proposed parcel does have adequate room to provide the required parking spaces and therefore, the project presents no impact relative to insufficient parking capacity. The proposed use will not result in a change in air traffic patterns due to increase traffic levels or change in location that would increase substantial safety risks. The site is within the Chico Airport Compatibility Zone C-2,but was determined by the Airport Land Use Commission(ALUC)that the project is consistent with the 2000 Airport Land Use Compatibility Plan and would not cause any safety issues. The project would not have a significant impact on any wastewater treatment facilities. Domestic water supply for fire station would be obtained from public water. No additional storm water facilities would be necessary as a result of this project due to the project not adding any additional impervious surfaces. The project would not increase the stream of waste being deposited in the Neal Road Landfill due to the fact that the proposed use is being relocated and is not a new use. According to the Butte County Public Works Department, the Neal Road Landfill is expected to reach maximum holding capacity by the year 2018. But in doing so,we want to limit our future use of the property and do so by means of an agreement with ourselves. Someone needs to thoroughly evaluate this approach. (Eliminated the requirement of only a fire station can be placed on the site) In addition, the agreement is between the County and Public Works. What does Public Works have to do with the Fire Station? (According to the application, Public Works is the owner of the property) Supposedly the purpose of the conditional zoning agreement is to limit the use of the property to a Fire Station, but it does not do so. It does not limit the use of the property at all. It only makes specific demands unrelated to any particular use. (The requirement of a particuliar use has been removed) ,,basks for a no access strip on Eaton, although this may be one of the access points to the property. 1AAfls`� It asks for a masonry wall around garbage receptacles. It asks for landscaping around the perimeter. It says nothing about restricting use or not allowing the property to be divided further. am not sure why we would want to do so anyway. The packet does not have the draft zoning ordinance that the conditional zoning agreement would be attached to. It does not have the resolution by which the Board would adopt the general plan amendment. f These are the big picture items. I also have some comments on lesser items. On page 1, you state access to the property may be on Eaton Road. Why are we restricting this access in the conditional zoning agreement?C; twV Under analysis on page 2, you talk about restrictions on use. I could not find any restrictions on use in the findings or conditional zoning agreement. ..� page 4 under#2 you state that there is no guarantee this relocation will be of a permanent nature. .-VVhat does this imply? Under III(C)coordinate with Dan on impact to vehicle circulation at the Eaton Hicks intersection. What do you mean by III(D)? Under III(E), you should include meeting the general plan criteria and zoning factors as you discussed in your report. I really question the use of a conditional zoning agreement. Are we going to enforce it against ourselves? Do we need an agreement to get the three things set forth in it? Why is it being made with Public Works? The conditions are more like things you would impose under a use permit. We should discuss what to do. In the initial study on page 1, you mention the limited environmental analysis based on the assumption of the use being limited. However, the use is not being limited. 1 Under Air Quality, you note impacts in .,,—second paragraph on page 6 that would icau to our imposing mitigations in most other instances. Here,we do not. Why not? Your analysis of vehicle impacts in paragraph 3 on page 6 might vary depending on whether it was over a wide area or specific to the new location. FOR: Airport Land Use Commission Meeting on January 17, 2003 SUMMARY: Staff recommends that ALUC find the project consistent with the 2000 Airport Land Use Compatibility Plan for the Chico Municipal Airport. BACKGROUND: The property is within the unincorporated area around Chico and is within the North Chico Specific Plan area. The current General Plan land use designation is Commercial and the zoning is C-2 (General Commercial). The site is currently developed with several storage buildings and was historically used as a boat repair and sales operation. The C-2 zone allows for a wide variety of commercial uses including offices, restaurants, churches, motels, and retail services. The site is located approximately 7,000 feet westerly and perpendicular to the south end of runway 13L-31R and approximately 7,700 feet from the south end of runway 13R-31L of the Chico Municipal Airport. The Butte County Fire Department has submitted this General Plan and Rezone application to the Department of Development Services with the intent of developing the site with a new County Fire Station. ANALYSIS: According to the 2000 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal Airport, the property is located in a Traffic Pattern Compatibility'Zone "C-2" - Traffic Pattern Zone. Compatible non-residential uses in the C-2 compatibility are limited based on the concentration of people expected on the site. Concentrations of 100 people per acre or less are generally compatible. Incompatible uses regardless of the concentration threshold include Children's schools, libraries, daycare facilities, nursing homes, hospitals and convalescent hospitals. The proposed PQ zoning would allow the development of public schools, public libraries, and public hospitals, which would be conflict with the airport compatibility zone. In this particular instance the County plans to develop a fire station on the site. The station would house up to 5 employees on the i8utte County Wirport Land Use Commission o per acre maximum called out in the C-2 Compatibility Zone. The change in land use and zoning along with the proposed development would, therefore be consistent with the 2000 ALUCP provided the site is developed as proposed. No height limitations are expected to be exceeded by a fire station and outdoor lighting should not interfere with airport operations. The radio frequencies used by emergency response personnel do not conflict with airport frequencies. Compatibility Zone"C" normally calls for a disclosure notice regarding airport noise, annoyance, and discomfort. This generally pertains to residential uses and would not be required in this case. Environmental Documentation: No environmental documentation has been completed for this project.
