Cummings on January 30, 2009, Document# 2009-0003000. This property was annexed into the Town of Paradise but currently has a Butte County Building Permit#B07-0420. It is my understanding that the final building permit inspection is on hold until such time that a Certificate of Merger is recorded. Please notify the appropriate party in your Building Division that the recording has taken place. It is our hope that the Cummings will receive their Final Building Inspection and Certificate of Occupancy as soon as possible. Did you run this by your Planning Division and/or Dept. supervisor(s) for guidance?Also, you may want to seek assistance from your legal counsel. However, it seems to me that if your application was officially deemed "complete"for purposes of Butte County processing on a date that precedes the actual date of this property annexation to the Town of Paradise and the PID that you could proceed and record the merger which will serve to benefit all affected parties [i.e. the project applicants, Butte County, and the Town of Paradise]. Although I'm curious as to how the Butte County staff managed to issue the building permit for the residence construction. In June,Brock and Kandice Cummings applied for a merger of two existing lots, in order to extinguish the interior lot line. Although there is only one Assessor's Parcel Number (051-050-064),the lots were created by deeds 54-13 (5/31/1930)and 483-255 (6/15/1948)created the boundaries for this parcel. 1/16/2008 Page 2 of 2 You did provide comments on this application, which pointed out that the parcel has been identified by the same number for a period of time. The merger of the underlying lots was necessary for the purpose of obtaining a building permit to construct a single family residence on the property. By the time I was able to process the application, it had already been merged into the Town of Paradise. It appears that the house construction is now being inspected by the Building Division. The Planning Division still has an"inspection"prior to the final inspection to ensure that the recordation of the merger is complete; however, our code no longer applies to the parcel. I'm not familiar with your code, so please bear with me! Is the lot configuration and merger of concern to the Town of Paradise?If it is,then I can forward the file information to your office, or provide you with any information that you deem is necessary. If it is not,then I would assume that the Planning Division"inspection" is not necessary. What is the appropriate next-step for the Town of Paradise,with regard to the Certificate of Merger? As we understand your verbal clarification of the incorrectly worded notice,the application by the Cummings is meant to finalize the paperwork for the parcel on Heaven's Gate (previously known as Ada Lane), also known as APN 051-050-064. It is currently our understanding that this merger will combine the single property, of 3.40 acres that straddle their access easement, Heaven's Gate.
