APN 058-670-012 (SH) (MVAR 00-03) It was moved by Commissioner Lambert, seconded by Commissioner Cage to approve the Minor Variance for William and Penelope Anderson subject to the findings and conditions listed below. I. Adopt a Categorical Exemption with the following finding: A. Find that the Minor Variance for William & Penelope Anderson is exempt from environmental review pursuant to the California Environmental Quality Act(CEQA)under Section 15303 Class 3(a) of the CEQA, which states that one single family residence in a residential zone is exempt. II. Approve MVAR 00-03, Minor Variance for William&Penelope on AN 058-670-012 to allow the construction of a new single family dwelling, subject to the condition(s)found in Exhibit A and with the following findings: A. There are special circumstances applicable to the property(size, shape,topography, location or surroundings) or the intended use of the property, and because of this, the strict application of zoning standards Code deprives the property of privileges. The Butte County Zoning Code, Chapter 24, Section 24-52 (d), provides for approval when special circumstances related to physical criteria are met. B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought. The neighboring parcels, not limited nor nonconforming in size, enjoy single family residences. C. This Minor Variance will not be detrimental to the public health, safety or welfare, or • injurious to the property or improvements in such vicinity and zone in which the property is located. The public health & safety will not be jeopardized by the property owner receiving approval to construct his single family residence, with a small portion of less than 3% of total square footage, several feet within the ten foot rear setback, bringing it within five to seven feet of the property line. D. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The FR-10 zoning classification's site requirements require a ten foot rear yard setback. There is provision in Section 24-45.10 which allows approval of the permit when the proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood. E. This Minor Variance will not be incompatible with the Butte County General Plan. The General Plan Land Use Element designation is Foothill Area Residential. The Land Use Element identifies residential use as a "Primary Use." APN 058-670-012(SH)(MVAR 00-03) Mr. Hackney gave a brief summary to the project. He noted that this parcel was an unusual size and shape. Mr. Parilo asked if the parcel was .9 acres as stated on the report cover sheet or.06 acres as shown on the exhibit. Mr. Hackney said the .9 acres is correct. He explained the existing encroachment for a shed behind the garage. The hearing was opened to the public. No one was present to speak at this hearing: The hearing was closed. Mr. Parilo said he would concur with staff's recommendation for approval of this Minor Variance, including the existing garage shop building encroachment with this Minor Variance as well to make it legal, recognizing that this parcel is unique relative to the size of the other lots in the subdivision. He said this parcel appears to be a remnant and smaller than the other parcels in this subdivision and cannot meet the setback requirement. When we originally applied for our building permit for Phase One of our Two-Phase custom home construction project on February 15, 1996 we requested a 5 foot setback due to the peculiar shape of our parcel and it was approved, both by CDF and by personnel at the county building department. Our garage/apartment is built 5 feet from the property line. Our revised plot map (copy attached)which we submitted on 4/8/96 showed the 5 foot setback for Phase One and also showed a 5 foot setback for Phase Two,the main home,which was to be completed at a future date. These were signed off by Ted Crawford of CDF and was ok'd by the helpful girl who assisted me at the counter at the building permit department. Apparently as a result of an oversight by county employees we were never told of the 10-foot zoning requirement at any time during the construction of Phase One, our garage/ apartment, and we received our final inspection on February 10,1997. Now, as we apply for a building permit for Phase Two to construct our main home of 1,541 square feet,we are told that the house has to be 10 feet from the property line.Phase One and Phase Two must have a 5 foot setback since the original plans show them connected together at a specific point. Also;since we completed Phase One we have constructed a 94 foot long 3-3 1/2 foot retaining wall to create a front yard space for the main home. If we are re- quired to have a 10 foot setback it would defeat the purpose of our building the retaining wall and would leave us with little or no front yard,a waste of thousands of dollars. Since the error in allowing us to build Phase One 5 feet from the property line was caused by county employees, we feel that we should suffer no penalty or delay as a result of that error. Although we have been given the option of applying for a"minor variance"and have been told that it would most likely be approved, given the circumstances, we feel it is unfair to make us wait 30 days for the variance before construction begins. Our construction schedule is already in place, our contractor and sub-contractors have reserved time to begin pouring the footings next week, and the framing is to follow immediately. We complied with everything we were told to do during Phase One, got approval for Phase Two for the 5 foot setback when we submitted our revised plot plan (we thought!) and made sure our septic system was approved for the three bedroom main home by the Division of Environmental Health during Phase One of construction. We respectfully request that a 5 foot setback be approved for Phase Two immediately so we can begin construction as planned. It's the only proper and honorable thing to do.All other conditions for the issuance of the building permit for Phase Two have been addressed. NECESSARY FINDINGS OF FACT Each zoning classification and land use has an associated set of development standards which are specified in the Butte County Zoning Code. The California Government Code Section 65906 and 65906.5 and the Butte County Zoning Code establish findings which must be made in order to grant variances from these standards where unique circumstances exist to warrant relief from the strict application of these standards. Variances from the terms of the Zoning Code may be granted only when,because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the Zoning Code deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. When we originally applied for our building permit for Phase One of our Two-Phase custom home construction project on February 15, 1996 we requested a 5 foot setback due to the peculiar shape of our parcel and it was approved, both by CDF and by personnel at the county building department. Our garage/apartment is built 5 feet from the property line. Our revised plot map (copy attached)which we submitted on 4/8/96 showed the 5 foot setback for Phase One and also showed a 5 foot setback for Phase Two,the main home,which was to be completed at a future date. These were signed off by Ted Crawford of CDF and was ok'd by the helpful girl-who assisted me at the counter at the building permit department. Apparently as a result of an oversight by county employees we were never told of the 10-foot zoning requirement at any time during the construction of Phase One, our garage/ apartment, and we received our final inspection on February 10, 1997. Now, as we apply for a building permit for Phase Two to construct our main home of 1,541 square feet,we are told that the house has to be 10 feet from the property line.Phase One and Phase Two must have a 5 foot setback since the original plans show them connected together at a specific point. Also,since we completed Phase One we have constructed a 94 foot long 3-3 1/2 foot retaining wall to create a front yard space for the main home. If we are re- quired to have a 10 foot setback it would defeat the purpose of our building the retaining wall and would leave us with little or no front yard,a waste of thousands of dollars. Since the error in allowing us to build Phase One 5 feet from the property line was caused by county employees, we feel that we should suffer no penalty or delay as a result of that error. Although we have been given the option of applying for a"minor variance"and have been told that it would most likely be approved, given the circumstances, we feel it is unfair to make us wait 30 days for the variance before construction begins. Our construction schedule is already in place, our contractor and sub-contractors have reserved time to begin pouring the footings next week, and the framing is to follow immediately. We complied with everything we were told to do during Phase One, got approval for Phase Two for the 5 foot setback when we submitted our revised plot plan (we thought!)-and made sure our septic system was approved for the three bedroom main home by the Division of Environmental Health during Phase One of construction. We respectfully request that a 5 foot setback be approved for Phase Two immediately so we can begin construction as planned. It's the only proper and honorable thing to do.All other conditions for the issuance of the building permit for Phase Two have been addressed. Our garage/apartment is built 5 feet from the property line. Our revised plot map (copy attached)which we submitted on 4/8/96 showed the 5 foot setback for Phase One and also showed a 5 foot setback for Phase Two,the main home,which was to be completed at a future date. These were signed off by Ted Crawford of CDF and was ok'd by the helpful girl who assisted me at the counter at the building permit department. Apparently as a result of an oversight by county employees we were never told of the 10-foot zoning requirement at any time during the construction of Phase One, our garage/ apartment, and we received our final inspection on February 10,1997. Now, as we apply for a building permit for Phase Two to construct our main home of 1,541 square feet,we are told that the house has to be 10 feet from the property line.Phase One and Phase Two must have a 5 foot setback since the original plans show them connected together at a specific point. Also,since we completed Phase One we have constructed a 94 foot long 3-3 1/2 foot retaining wall to create a front yard space for the main home. If we are re- quired to have a 10 foot setback it would defeat the purpose of our building the retaining wall and would leave us with little or no front yard,a waste of thousands of dollars. Since the error in allowing us to build Phase One 5 feet from the property line was caused by county employees, we-feel that we should suffer no penalty or delay as a result of that error. Although we have been given the option of applying for a"minor variance"and have been told that it would most likely be approved, given the circumstances, we feel it is unfair to make us wait 30 days for the variance before construction begins. Our construction schedule is already in place, our contractor and sub-contractors have reserved time to begin pouring the footings next week, and the framing is to follow immediately. We complied with everything we were told to do during Phase One, got approval for Phase Two for the 5 foot setback when we submitted our revised plot plan (we thought!) and made sure our septic system was approved for the three bedroom main home by the Division of Environmental Health during Phase One of construction. We respectfully request that a 5 foot setback be approved for Phase Two immediately so we can begin construction as planned. It's the only proper and honorable thing to do.All other conditions for the issuance of the building permit for Phase Two have been addressed. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The applicant is requesting a Minor Variance to allow the new construction of a primary residence to be located so that a corner portion of the structure is built five feet into the ten foot rear yard setback, as per Chapter 24 of the Zoning Code. The applicant's parcel, AN 058-670-012, was created in 1968. The zoning for the area is FR-10 (Foothill Recreational-10 acre minimum). The FR-10 zoning classification was approved August 17, 1982. The General Plan Land Use designation for the property is Foothill Area Residential, which specifies a minimum parcel size of 1 to 40 acres. The final map creating this parcel predates the County's General Plan Land Use designation by approximately 10 years. The project site is located north/northeast of Oroville, in the Pulga Canyon area of State Route 70. An extensive area of land to the south, southeast and southwest of the project site is owned by the State of California. This extensive land area, bordering Lake Oroville, is zoned R-C, Resource- BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ PAGE 1 ■ Conservation. The project site's rear yard backs up to this land. The large rural parcels to the north of the project is zoned FR-10. The project is not located in any Urban Area. The neighboring parcels to the north are characterized as rural residential. Access to the project site is by Truex Road, which runs approximately 1800 feet distance from SR70 to the north east. ANALYSIS: The applicant's parcel,AN 058-670-012, is located in an area with parcels created in the mid-1960s. Approximately 10 years after project parcel was created the area was zoned FR-10. The FR-10 zoning requires a 10 foot setback, side and rear. In February 1996, the applicant applied for, and received, a building permit for a planned two-phased development of his parcel. At that time he submitted a plot plan indicating a 5 foot incursion into the 10 foot setback, for the purposes of constructing a garage with an attached living unit. This was intended to be a temporary living unit until the applicant was able to build his primary residence, as indicated on his plot plan. The original plot plan indicated the proposed primary residence in phase two would also encroach 5 feet into the 10 foot rear yard setback. The applicant obtained building and septic permits and built the garage and attached living unit. On July 13, 2000, the applicant submitted his request for building permits to proceed with the second phase of his plot plan, to build his primary residence, turning the small temporary living unit into a workshop. At this time,the applicant was notified that a Minor Variance would be required to comply with Butte County Zoning Code Section 24-52 Minor Variances. The square footage of the proposed primary dwelling is 1541 square feet. The portion of the primary dwelling which will encroach into the rear yard setback amounts to less than 4%, or approximately 60 square feet. Due to the legal,pre-existing nonconforming size of the parcel, 0.90 acre, in the FR- 10 zone, the shape, size, and physical characteristics of the parcel, the applicant requests a minor variance to build a small portion of his primary residence 5 feet in the 10 foot setback. This request is appropriate under Section 24-52(e)(1-6) of the Butte County Code. CEQA issues: Upon careful and deliberate review of the project and the project site environs, the proposed encroachment of the single family dwelling will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15303 Class 3(a) of the California Environmental Quality Act guidelines. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Adopt a Categorical Exemption with the following finding: A. Find that the Minor Variance for William & Penelope Anderson is exempt from environmental review pursuant to the California Environmental Quality Act(CEQA) under Section 15303 Class 3(a) of the CEQA, which states that one single family residence in a residential zone is exempt. II. Approve MVAR 00-03, Minor Variance for William & Penelope on AN 058-670-012 to ■ BUTTE COUNTY PLANNING MANAGER ■AGENDA REPORT ■PAGE 2 ■ r allow the construction of a new single family dwelling, subject to the condition(s) found in Exhibit A and with the following findings: A. There are special circumstances applicable to the property (size, shape, topography, location or surroundings)or the intended use of the property, and because of this, the strict application of zoning standards Code deprives the property of privileges. The Butte County Zoning Code, Chapter 24, Section 24752 (d), provides for approval when special circumstances related to physical criteria are met. B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought. The neighboring parcels,not limited nor nonconforming in size, enjoy single family residences. C. This Minor Variance will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located. The public health & safety will not be jeopardized by the property owner receiving approval to construct his single family residence, with a small portion of less than 3%of total square footage, several feet within the ten foot rear setback, bringing it within five to seven feet of the property line. D. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The FR-10 zoning classification's site requirements require a ten foot rear yard setback. There is provision in Section 24-45.10 which allows approval of the permit when the proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood. E. This Minor Variance will not be incompatible with the Butte County General Plan. The General Plan Land Use Element designation is Foothill Area Residential. The Land Use Element identifies residential use as a "Primary Use." The "Site Designation Criteria" of the land use designation are met with this application.
