VARIANCE
APPLICATION PACKET CHECKLIST
This checklist is designed to assist applicants in making sure all necessary information is included in their
application packet. Please include this checklist along with your submittal.

1. A completed, signed, Uniform Application and Environmental Information form. If the
application is signed by an agent for the property owner, an agent authorization form must
be submitted along with the Uniform Application. The application shall not be accepted
unless signed by the'owner or authorized agent.

3. LJ ) copies of plans which shall include a detailed site plan drawn to scale. All
plans shall be drawn on uniform size sheets nor eater than 24" X 36".The finished plans
shall be folded to 8 1/2" x 11". The detailed site plan must include:
a. LJ Name and address of Applicant, Engineer, Architect, and/or person who prepared the
plan
b. Property lines and lot dimensions
c. A Assessor Parcel Number(s) and the street address.
d. U Dimensioned locations of existing and proposed improvements on the property
(including,but not limited to, buildings, driveways, parking areas, wells, septic tanks
and leach fields).
e. LJ Distances from any significant natural and man-made features of the property, such as
streets, access roads; streams, rock outcroppings, major tree stands, storm drains,
bodies of water, railroads,.to the property lines.
f. North arrow and scale of P drawing. All laps shall be drawn to an engineering scale

4. NECESSARY FINDINGS OF FACT
Each zoning classification and land use has an associated set of development standards which are specified
in the Butte County Zoning Code. The California Government Code Section 65906 and 65906.5 and the
Butte County Zoning Code establish findings which must be made in order to grant variances from these
standards where unique circumstances exist to warrant relief from the strict application of these standards.
Variances from the terms of the Zoning Code may be granted only when,because of special circumstances
applicable to the subject property, including size, shape, topography, location, or surroundings, the strict
application of the Zoning Code deprives such property of privileges enjoyed by other property in the
vicinity and under identical zoning classification. Any Variance granted may be subject to conditions that
will assure that the deviation shall not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in which such property is situated.
Variances can nQt be granted for reductions in lot size, increases in residential density, increase in
lot coverage, or for uses not permitted in a zone.
The courts have clearlyindicated that variances are not intended to rewrite the Count Code and can only

be granted if all the findings listed below are made. Further, the courts have indicated the actual, factual
basis for these findings must be stated.

We live on a non-conforming size parcel of land in a newly
approved subdivision, but this subdivision is sited inside an
existing Ag. 20 zone. Our- substandard-lots—are--being held to Ag.
20 requirements, which does not generally apply to other r
subdivision lots under an acre in size.
b. The granting..of the Variance_.is_necessary_for-the_preseruation..and-erijoyrnent-of--substantial-property

Under the "Limitations of Commercial Activities" section of our
—��-- - -- subdivision' s Covenants, Codes and Restrictions ( ".CC&R' s" ) we_
must park our Snap-on Tools truck away from the other parcel
owners' view, e.g. behind our fenced back yard area. We also
need space in the back yard for the enjoyment of our planned
- -recrsatiorial activities, including a swimming pool, garden and
children' s play area. This requires the easing of the 20-foot
back line setback.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Jolynn Aanenson is hereby granted a Minor Variance in accordance with application
filed, to allow Minor Variance to allow a shop/garage structure to encroach 5 feet into the 25 foot
rear yard setback at APN 039-410-077 located at 60 Old Chico Way in southwest Chico area.
1. Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit,constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance,including Butte County Code
r Sec. 24-62.
2. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant, or their respective designee, Prior to such approval, verification shall be made
by each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
imajor or significant in nature shall require a formal application for amendment.
3. A Minor Variance shall lapse and shall become void one year following the date on which
the Minor Variance became effective, unless prior to the expiration of one year, a building
permit is issued and construction is commenced and diligently pursued toward completion
on the site which was the subject of the Minor Variance application.
4. The terms and conditions of this minor variance shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.

At the regular meeting of the Butte County Planning Commission held September 28, 2000, your
request for a Minor Variance,was approved subject to the conditions listed on the varuabce.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must
do so in writing, to the Clerk of the Board of Supervisors, 25 County Center.Drive, Oroville,
California,prior to 5:00 p.m.,Monday, October 9, 2000. The appeal fee of$50.00 must be paid at
that time. If you do not.appeal and if there are no other appeal within the 10 calendar-day appeal
period, the action of the Planning Commission is final.

A. Find that the Minor Variance for Jolynn Aanenson is exempt from environmental review
pursuant to the California Environmental Quality Act(CEQA)under Section 15303 Class
3(e) of the CEQA, which states that accessory (appurtenant) structures including garages,
carports,patios, swimming pools, and fences.
II. Approve MVAR 00-04, Minor Variance for Jolynn Aanenson on APN 039-410-077 to allow the
construction of a new shop/garage 5 foot into the rear yard setback of 25 foot, subject to the
condition(s) found in Exhibit A and with the following findings:
A. There arespecial circumstances applicable to the property Y(size shape,topography, location
or surroundings) or the intended use of the property, and because of this, the strict
application of zoning standards Code deprives the property of privileges. The Butte County
Zoning Code, Chapter 24, Section 24-35.40, provides for rear yard setback reductions in 5
foot increments down to 10 feet. This project is located on a nonconforming size parcel in
the A-20 zone.
B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property
right possessed by other property in the same vicinity and zone and denied to the property
for which the Minor Variance is sought. The neighboring parcels have shops and/or garages
built on them. The applicant wishes to build a shop/garage on his parcel. The applicant is
subjected to a 25 foot rear yard as per County Code Chapter 24 §24-90.10.
C. This Minor Variance will not be detrimental to the public health, safety or welfare, or
injurious to the property or improvements in such vicinity and zone in which the property
is located. The public health & safety will not be jeopardized by the property owner
receiving approval to construct his shop/garage 5 feet within a 25 foot rear yard setback,
bringing it within 20 feet of the property line.
D. This Minor Variance will not allow a use or activity which is prohibited by the zoning
regulation governing the parcel of property. The A-20 zoning classification=s site
requirements require a 25 foot rear yard setback, there is provision in Section 24-35.40 to
allow nonconforming parcels to reduce the rear yard setback. The nonconforming parcel was
created in 1907, while the A-20 zoning was created in 1988.
E. This Minor Variance will not be incompatible with the Butte County General Plan. The
General Plan Land Use Element designation is Orchard & Field Crops. The Land Use
Element identifies residential use as a"secondary Use." The "Site Designation Criteria"of
the land use designation provides for"adjacent uses compatible with primary and secondary

Mr. Wilson gave a brief summary of the project. He noted a letter received in favor of the project. He
stated that this property is part of a subdivision done in'March of.1907. and there have been a number
of changes in terms of Planning regulations.
The hearing was opened to the public.
No one was present to speak on this item.
The hearing was closed.
Mr. Wilson concurred with staff's recommendation to recommend to the Planning Commission that

PROJECT DESCRIPTION/SITE CHARACTERISTICS:
The applicani is requesting a Minor Variance to allow the new construction of a garage/shop five
feet into the 25'foot side & rear setback, as per Chapter 24 of the Zoning Code.
The applicant's parcel, APN 039-410-077, is part of the Glendale Addition No. 1 Subdivision;
created by Final Map if Book 6 of Maps at page 45, on April 11, 1907. The applicant's parcel was
created by the merging of several underlying lots in a merger action approved May 21, 1997. As part
of the merger approval, the Board of Supervisors approved a Settlement Agreement with the
applicant in which the setbacks for the subdivision were changed to the following: Front yard--20
foot, Rear yard-=25 foot, and Side yard--10 foot. The zoning for the area is A-20 (Agricultural-20
acre minimum). The A-20 zoning classification was approved for this area March 1, 1988. The
General Plan Land Use designation for the property is Orchard & Field Crop, which specifies a
minimum parcel size of 5 acres. The final map of the Glendale Addition No. 1 Subdivision predates
the County's General Plan Land Use designation by approximately 70 years.

The project site is located in the southwest Chico area,just outside the Chico Urban area. The area

ANALYSIS:
The applicant's parcel, APN 039-410-077, is located in a 93 year old subdivision,presently zoned
A-20. The A-20 zoning requires a 25 foot setback, side and rear. As part of an agreement to allow
a revision of the zoning's setback requirements, the applicant merged a number of underlying lots
which had been created in 1907. The new setback requirements included allowing a side yard
setback of 10 feet. The applicant requests to construct a shop/garage 5 foot into the 25 foot tear yard
setback. The applicant proposes to build the shop/garage to the 10 foot side yard setback. This is
allowed under the terms of the Settlement Agreement with the Board of Supervisors in 1997. Due
to the pre-existing nonconforming size of the parcel, 0.73 acre, in the A-20 zone, the size and
location of.the parcel is such that the applicant requests to have a rear yard setback of 20 feet. This
request is appropriate under §24-52(e)(1- 6) of the Butte County Code.
CEQA issues: Upon careful and deliberate review of the project and the project site environs, the
proposed shop/garage will have no significant environmental effects and has been determined to
meet the criteria for a categorical exemption under Section 15303 Class 3(e) of the California
Environmental Quality Act guidelines.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Commission take the following actions:
I. Adopt a Categorical Exemption with the following finding:
A. Find that the Minor Variance for Jolynn Aanenson is exempt from environmental
review pursuant to the California Environmental Quality Act(CEQA)under Section
15303 Class 3(e)of the CEQA,which states that accessory (appurtenant) structures
including garages, carports, patios, swimming pools, and fences.
II. Approve MVAR 00-04,Minor Variance for Jolynn Aanenson on APN 039-410-077 to allow
the construction of a new shop/garage 5 foot into the rear yard setback of 25 foot, subject to
the condition(s) found in Exhibit A and with the following findings:
A. There are special circumstances applicable to the property (size, shape, topography,
location or surroundings)or the intended use of the property, and because of this,the
strict application of zoning standards Code deprives the property of privileges. The
Butte County Zoning Code, Chapter 24, Section 24-35.40, provides for rear yard
setback reductions in 5 foot increments down to 10 feet. This project is located on
a nonconforming size parcel in the A-20 zone.

B. The Minor Variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone and denied
to the property for which the Minor Variance is sought. The neighboring parcels
have shops and/or garages built on them. The applicant wishes to build a
shop/garage on his parcel. The applicant is subjected to a 25 foot rear yard as per
County Code Chapter 24 §24-90.10.
C. This Minor Variance will not be detrimental to the public health, safety or welfare,
or injurious to the property or improvements in such vicinity and zone in which the
property is. located. The public health & safety will not be jeopardized by the
property owner receiving approval to construct his shop/garage 5 feet within a 25
foot rear yard setback,bringing it within 20 feet of the property line.
D. This Minor Variance will not allow a use or activity which is prohibited by the
zoning regulation governing the parcel of property. The A-20 zoning classification's
site requirements require a 25 foot rear yard setback,there is provision in Section 24-
35.40 to allow nonconforming parcels to reduce the rear.yard setback. The
nonconforming parcel was created in 1907, while the A-20 zoning was created in
1988.
E. This Minor Variance will not be incompatible with the Butte County General Plan.
The General Plan Land Use Element designation is Orchard & Field Crops. The
Land Use Element identifies residential use as a "Secondary Use." The "Site
Designation Criteria" of the land use designation provides for "adjacent uses
compatible with primary and secondary uses." Approval of the minor variance shall
enable the applicant to fulfill the General Plan's "Secondary Use" for accessory, or
adjacent, uses for APN 039-410-077.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below:Jolynn Aanenson is hereby granted a Minor Variance in accordance with application
filed, to allow Minor Variance to allow a shop/garage structure to encroach 5 feet into the 25 foot
rear yard setback at APN 039-410-077 located at 60 Old Chico Way in southwest Chico area.
1. Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit,constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance,including Butte CountyCode
Sec. 24-62.
2. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant, or their respective designee, Prior to such approval,verification shall be made
by each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
3. A Minor Variance shall lapse and shall become void one year following the date on which
the Minor Variance became effective,unless prior to the expiration of one year, a building
permit is issued and construction is commenced and diligently pursued toward completion
on the site which was the subject of the Minor Variance application.
4. The terms and conditions of this minor variance shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal.representatives, successors, and assigns of the
Permittee.
Conditions of Approval:
1. Provide an all weather access to all structures, which is designed to carry a 40,000
pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance.

ordinances and regulations.

this letter is being sent in support of the Request for Minor Variance.
- My wife and I own the parcel of land north of the subject property, across Old
Chico Way(039-410-071). It is our intent to build on our land in the near future and
are aware of the various set-back requirements that exist in the neighborhood. In
out opinion, the granting of a five-foot variance will have no negative impact on
the surrounding area.

PLEASE CONTACT THE BUTTE COUNTY FIRE DEPARTMENT FOR COMPLIANCE WITH THE
FOLLOWING CHECKED CONDITIONS
1. Construction, installation or development of structures or facilities on the parcels/lots shall
comply with the latest California Fire Safe Regulations, (Public Resources Code 4290),
and all other applicable State and County codes, ordinances and regulations in effect at
the time of application for improvement permits.
2. Building identification and/or addresses shall be installed in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter.
3. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the
County Fire Warden.
4. In lieu of a pressurized water system or water storage tank, payment of$200.00 per
created parcel into the Battalion_water tend fund, is required prior to the issuance of a
building permit.
5. A pressurized community water system for fire protection is required. The specific
locations and fire flow requirements shall be in accordance with the Fire Department
specifications and to the satisfaction of the County Fire Warden. Average required
hydrant spacing_feet, hydrant size_inches, and residual fire flow_gpm. Submit
plans to the Fire Department for review and approval prior to construction of facilities.
6. In lieu of hydrant installation, payment may be made into the hydrant fund at a
cost of$1.72 per lineal foot of street frontage. The estimated fee amount is $

the then current fee for the West Chico Fire Station Fund.
8. Provide an all weather access to all structures, which is designed to carry a 40,000 pound
fire apparatus at least 10 feet wide with a 15 foot vertical clearance.
