Thompson (Item determined to be categorically exempt from environmental review), Minor Variance to place a mobile home (1978), as a primary residence in the front setback - encroaching 2 feet into a 20 foot setback and in the rear setback 1 foot into a 5 foot setback. The property is zoned R-N (Residential Nonconforming) and is located at 2732 D Street, on the corner of D Street and Burlington, in Oroville. APN 035-122-007 (SH) (MVAR 01-01) It was moved by Commissioner Mooney, seconded by Commissioner Leland, and unanimously carried to approve the Minor Variance for Esther Thompson subject to the findings and conditions listed below. I. Find that the project is exempt from the provisions of the California Environmental Quality Act .under Section 15305 Class 5(a) which states Minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. II. Approve a Minor Variance(MVAR 01-01) for Esther L. Thompson on APN 035-122-007 to allow the placement of a mobile home as a single family dwelling, subject to the condition(s) found in Exhibit A and with the following findings: A. There are special circumstances applicable to the property (size, shape, topography, location or surroundings)or the intended use of the property, and because of this, the strict application of zoning standards code deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. The Butte County Zoning Code, Chapter 24, Section 24-52 (d), provides for approval when special circumstances related to physical criteria are met. B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which Mi o ich the nor Variance is sought. The neighboring parcels, not limited nor nonconforming in size, enjoy single family residences. The surrounding area is characterized by single family residences and duplex units encroaching in the front and rear yard setbacks. C. This Minor Variance will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located. The public health & safety will not be jeopardized by the property owner receiving approval to construct her single family residence, with an encroachment of 20% or less, 1 foot into the 5 foot rear yard setback and 2 feet into the 20 foot front yard setback. D. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The R-N zoning classification's site requirements require a 5 foot rear yard setback and a 20 foot front yard setback. E. This Minor Variance will not be incompatible with the Butte County General Plan. The General Plan Land Use Element designation is MDR (Medium Density Residential). The Land Use Element identifies residential use as a "Primary Use." The "Site Designation Criteria" of the land use designation are met with this application. Approval of the minor variance shall enable the applicant to fulfill the General Plan's "Primary Use" for single family uses for APN 035-122-007. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The applicant is requesting a Minor Variance to allow the placement of a 1978 mobile home as a primary residence to be located so that a the mobile home encroaches 1 foot into the 5 foot rear yard setback and 2 feet into the 20 foot front yard setback, as per Chapter 24 of the Zoning Code. The applicant's parcel, AN 035-122-007, was created in 1911. The zoning for the area is R-N (Residential-Nonconforming). The R-N zoning classification was approved August 22, 1978. The General Plan Land Use designation for the property is MDR(Medium Density Residential), which specifies a minimum parcel size of 6500 square feet for parcels on community sewer. The final map creating this parcel predates the County's General Plan Land Use designation by 67 years. The purpose of the R-N zoning is to address those areas of the County with nonconforming size parcels. The project site is located in central/south central Oroville. While the site is in the unincorporated . portion of Oroville, the site is located in the Oroville Urban Area and in the Oroville Enterprise Zone. Residential applications are processed by the County in the Oroville Enterprise Zone. No ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ PAGE 1 ■ particular development constraints for residential development are existent in the R-N zoned areas located in the Oroville Enterprise Zone. The neighboring parcels are all in the R-N zone. Access to the project site is by D Street, which runs approximately 3000 feet distance from Lincoln Boulevard on the west, to the end of D Street running to the east. ANALYSIS: The applicant's parcel, APN 035-122-007,is located in an area with parcels created shortly after the turn of the 20th Century, in 1911. Approximately 67 years after the project parcel was created the area was zoned R-N. The R-N zoning requires a 5 foot rear yard setback and a 20 foot front yard setback. In March 2001, the applicant inquired about the placement of a 24 foot x 60 foot mobile home on the vacant parcel. Due to the nonconforming size of the parcel and the required setbacks, and the size of the mobile home, the applicant was informed that placement of the mobile home on the parcel would encroach into the rear yard and front yard setbacks. The proposed placement of the mobile home will encroach 1 foot, or 20%into the 5 foot rear yard setback; and 2 feet, or 10% into the 20 foot front yard setback. The Zoning Code Section 24-52(e) provides for a Minor Variance at a maximum reduction of 20% of the prescribed requirements of this Ordinance. The square footage of the proposed mobile home is 1440 square feet. The total square footage of the parcel is 4,935 square feet. The portion of the mobile home which will encroach into the rear yard setback will amount to no more than 20% of the setback requirement, and the portion of the mobile home which will encroach into the front yard setback will amount to no more than 10% of the setback requirement. Due to the legal,pre-existing small size of the parcel,0.11 acre,in an older neighborhood characterized by legally created small lots that required the creation of the R-N zoning classification to encompass such substandard lots, the applicant requests a minor variance to place her primary residence 1 foot in the 5 foot rear yard setback and 2 feet in the 20 foot front yard setback. This request is appropriate under Section 24-52(e)(1-6) of the Butte County Code. CCEQA issues: Upon careful and deliberate review of the project and the project site environs, the proposed encroachment of the single family dwelling will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15305 Class 5(a) of the California Environmental Quality Act guidelines. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15305 Class 5(a) which states Minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. II. Recommend approval to the Planning Commission for a Minor Variance (MVAR 01-01) for Esther L. Thompson on AN 035-122-007 to allow the placement of a mobile home as a single family dwelling, subject to the condition(s)found in Exhibit A and with the following ■ BUTTE COUNTY PLANNING MANAGER ■ AGENDA REPORT ■ PAGE 2 ■ findings: A. There are special circumstances applicable to the property (size, shape, topography, location or surroundings)or the intended use of the property, and because of this,the strict application of zoning standards Code deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. The Butte County Zoning Code, Chapter 24, Section 24-52 (d),provides for approval when special circumstances related to physical criteria are met. B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought. The neighboring parcels,not limited nor nonconforming in size,enjoy single family residences. The surrounding area is characterized by single family residences and duplex units encroaching in the front and rear yard setbacks. C. This Minor Variance will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located. The public health & safety will not be jeopardized by the property owner receiving approval to construct her single family residence, with an k encroachment of 20% or less, 1 foot into the 5 foot rear yard setback and 2 feet into the 20 foot front yard setback. D. This Minor Variance will not allow a use'or activity which is prohibited by the zoning regulation governing the parcel of property. The R-N zoning classification's site requirements require a 5 foot rear yard setback and a 20 foot front yard setback. E. This Minor Variance will not be incompatible with the Butte County General Plan. The General Plan Land Use Element designation, is MDR (Medium Density Residential). The Land Use Element identifies residential use as a "Primary Use." The "Site Designation Criteria" of the land use designation are met with this application.
