APN 065-510-034 (CBS) (MVAR 02-01) Mr. Sanders said that after holding a public hearing,the Planning Manager recommended approval. It was moved by Commissioner Leland, seconded by Commissioner Lambert, and unanimously carried to approve the Minor Variance for Roger Stapp subject to the findings and conditions listed below: I. The project is exempt from the provisions of the California Environmental Quality Act under Section 15305 Class 5(a)which includes Minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. lI. Approve a Minor Variance(MVAR 02-01) for Roger Stapp on APN 065-5101034 to allow the placement of a structure 16 feet from the edge of the right-of-way along Notty Lane in Exhibit A and with the following findings: A. There are special circumstances applicable to the property(size, shape, topography, location or surroundings)or the intended use of the property, and because of this,the strict application of zoning standards Code deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. The Butte County Zoning Code, Chapter 24, Section 24-52 (d), provides for approval when special circumstances related to physical criteria are met. Specifically: 1. The proposed residential use is an allowed use on all parcels in the TM-1 zone. 2. The subject parcel is pre-existing lot that is significantly smaller than the minimum parcel size required in the TM-1 zone. 3. The parcel shape which is 285 feet wide by 100 feet deep combined with sloped topography covering approximately 60 feet of the lot's depth severely limits the choices for locating a home on this parcel. B. This Minor Variance will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located. The public health & safety will not be jeopardized by the property owner receiving approval to construct a single family residence, with an encroachment of 4 feet into the 20 foot front yard setback, a 20% reduction to the required 20-foot setback. The property is located on the south side of Notty Lane, approximately 500 feet east of Coutelenc Road, upper Paradise ridge area. APN 065-510-034 (CBS) (MVAR 02-01) Mr. Sanders gave a brief summary of the project. The hearing was opened to the public. James Scales said he owns a 30-foot easement between his property and the subject property. He said there has been grading on the easement that has caused a 3-foot high bank along his property and has made it hard to access his property from the easement. He remarked that his property needs a retaining wall before it can be developed. He said the dirt from the easement was put on the applicant's parcel as filler. Steve Wilson,Parcel 65-91-97, adjacent to the subject property pointed out that when the easement cut was made, the dirt was pushed over to Mr. Stapp's property and he did not want the proposed development on Mr. Stapp's property to preclude him from developing his own property in the future. Mr. Meleka asked Mr. Scales if his concerns were the cuts that took place in the easement and the dip in the created access; Mr. Scales affirmed. Mr..Vernie Wilson mentioned that he owns part of the easement and it used to have a gradual slope along his and Mr. Scales property. He said that the cuts were done at the time when Mr. Barrons owned the subject property. This was done 10 years ago. He submitted a picture of the easement for the record. Mr. Stapp spoke to the request being for a Variance 4 feet into the setback. Mr. Scales requested that the cuts be filled back in or a retaining wall put in. Mr. Meleka asked about the surrounding properties that use the easement for access. Mr. Sanders said that this easement was not the deeded access into Mr. Scales property. There was a brief discussion. He noted that after 10 years, the fill soil should be suitable for a septic and leachfields. He did not know what, if anything, could be done about the 10-year old cuts to the easement and did not feel it was relevant to granting the Variance. Mr. Wilson said that he will need this easement in the future to access his property. Mr. Sanders discussed the placement of the well and sepiic in relationship to the adjoining property. Mr. Meleka suggested a condition that any future work on this easement should be coordinated with the other property owners so that no hardships are caused to the other property owners. ■ BUTTE COUNTY PLANNING SERVICES MEETING■ MINUTES-DECEMBER 26,2001 ■PAGE 1 0 Mr. Scales made it clear that he did not object'to this Variance and was only concerned with the easement. The hearing was closed. PUBLIC HEARING REQUIREMENTS A variance is subject to a public hearing by the Planning Commission. All parcels within a 300' radius of the application boundaries, but not less than 10 parcels, will be notified of the application by the Planning Division prior to the public hearing. C. NECESSARY FINDINGS OF FACT Each zoning classification and land use has an associated set of development standards which are specified in the Butte County Zoning Code. The California Government Code Section 65906 and 65906.5 and the Butte County Zoning Code establish findings which must be made in order to grant variances from these standards where unique circumstances exist to warrant relief from the strict application of these i standards. Variances from the terms of the Zoning Code may be granted only when, because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the Zoning Code deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. Any Variance granted may be subject to conditions that will assure that the deviation shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated. Variances can D.Qt be granted for reductions in lot size, increases in residential density, increase in lot coverage, or for uses not permitted in a zone. The courts have clearly indicated that variances are not intended to rewrite the County Code and can only be granted if all the findings listed below are made. Further, the courts have indicated the actual, factual basis for these findings must be stated. In order to approve a variance, the Planning Manager must establish that special circumstances are applicable to the property, including size, shape, topography, location, and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The Planning Manger's decision must also have approval by the Planning Commission as a consent agenda item. With a Minor Variance, setback distances can only be reduced a maximum of 20%. The required front setback for this parcel is 20 feet. A 20% reduction in the setback equates to 4 feet. The applicant is requesting maximum relief to the setback allowed by a Minor Variance. Approval would allow a structure to be built 16 feet from the edge of the right-of-way on Notty Lane. The subject appears to be faced with at least three hardships when compared to other parcels in the surrounding TM-1 zone. First, the parcel is significantly smaller than the majority of parcels in the surrounding area and is substantially smaller than the one-acre minimum required by the zone. Second, approximately 60% of the parcel has significant slope that makes building within the area more costly. Of the 0.65 acre parcel about 0.26 has fairly level topography suitable for normal construction techniques. Third, the shape of the parcel is somewhat irregular. The depth of the lot is only 100 feet. A 20-foot building setback reduces the building area to 80 feet in depth and the topography further reduces the suitable building site depth to about 20 feet. In addition, the small size of the project parcel, and the area needed for the septic tank and leachfield further restricts the suitable building area. The applicant has chosen a house design that attempts to fit within the setback and topography limitations of the site. The building footprint is only 26 feet deep from front to back. Oher Issues The Butte County Building Division , Environmental Health Division, and Butte County Fire Department/CDF have no objections to or conditions for this project. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this variance. These findings indicate that the adjustment authorized will not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. 0 BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT 0 PAGE 2 0 CEQA ISSUES Upon careful and deliberate review of the project and the project site environs, the proposed encroachment of the single family dwelling will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15305 Class 5(a) of the California Environmental Quality Act guidelines. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Manager take the following actions: I. Recommend that the Planning Commission find that the project is exempt from the provisions of the California Environmental Quality Act under Section 15305 Class 5(a) which states Minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. II. Recommend approval to the Planning Commission for a Minor Variance (WAR 02-01) for Roger Stapp on APN 065-5101034 to allow the placement of a structure 16 feet from the edge of the right-of-way along Notty Lane in Exhibit A and with the following findings: A. There are special circumstances applicable to the property(size, shape, topography, location or surroundings) or the intended use of the property, and because of this,the strict application of zoning standards Code deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. The Butte County Zoning Code, Chapter 24, Section 24-52 (d), provides for approval when special circumstances related to physical criteria are met. Specifically: 1. The proposed residential use is an allowed use on all parcels in the TM-1 zone. 2. The subject parcel is pre-existing lot that is significantly smaller than the minimum parcel size required in the TM-1 zone. 3. The parcel shape which is 285 feet wide by 100 feet deep combined with sloped topography covering approximately 60 feet of the lot's depth severely limits the choices for locating a home on this parcel. B. This Minor Variance will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located.
