Re: Fiori-Webb Proposed Development Notice Of Proposed "Minor Variance Approval" Dear Butte County Development Services Planning Division: I am writing to oppose the "minor variance approval" requested by Mr. Webb. In this particular case the developer knew or should have known about the Fern Avenue lot with an existing easement. In any event, the Jones family has maintained this easement for over 25 years. The Jones family has planted a garden and utilized the easement to access their back yard. Perhaps the Jones family should raise the issue of adverse possession of the easement, they have most certainly earned it. The property owner and the developer were aware of the Jones's utilizing and maintaining the easement. I do not oppose development or growth in our rural community setting. I am very proud of being a N.I.M.B.Y., because I care what happens to my rural community setting What I oppose is the creation of islands within the county jurisdiction and the extreme gerrymandering currently being implement by the City Of Chico. At best this practice is unethical and most likely illegal. What I oppose is planning that fails to recognize and consider the existing neighborhood. In my neighborhood most of the lots average 12,000 square feet and some are larger. Our lot size is 90feet by 125feet. All of my neighbors lots are the same or large. The Webb subdivision proposes 3 houses behind my home and this is NOT compatible with the neighborhood. At one point Mr. Fiore agreed to line up the property lines along Fern Avenue. Shortly after this agreement, he sold this property to Mr. Webb. We talked to Mr. Webb and his attitude is, I HAVE THE POWER TO BUILD WHAT I WANT IN THIS TOWN. Please prove him wrong and let us keep our rural atmosphere. Another concern we have is the 60foot easement on Fern Avenue. Mr. Webb has asked for a variance on this lot so he can build a home on it. We urge you not to grant this variance. All the homes on Fern Ave. are 90 feet or more and the spacing between each of our home is 20 feet or more. Putting a house on this small lot would NOT be consistent with Fern Ave. lots. The families on Fern Ave. have been before the Development Review Board twice with Mr. Fiore as the developer and the Board has not approved this development or the easement. This easement is a dead piece of property. We have mowed this lot for 26 years due to the fire danger. We also have planted a vegetable garden every summer on this easement.
