Jolynn Aanenson, (Item determined to be Categorically Exempt from environmental
review),Minor Variance to allow a structure to be placed two and one-half(2.5)feet into a
25 foot rear yard landing setback on property zoned A-20 (Agricultural—20 acre parcels).
The property is located on the south side of Old Chico Way, approximately 300 feet east of
Floating Cloud Drive,at 60 Old Chico Way,south of Chico. APN 039-410-077(MM)(File
#MVAR 03-02)
It was moved by Commissioner Leland,seconded by Commissioner Marin, and unanimously carried to
approve the Minor Variance for Jolynn Aanenson subject to the findings and conditions listed below:
1. Find that the project is Categorically Exempt from the provisions of the California
Environmental Quality Act (CEQA) under Section 15305, Class 5(a), which states that
variances not resulting in the creation of any new parcel are Categorically Exempt from
CEQA..
II. Approve a Minor Variance (MVAR 03-02) for Jolynn Aanenson on APN 039-410-077 to
allow the existing structure/bui I ding to encroach 2.5 feet into the required 25 foot rear yard
setback, subject to the conditions found in Exhibit A and with the following findings:
A. There are special circumstances applicable to the property(size,shape,topography,
location or surroundings)or the intended use of the property,and because of this,the
strict application of zoning standards deprives the property of privileges enjoyed by
other property in the vicinity and under identical zoning classification. The Butte
County Zoning Code, Chapter 24, Section 24-52 (d), provides for approval when
special circumstances related to physical criteria are met. Specifically:
1. The subject property's size,0.73 acres is not consistent with the existing 20-
acre minimum parcel zoning standard. The required rear yard setback of 25
feet for the A-20 zone is too restrictive for the parcel.
2. The previous variance for this parcel allowed a 5 foot encroachment into the
same rear yard,effectively extending the developed area of the rear yard by 5
feet. The requested Minor Variance for the 2.5 foot encroachment would
take place within the existing 5 foot area.
B. This Minor Variance will not be detrimental to the public health,safety or welfare,or
injurious to the property or improvements in such vicinity and zone in which the
property is located. The public,health & safety will not be jeopardized by the
property owner receiving relief from the required 25 foot rear yard setback in the A-
20 zone. Specifically:
1. The Butte County Fire Department/CDF, Public Works Department,
Agricultural Commissioner,LAFCo,and Environmental Health Division'do
not object to the Minor Variance approval.

Conditions of Approval:
1. Provide an all weather access to all structures, which is designed to carry a 40,000
pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance.
2. Prior to the issuance of building permits, the plans, incorporating all applicable
conditions of approval shall be submitted to the Planning Division to verify
compliance with said conditions of approval.
3. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.

Mr. Michelena gave a brief summary of the project.
The hearing was opened to the public.
The applicant was not present.
The hearing was closed.
Mr. Sanders concurred with staff's recommendation to recommend approval of the Minor Variance
for Jolynn Aanenson subject to the findings and conditions listed below, deleting Condition 1
finding that all weather access to the home is sufficient per the Fire Department.
1. Recommend that the Planning Commission find that the project is Categorically Exempt
from the provisions of the California Environmental Quality Act (CEQA) under Section
15305,Class 5(a),which states that variances not resulting in the creation of any new parcel
are Categorically Exempt from CEQA.

This checklist is designed to assist applicants in making sure all necessary information is included in their
application packet. Please include this checklist along with your submittal.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Jolynn Aanenson is hereby granted a Minor Variance in accordance with
application filed,to allow a structure/building to encroach 2.5 feet into the required 25 foot rear yard
setback at APN 039-410-077 located at 60 Old Chico Way in southwest Chico area.
1. Failure to comply with the conditions specified herein as the basis for approval of the
application and issuance of the permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-62.
2. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health,or Public Works upon receipt of a substantiated written request by the
applicant,or their respective designee. Prior to such approval,verification shall be made by
each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
3. A Minor Variance shall lapse and shall become void one year following the date on which
the Minor Variance became effective,unless prior to the expiration of one year, a building
permit is issued and construction is commenced and diligently pursued toward completion
on the site which was the subject of the Minor Variance application.
4. The terms and conditions of this minor variance shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.
Conditions of Approval:
1. Provide an all weather access to all structures, which is designed to carry a 40,000
pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance.
2. Prior to the issuance of building permits, the plans, incorporating all applicable
conditions of approval shall be submitted to the Planning Division to verify
compliance with said conditions of approval.

3. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
NOTE: Issuance of this Minor Variance does not waive requirement of obtaining Building and
Health Department permits before starting construction, nor does it waive any other requirements.

PROJECT DESCRIPTION/SITE CHARACTERISTICS:
The•applicant is requesting a Minor Variance for an existing structure/building, which stores
horticulture supplies, that encroaches 2.5 feet into the required 25 foot rear yard setback, as per
Section 24-90.10 of the Zoning Code.
The project site is located southwest of Chico,just outside the Chico Urban area. The project site is
surrounded by other nonconforming parcels in the A-20 zone. To the west of the project site is a
residential development in the.SR-1 zone. Access to Old Chico Way is provided by either
Macintosh Avenue or Diamond Avenue.
The applicant's parcel, APN 039-410-077, is part of the Glendale Addition No. 1 Subdivision,

created by Final Map of Book 6 of Maps at page 45,on April 11, 1907. The applicant's parcel was
created by the merging of several underlying lots in a merger action approved, May 21, 1997. As
part of the merger approval, the Board of Supervisors approved a Settlement Agreement with the
applicant in which the setbacks for the subdivision were changed to the following: Front yard--20
foot,Rear yard--25 foot, and Side yard--10 foot. The zoning for the area is A-20 (Agricultural 20-
acre minimum.parcel). The A-20 zoning classification was approved for this area March 1, 1988.
The General Plan Land Use designation for the property is Orchard&Field Crops,which specifies a
minimum parcel size of 5 acres. The final map of the Glendale Addition No. 1 Subdivision predates
the County's General Plan Land Use designation by approximately 70 years.
The applicant received a previous Minor Variance in September 2000, on the same parcel, for a
garage/shop that encroached 5 feet into the required 25 foot rear yard setback.
ANALYSIS:
The applicant has built a structure/building 2.5 feet into the required 25 foot rear yard setback.Due
to the pre-existing nonconforming size of the parcel,0.73 acre,in the A-20 zone,and the Orchard&
Field Crops General Plan designation, along with the previously approved Minor Variance, the
applicant requests to encroach 2.5 feet into the required 25 foot rear yard setback. This request is
appropriate under §24-52(e)(1- 6) of the Butte County Code.
Alternatives
The existing structure/building could have been placed on the parcel, either by moving the
structure/building location north, rotating it, or reducing the size, so it would not have encroached
into the setback. However,the previous variance allowed a 5 foot encroachment into the same rear
yard, effectively extending the developed area of the rear yard by 5 feet. The requested Minor
Variance for the 2.5 foot encroachment would take place within the existing 5 foot area.
Other Issues
The Butte County Building Division requires building permits for the existing structure/building.
The Butte County Fire Department/CDF, Public Works Department, Agricultural Commissioner,
LAFCo, and Environmental Health Division do not object to the project or recommend any
conditions.
Conclusion
Even though alternative locations or design could have prevented the encroachment of the
structure/building,the special circumstances that exists for the applicant's parcel which include the
non-conformance of the 0.73 acre parcel to the minimum lot size for the A-20 zone and OFC

General Plan designation, and the presence of the existing encroachment of the garage/shop 5 feet
into the same rear yard.
CEQA ISSUES:
Upon careful and deliberate review of the project and the project site environs,the proposed Minor
Variance allowing for a 2.5 foot encroachment in the required 25 foot rear yard setback would have
no significant environmental effects and has been determined to meet the criteria for a Categorical
Exemption under Section 15305 Class 5(a) of the California Environmental Quality Act (CEQA)
Guidelines.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Commission take the following actions:
I. Recommend that the Planning Commission find that the project is Categorically Exempt
from the provisions of the California Environmental Quality Act (CEQA) under Section
15305,Class 5(a),which states that variances not resulting in the creation of any new parcel
are Categorically Exempt from CEQA.
H. Recommend approval of the Minor Variance(MVAR 03-02)for Jolynn Aanenson on APN
039-410-077 to allow the existing structure/building to encroach 2.5 feet into the required 25
foot rear yard setback, subject to the conditions found in Exhibit A and with the following
findings:
A. There are special circumstances applicable to the property(size, shape,topography,
location or surroundings)or the intended use of the property,and because of this,the
strict application of zoning standards deprives the property of privileges enjoyed by
other property in the vicinity and under identical zoning classification. The Butte
County Zoning Code, Chapter 24, Section 24-52 (d), provides for approval when
special circumstances related to physical criteria are met. Specifically:
1. The subject property's size,0.73 acres is not consistent with the existing 20-
acre minimum parcel zoning standard. The required rear yard setback of 25
feet for the A-20 zone is too restrictive for the parcel.
2. The previous variance for this parcel allowed a 5 foot encroachment into the
same rear yard,effectively extending the developed area of the rear yard by 5
feet. The requested Minor Variance for the 2.5 foot encroachment would
take place within the existing 5 foot area.

B. This Minor Variance will not be detrimental to the public health,safety or welfare,or
injurious to the property or improvements in such vicinity and zone in which the
property is located. The public health & safety will not be jeopardized by the
property owner receiving relief from the required 25 foot rear yard setback in the A-
20 zone. Specifically:
1. The Butte County Fire .Department/CDF, Public Works Department,
Agricultural Commissioner,LAFCo,and Environmental Health Division do
not object to the Minor Variance approval.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Jolynn Aanenson is hereby granted a Minor Variance in accordance with application

1. Failure to comply with the conditions specified herein as the basis for approval of the
application and issuance of the permit constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-62.
2: Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health,or Public Works upon receipt of a substantiated written request by the
applicant,or their respective designee. Prior to such approval,verification shall be made by
each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
3. A Minor Variance shall lapse and shall become void one year following the date on which
the Minor Variance became effective,unless prior to the expiration of one year, a building
permit is issued and construction is commenced and diligently pursued toward completion on
the site which was the subject of the Minor Variance application.
4. The terms and conditions of this minor variance shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.

Conditions of Approval:
1: Provide an all weather access to all structures,which is designed to carry a 40,000
pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance.
2. Prior to. the issuance of building permits, the plans, incorporating all applicable
conditions of approval shall be submitted to the Planning Division to verify
compliance with said conditions of approval.
3. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
NOTE: Issuance of this Minor Variance does not-waive requirement-of obtaining Building and
Health Department permits before starting construction,nor does it waive any other requirements.

NOTICE OF PROPOSED MINOR VARIANCE HEARING
Notice is hereby given that the Butte County Director of Development Services is proposing to
recommend approval of a Minor Variance for Jolynn Aanenson to allow a structure to be placed
two and one-half (2.5) feet into a 25-foot rear yard landing setback on property zoned A-20
(Agricultural, 20-acre parcels). The property is located on the south side of Old Chico Way,
approximately 300 feet east of Floating Cloud Drive, at 60 Old Chico Way, south of Chico. APN

Persons wishing to comment on the project may submit written comments to the Butte County
Planning Division any time prior to Tuesday, September 24, 2002. The Development Services
Director shall consider all comments in determining if the application meets all of the above
conditions and criteria. Upon finding that the proposed use does or will meet all of the conditions
and criteria,the Director of Development Services will hold a hearing on Wednesday,September
25, 2002, at 9:00 a.m., in the Development Services conference room, at 7 County Center Drive,
Oroville. Any interested person may attend this hearing. The decision of the Planning Manager or
representative will be submitted, to the Planning Commission for final approval. If recommended
for approval, this item will be on the Planning Commission Consent Agenda at the next available
meeting. Upon action taken by the Planning Commission on the project an appeal may be filed with
the Clerk of the Board of Supervisors. The appeal period is 10 days.

Dear Mr. Kerr and Mrs. Aanenson,
I received your letter dated May 23, 2002, and would like to respond.
The 1997 Uniform Building Code describes an agricultural building as a structure limited
to the following uses:
1. Storage, livestock and poultry.
2. Milking barns.
3. Shade structures.
4. Horticultural structures (greenhouse and crop protection).
The code further defines an agricultural building as follows.:
Agricultural building is a structure designed and constructed to house farm
implements, hay, grain,poultry, livestock, or other horticultural products. This
structure shall not be a place of human habitation or a place of employment
ti�here agricultural products are processed, treated, or packaged, not shall it be a
place used by the public.
During several site visits, it was determined that the structure is already constructed, and
appears to be a shade structure or screened patio approximately 6 to 8 feet from the pool.
The structure is within the 25 foot rear yard setback. The Environmental Health
Department clearance is for a screened patio. They have determined that the structure is
on top of the existing leach lines, which must be abandoned, and relocated.
We cannot issue a building permit for a structure in a setback, whether it is an
agricultural exempt building or not. Based upon our site visits, the Health Department

clearance,the information you-,h.-ave provided us to this point, and your previous
application for a building permit for a screened porch and trellis which was refunded, we
have determined that your proposed structure does not fit the definition or intended use of
an agricultural exempt building. .
It is now in order for you to apply for a Minor Variance to allow the above structure in
the setback. The alternative to a variance would be to remove the structure from the
setback. In addition it is now in order for you to provide construction plans including an
accurate plot plan showing all structures on the property, foundation plan, floor plan, and
framing plans, and apply for building permits.

The Planning Division has received a project application for the property described below. The purpose of this
comment sheet is to:
1. Determine if the information contained in the application is adequate to allow your jurisdiction to review
the project and submit conditions, if any; and to
2. Determine the appropriate environmental documents to prepare for this project, as well as to identify
particular environmental concerns to be addressed or mitigation measures your agency/department may want
incorporated.
If the application is determined to be complete within 30 days of its submittal it should be heard at the estimated
hearing date indicated below. If a response cannot be submitted within the time frame given, or if additional

This is an application for Minor Variance to allow a structure to be placed two and one-half(2.5) feet into a
25=f6ot rear yard landing setback on property zoned A-20(Agricultural,20-acre parcels)located on the south
side of Old Chico Way, approximately 300 feet east of Floating Cloud Drive, at 60 Old Chico Way, south of
Chico, identified as APN 039-410-077. Supervisorial District No. 4 .
