I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, CEQA Guideline's Section 15303 — New Construction or Conversion of Small Structures,Class 3 consists of construction and location of limited number of new, small facilities or structures; subsection (a)—One single-family residence, or a second dwelling in a residential zone. II. Zoning Ordinance Findings. A. There are special circumstances applicable to the property(size,shape,topography, location or surroundings)or the intended use of the property,and because of this,the strict application of zoning standards Code deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification in that the irregular shape of the parcel with easement setback and rear yard setback along with septic space requirement poses a hardship; and B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be materially detrimental to the public health,safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The use is residential and the proposed use is residential. F. If this entire matter or any finding,action or condition of this matter is appealed to the Board of Supervisors, the applicant, or any other subdivider other than the applicant, agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing.If the application is not appealed,this condition is deemed satisfied. Present: Joe Baker, Planning Manager Mark Michelena, Associate Planner Also Present: John Starr, Better Builders Construction, Inc. Roni Thornton, Secretary I. ITEM FOR CONSIDERATION Better Builder Construction, (Item determined to be Categorically Exempt from environmental review), Minor Variance application to allow a structure to encroach 3 feet into the 15-foot rear yard setback on property zoned R-1 (Residential). The property is located at the end of Fowler Court, approximately 400 feet southwest from the intersection of Royal Oaks Drive and Oman Drive, and approximately four-tenths of a mile northeast from the intersection of Canyon Drive and Royal Oaks Drive,Kelly Ridge, Oroville. APN 069-530-043 (MM) (MVAR 03-03) Mr. Michelena gave a brief summary of the project. The hearing was opened to the public. Mr. Starr said he has built eight other homes in that subdivision, and this is the first one that anyone has picked up the R-1, 15-foot setback. He said the house was designed to set 10 feet on the back property,except the sewer easement. He said the 15-foot setback does make a hardship,and that is why he is asking for the Minor Variance. Mr. Baker asked if Mr. Starr had done a custom design for the site. Mr. Starr answered "correct." Mr. Baker asked about the slope of the parcel. Mr. Starr said that there is at least 45 feet of fall from the southeast corner of the property to the northwest corner; it is a steep lot. He said he put a retaining wall in on the lower,western exposure, to level the lot for a two-story house, and will have a tall retaining wall across the back. He added that he already has a building permit for the house and found out about the 15-foot setback when he got the building permit. Mr. Baker asked if the building permit was issued in spite of the fact that there was a setback issue. Mr. Baker asked if all fees had been paid. Mr. Michelena said "no", but added that the applicant was willing to pay the required fees due. The hearing was closed. PROJECT DESCRIPTION The applicant requests approval of a minor variance to allow an encroachment of 3 feet into the 15- foot rear setback for the construction of a single family residence. The resulting setback from the rear property line will be 12 feet. PROJECT SITE DESCRIPTION The property is not developed at this time. The applicant proposes to develop the site with a 2,677 square foot dwelling and garage. Public sewer and water would serve the dwelling. The project site is located in a rural/suburban east of Oroville, in the Kelly Ridge area. Parcel sizes range from 0.2 acres to 1.3 acres. Parcels within the surrounding R-1 zone are generally same or larger than the 0.27 acre parcel. 0 BUTTE COUNTY PLANNING MANAGER 0 AGENDA REPORT 0 PAGE 1 0 The applicant is requesting a Minor Variance to allow the new construction of a primary residence to be located so that a retaining wall will be built three feet into the fifteen foot rear yard setback, as per Chapter 24 of the Zoning Code. The applicant's parcel, APN 069-530-043,was created in 1981. The zoning for the area was RT-1 (Medium Density Residential — Mobile Home) which required a rear setback five feet. The Area was rezoned in 1986 to R-1,which has a rear setback requirement of fifteen feet. The General Plan Land Use designation for the property is Low Density Residential, which specifies a minimum parcel size of 6,500 square feet with sewer. ANALYSIS Section 24-52 of the Butte County Code sets out the provisions for Minor Variances. In order to approve a variance,the Planning Manager must establish that special circumstances are applicable to the property, including size, shape,topography, location, and surroundings that cause a variance to County code to be necessary. Additionally, the variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. The Planning Manger's decision must also have approval by the Planning Commission as a consent agenda item. With a Minor Variance, setback distances can only be reduced a maximum of 20%. The required rear yard setback for this parcel is 15 feet. A 20% reduction in the setback equates to 3 feet. The applicant is requesting maximum relief to the setback allowed by a Minor Variance. Approval would allow a structure to be built 12 feet from the rear property line. The subject appears to be faced with at least three hardships when compared to other parcels in the surrounding R-1 zone. First, the parcel,even though it is approximately a quarter-of-an-acre, is on the smaller size with regard to the parcels in the surrounding area. Second, the parcel has slope issues which are the reason for the retaining wall. Third, the shape of the parcel is irregular. The front of the parcel is narrow at the front setback than the required 65 minimum lot frontage. This narrow lot frontage, along with the slope of the property, requires that the house be placed further back on the lot than most of the surrounding lots. While the depth of the lot is approximately 175 feet,the irregular shape of the lot,slope of the property,and the required setbacks limit the buildable depth of the lot to approximately 85 feet. In addition, when the parcels were originally created, November 13, 1992, zoning for the parcel was RT-1, which had a 5 foot rear setback requirement. There is also a 10 foot Public Utility Easement existing at the rear of the parcel. Other Issues The Butte County Fire Department/CDF believes this may change the SRA PRC 4290 building requirements and suggests a new site plan should be submitted to the Fire Department for conditioning.
