APN 064-390-001 (MM) (MVAR 03-01) It was moved by Commissioner Leland, seconded by Commissioner Marin, and unanimously carried to approve the Minor Variance for King and Lynn Baker subject to the findings and conditions listed below: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, CEQA Guideline's Section 15305 - Minor Alterations in Land Use Limitations, Class 5 - (a) minor setback variances not resulting in the creation of any new parcel, and Section 15301 —Existing Facilities, Class 1 - (e) additions to existing structures provided that the addition will not result in an increase of more than: (1) - 50 percent of the floor area of the structures before the addition, or 2,500 square feet, whichever is less. ` Il. Zoning Ordinance Findings. A. There are special circumstances applicable to the property(size,shape,topography, location or surroundings)or the intended use of the property,and because of this,the strict application of zoning standards Code deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification in that the irregular shape of the parcel with easement setback and rear yard setback along with septic space requirement poses a hardship; and B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. H. PUBLIC HEARING REQUiKEMENTS A minor variance is subject to a public hearing by the Planning Commission. All parcels within a 300' radius of the application boundaries, but not less than 10 parcels, will be notified of the application by the Planning Division prior to the public hearing. C. NECESSARY FINDINGS OF FACT Each zoning classification and lana] use has an associated set of development standards which are specified in the Butte County Zoning Coils. The California Government Code Section 65906 and 65906.5 and the Butte County Zoning Code establish findings which must be made in order to grant minor variances from these standards where unique circumstances exist to warrant relief from the strict application of these standards. Minor variances front the teens of the Zoning Code may by granted only when, because of special circumstances applicable to the subject property, including sire, shape, topography, location, or surroundings, the strict application of the 'Zoning Code deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. Any Minor Variance granted maybe subject to conditions that will assure that the deviation shall not constiture a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone if) which such property is situated. Minor variances can not be granted for reductions in lot size, increases in residential density, increase in lot coverage,or for uses not permitted in a zoite. The courts have clearly indicated that minor variances are not intended to rewrite the County Code and can only be granted in all the lindings listed below are made. Further, the courts have indicated the actual, factual basis for these findings must me stated. PROJECT DESCRIPTION The applicant requests approval of a minor variance to add a 478 square foot addition to the master bedroom of an existing house. The addition would extend out from the existing house on ` the side and rear yards. A portion of the rear addition will extend three (3) feet into the required fifteen(15) foot rear building setback. PROJECT SITE DESCRIPTION The property is developed with a two-bedroom, 1,248-square foot single family dwelling with an attached garage, public water, septic tank and leach field. Access onto the site is from Cumberland Road. The property is an interior lot, with existing single family dwellings to the ■ Butte County Department-of Development Services ■ Planning Division 0 Page 1 0 north, east, and west. The project site is level with no topographic features that would create a hardship for the property. Surrounding properties in the R-1 zone are developed with single family dwellings. The project parcel was created in December 1970. At that time, the site was zoned A-2, which allowed a minimum parcel size of 8,125 sq. ft, with side and rear yard building setbacks of five feet. Because the project parcel met the minimum parcel size requirements at the time it was created, the property is considered to be a legal, nonconforming parcel. The site was rezoned to RT-1 (Residential Mobile Home) in 1975, which also required side and rear yard building setbacks of five feet. The house on the property was constructed in 1979. The site was rezoned to the existing R-1 zone which requires a side yard building setback of five feet and a rear yard building setback of fifteen feet. Butte County Code Sections 10-6 and 10-7 state that building setbacks from a road are only required if the road is dedicated and accepted for public use. Normally, there is a 50 or 55-foot building setback from the centerline of a road accepted for public use. According to the Public Works Department, Cumberland Road is a public road. The existing house is over 90 feet from the centerline of Cumberland Road, which meets the required standards. Therefore, the only building setbacks that apply are the setbacks found in the R-1 section of the Zoning Ordinance (Section 24-120.10). ANALYSIS In order to approve a minor variance, the Planning Manager must establish that special circumstances are applicable to the property, including size, shape, topography, location and surroundings that cause a minor variance to County code to be necessary. Additionally, the minor variance must not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. Staff finds that there is a minor hardship with respect to the shape of the parcel. The rear property line is not a straight line. A portion of the lot angles slightly toward the front of the property, which is the area of the proposed addition. If the rear property line was a straight line, the proposed addition would be outside the required rear yard building setback. The parcel is currently developed with a house, septic tank, leach field and a front deck. The location of these improvements, the existing design of the house, existing trees, and the small size of the parcel are contributing factors that limit alternatives for development. Section 24-52(e) of the Butte County Code allows the Director of Development Services to grant a Minor Variance, at a maximum reduction of twenty percent (20%) of the prescribed requirements of Section 24 of the Butte County Code with respect to front, rear, or side yard setbacks. The existing house has two bedrooms on the east side of the house, which would be the most logical place to expand an existing bedroom. However, placing the addition on the front (or south) bedroom would require relocation of an existing septic tank and leach lines, and partial removal of an existing deck. It appears that the applicant's proposal to construct the addition on the north and west end of the house is very appropriate because of the existing bedroom and lack of physical constraints. ■ Butte County Department of Development Services 0 Planning Division 0 Page 2 0 The addition to the house would not result in a reduced sight-distance since it is an interior lot. The existing house is located 60 feet(90 feet from centerline) from Cumberland Avenue, and the addition would not encroach into the 20-foot front yard building setback. The addition to the house is consistent with the use of residential property and would not constitute a special privilege not enjoyed by other similar properties in the area. Alternatives The proposed addition could be placed on the south side of the house, but doing so would require: the partial removal and relocation of an existing deck; relocation of the septic tank and leach lines; and reducing the size of the leach field. Moving the addition to the northeast side of the house would meet existing setback requirements, but would not allow for the proposed expansion to tie into the existing bedroom and would require the removal of mature trees. Another alternative would be to reduce the size of the addition to remain outside the required 15- foot rear yard setback. This alternative would reduce the size of the addition from 478 square feet to approximately 400 square feet and change the design of the addition. Other Issues The Butte County Building Division requires building permits for the proposed bedroom expansion. Butte County Fire Department/CDF, Public Works Department, Agricultural Commissioner, LAFCo, Environmental Health Division, Del Oro Water Co, and Paradise Pines Community Association did not object to the project or recommend any conditions. Conclusion The special circumstances noted in the previous sections allow for the findings necessary to grant this minor variance and indicate that the adjustment authorized would not constitute a grant of special privilege inconsistent with the limitations placed upon other properties in the vicinity and zone in which the property is situated. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. This proposal has been determined to be Categorically Exempt from the California Environmental Quality Act. Specifically, CEQA Guideline's Section 15305 - Minor Alterations in Land Use Limitations, Class 5 - (a) minor setback variances not resulting in the creation of any new parcel, and Section 15301 —Existing Facilities, Class 1 - (e) 0 Butte County Department of Development Services 0 Planning Division ■ Page 3 ■ additions to existing structures provided that the addition will not result in an increase of more than: (1) - 50 percent of the floor area of the structures before the addition, or 2,500 square feet,whichever is less. II. Zoning Ordinance Findings. A. There are special circumstances applicable to the property (size, shape, topography, location or surroundings) or the intended use of the property, and because of this, the strict application of zoning standards Code deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification in that the irregular shape of the parcel with easement setback and rear yard setback along with septic space requirement poses a hardship; and B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be materially detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The use is residential and the proposed use is residential. F. This Minor Variance will not be incompatible with the Butte County General Plan. I III. Action. A.
