Mr. Sanders called the meeting to order noting that the applicant was present.
The hearing was opened.
Mr. Hill agreed to the conditions as listed in the agenda report dated December 30, 1996.
The hearing was closed.
Mr. Sanders recommended to the Planning Commission that the Minor Variance for
Richard Hill be approved subject to the findings and conditions listed in Exhibit A of the
Agenda Report and the item be scheduled for the March 13, 1997 Planning Commission
Consent Agenda. If the Planning Commission concurs with the recommendation, the
Variance can be issued. There is no appeal for Minor Variance decisions.

is located in Supervisorial District 5.

SUMMARY: Staff recommends approval of this application.
PROJECT CHARACTERISTICS: This is a minor variance request to allow an overhead canopy
within the 25 ft. front yard setback. The canopy, which will cover two self-serve gas pumps, will
be located nine (9) ft. into the front yard setback. The project site is located on Skyway, and is
developed with a 1,500 sq. ft. convenience food store (Hill's Country Store) and an attached 900
sq. ft. dwelling unit. The store has been in operation since 1966, and the gas pumps were
installed in 1977. The project site is zoned CC (Community Commercial) and is designated by
the Land Use Element Map of the Butte County General Plan as Low Density Residential.
Surrounding parcels are zoned RT-1 (Residential-Mobile Home) and the land use is low density
residential.
The parcel was zoned C-C when the gas tanks and pumps were initially installed. The C-C
zoning at that time did not require a front yard setback. However, the current C-C zoning
requires a minimum front yard setback of 20 ft. from the edge of the road right-of-way, or 25 ft.
when located on a federal aid secondary road, such as The Skyway. A variance is not required
for the pumps themselves because they are a legal, pre-existing use and conformed to the
zoning requirements when they were installed 1977. The gas tank and pumps were recently
replaced, in the same position as the old tank and pumps, in order to comply with State
regulations and to provide better convenience to the public.
ANALYSIS: This is a minor variance request to allow the construction of an overhead canopy
within the front yard setback. There is normally a 25 ft. setback from the edge of the road right-
of-way (or 55 ft. from the centerline of Skyway). The canopy will be located 16 ft. from the edge
of the road right-of-way, which will place it 9 ft. into the front yard setback. The canopy structure
will provide weather protection for the gasoline pumps, providing limited shelter for customers.
The lowest portion of the canopy is proposed to be 12' 6" above the ground and will not interfere

with sight distance. However, the Building Department will require that the lowest portion of the
' canopy be at least 13' 6" above the ground.
The canopy will be 180 sq. ft. (30' long by 6' wide) and will have a rustic appearance. The top
of the canopy will be an "A" frame which will be covered with wood-like tiles. The canopy will
enhance the visual appearance of the project site. A light fixture will be placed under the canopy
to provide illumination for people using the pumps at night. A condition of this project will require
that the canopy be similar to the plans submitted with the application.
A building permit for the canopy must be obtained from the Butte County Building Department
prior to construction. The Building Department has stated that the canopy must comply with the
1994 edition of the Uniform Building Code (UBC). The UBC requires that the canopy be able
to withstand a fire, either through the use of non-combustible, fire retardant treated wood, one
hour fire resistive construction, or heavy timber construction. In addition, the UBC requires that
the canopy be at least 13' 6" at the lowest projecting element of the canopy. The gas pumps will
also be required to comply with the disabled access requirements of Title 24, California Code
of Regulations in order to allowed disabled persons access to the pumps. In addition, the
grocery store may also be required to comply with Title 24 as part of the issuance of a building
permit for the canopy. No adverse comments were received from other County Departments
or local agencies.
Section 65906 of the State Planning and Development Law and Section 24-50 of the Butte
County Code states that a variance may only be granted when, because of special
circumstances applicable to the property, including size, shape, topography, location or
surroundings, the strict application of the zoning ordinance deprives the property of privileges
enjoyed by other property in the vicinity and under identical zoning classification. Section 24-
52.E of the Butte County Code allows the Director of Development Services to grant a minor
variance, at a maximum reduction of twenty percent (20%) of the prescribed requirements of
Section 24 of the Butte County Code with respect to front, rear, or side yard setbacks. The
canopy structure will be placed 16% into the 55 ft. front yard setback. The gas pumps have
been in the same location on the project site for the last 19 years, and to move them in order to
provide a canopy would be very expensive and impracticable. The overhead canopy will protect
customers from the elements and will be an aesthetically pleasing structure.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under
the California Environmental QualityAct CEQA and as such is subject to the requirements of

CEQA. The project has been determined to be categorically exempt from environmental review
under a class 5 exemption.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Notices of the hearing will be mailed to the nearest 10 property owners.
RECOMMENDATION: Staff recommends that the Director of Development Services approve
this variance application for Richard Hill File # WAR 97-01, and recommend approval to the

following findings and conditions contained in Exhibit A.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Robert Hill is hereby granted a Minor Variance in accordance with
application filed December 3, 1996, to allow an overhead canopy within the front yard setback
on .74 acres located on the east side of Skyway, approximately 340 ft. north of Steiffer Rd., at
14972 Skyway, Magalia, in an area zoned C-C (Community Commercial).
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-62.
2. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee, Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
3. A Minor Variance shall lapse and shall become void one year following the date on which
the Minor Variance became effective, unless prior to the expiration of one year, a building
permit is issued and construction is commenced and diligently pursued toward completion
on the site which was the subject of the Minor Variance application.
4. The terms and conditions of this minor variance shall run with the land and shall be
binding upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.

Section 1: Environmental Findings,
A. Upon careful and deliberate review of.the project and the project site environs, the
proposed overhead canopy will have no significant environmental effects and has
been determined to meet the criteria for a categorical exemption under Section
15303 of the California Environmental Quality Act guidelines; and
Section 2: Zoning Ordinance Findings.
A. There are special circumstances applicable to the property (size, shape,
topography, location or surroundings) or the intended use of the property, and
because of this, the strict application of zoning standards Code deprives the
property of privileges enjoyed by other properties in the vicinity under identical
zoning classification; and ,
B. The Minor Variance or its modification is necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same
vicinity and zone and denied to the property for which the Minor Variance is
sought; and
C. This Minor Variance or its modification will not be materially detrimental to the
public health, safety or welfare, or injurious to the property or improvements in
such vicinity and zone in which the property is located; and
D. This Minor Variance will not constitute a special privilege inconsistent with the
limitations upon other properties in the vicinity and zone in which such property is
situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning
regulation governing the parcel of property.
F. This Minor Variance or its modification will not be incompatible with the Butte
County General Plan.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to
approve the Variance for Richard Hill on APN 065-140-054 to allow a canopy
within the front yard setback. Approval shall be subject to the following conditions:

1. A building permit for the canopy shall be obtained from the Butte County
Building Department.

2. The canopy shall substantially conform to the plans submitted with the
application.
3. Applicant must also comply with all other applicable State and local
statutes, ordinances and regulations.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Robert Hill is hereby granted a Minor Variance in accordance with
application filed December 3, 1996, to allow an overhead canopy within the front yard setback
on .74 acres located on the east side of Skyway, approximately 340 ft. north of Steiffer Rd., at
14972 Skyway, Magalia, in an area zoned C-C (Community Commercial).
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Variance, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-62.
2. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee, Prior to such approval, verification
shall be made by each Department or Division that the modification,is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
3. A Minor Variance shall lapse and shall become void one year following the date on which
the Minor Variance became effective, unless prior to the expiration of one year, a building
permit is issued and construction is commenced and diligently pursued toward completion
on the site which was the subject of the Minor Variance application.
4. The terms and conditions of this minor variance shall run with the land and shall be
binding upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
FINDINGS:
Section 1: Environmental Findings.
A. Upon careful and deliberate review of the project and the project site environs, the
proposed overhead canopy will have no significant environmental effects and has
been determined to meet the criteria for a categorical exemption under Section
15303 of the California Environmental Quality Act guidelines; and
Section 2: Zoning Ordinance Findings.
A. There are special circumstances applicable to 'the property (size, shape,
topography, location or surroundings) or the intended use of the property, and
because of this, the strict application of zoning standards Code deprives the
property of privileges enjoyed by other properties in the vicinity under identical
zoning classification; and
B. The Minor Variance or its modification is necessary for the preservation and
enjoyment of a substantial property right possessed by other property in the same
vicinity and zone and denied to the property for which the Minor Variance is
sought; .and
C. This Minor Variance or its modification will not be materially detrimental to the
public health, safety or welfare, or injurious-to the property or improvements in
such vicinity and zone in which the property is located; and )
D. This Minor Variance will not constitute a special privilege inconsistent with the
limitations upon other.properties in the vicinity and zone in which such property is
situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning
regulation governing the parcel of property.
F. This Minor Variance or its modification will not be incompatible with the Butte
County General Plan.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to
approve the Variance for Richard Hill on APN 065-140-054 to allow a canopy
within the front yard setback. Approval shall be subject to the following conditions:
B. Conditions of Approval:
1. A building permit for the canopy shall be obtained from the Butte County
Building Department.
2. The canopy shall substantially conform to the plans submitted with the
application.
3. Applicant must also comply with all other applicable State and local
statutes, ordinances and regulations.
NOTE: Issuance of this Minor Variance does not waive requirement of obtaining Building
Division and Environmental Health Division permits, before starting construction, nor does it
waive any other requirements.

Dear Mr. Hill:
At the regular meeting of the Butte County Planning Commission held March 13, 1997,
your request for a Minor Variance for an overhead canopy within the 25 foot front yard
setback on property zoned C-C, Magalia, was approved subject to the conditions listed on
the Agenda Report.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive,
Oroville, California, prior to 5:00 p.m., Monday, March 24, 1997. The appeal deposit of
$250.00 must be paid at that time. If you do not appeal and if there are no other appeal
within the 10 calendar-day appeal period, the action of the Planning Commission is final.
Your Variance will be issued at the end of the 10-day appeal period.
A Notice of Exemption (NOE) should be filed for purpose of completing the California
environmental quality Act requirements. The fee for filing the NOE is a $25.00 document
handling fee. A check made payable to the Butte County Treasurer in the amount of
$25.00 should be submitted to the Planning Division in order to complete the process.

NOTICE OF PROPOSED MINOR VARIANCE APPROVAL
Notice is hereby given that the Butte County Director of Development Services is proposing
to recommend approval of a Minor Variance for an overhead canopy within the 25 foot
front yard setback on a 74 acre.parcel zoned C-C (Community Commercial) located on the
east side of Skyway, approximately 340 feet north of Steiffer Road, identified as AP 065-
140-054, at 14972 Skyway, Magalia. The Variance will recommended for approval subject
to the following conditions:
1. A building permit for the canopy shall be obtained from the Butte County Building
Department.
2. The canopy shall substantially conform to the plans submitted with the application.
3. Applicant must also comply with all other applicable State and local statutes,
ordinances, and regulations.
Persons wishing to'comment on the project may submit written comments to the Butte
County Planning Division any time prior to February 17, 1997. The Development Services
Director shall consider all comments in determining if the application meets all of the above
conditions and criteria. Upon finding that the proposed use does or will meet all of the
conditions and criteria, the Director of Development Services will hold a hearing on
February 20, 1997, at 9:00 a.m., at 7 County Center Drive, Oroville. Any interested
person may attend this hearing. The decision of the Director of Development Services will
be submitted, to the Planning Commission for final approval. If recommended for approval,
this item will be on the Planning Commission Consent Agenda at the next available
meeting.
