Ronald Hague-a minor variance request to allow the expansion of a house located within the 20 foot
front yard setback on property zoned Unclassified on the north side of Forbestown Road,
approximately 1,400 feet west of Bamford Way, at 5899 Forbestown Road, Forbestown, identified
as AP 073-190-012. (SB) (MVAR 98-01)
It was moved by Commissioner Leland, seconded by Commissioner Mooney, and carried unanimously for
approval of the Consent Agenda.
EXHIBTI' A
Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set
forth below:Ronald Hague is hereby granted a Minor Variance in accordance with application filed February
23, 1998, to allow the expansion of a house that is located within the 20 foot front yard setback.
1. Failure to comply with the conditions specified herein as the basis for approval of application and
issuance of Permit, constitutes cause for the revocation of said permit in accordance with the
procedures set forth in the Butte County Zoning Ordinance,including Butte County Code Sec. 24-52.
2. A Minor Variance shall lapse and shall become void one year following the date on which the Minor
Variance became effective, unless prior to the expiration of one year, a building permit is issued and
construction is commenced and diligently pursued toward completion on the site which was the
subject of the Minor Variance application.
3. The terms and conditions of this minor variance shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
4. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee, Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or significant
in nature shall require a formal application for amendment.
FINDINGS:
Section 1: Environmental Findings.
A. Upon careful and deliberate review of the project and the project site environs, the proposed
overhead canopy will have no significant environmental effects and has been determined to
meet the criteria for a categorical exemption under Section 15303 of the California
Environmental Quality Act guidelines; and
Section 2: Zoning Ordinance Findings.
A. There are special circumstances applicable to the property(size, shape,topography, location
or surroundings)or the intended use of the property,and because of this,the strict application

of zoning standards Code deprives the property of privileges enjoyed by other properties in
the vicinity under identical zoning classification. These special circumstances are:
1. The location of the OWID water ditch limits the amount of expansion that can occur
on the rear of the house; and
B. The Minor Variance or its modification is necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone and
denied to the property for which the Minor Variance is sought; and
C. This Minor Variance or its modification will not be materially detrimental to the public
health, safety or welfare, or injurious to the property or improvements in such vicinity and
zone in which the property is located because:
1. The expansion of the house will not increase the distance that the house projects into
the front yard setback; and
2. The expansion will not interfere with vehicle safety or sight distance; and
D. This Minor Variance will not constitute a special privilege inconsistent with the limitations
upon other properties in the vicinity and zone in which such property is situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning
regulation governing the parcel of property.
F. This Minor.Variance or its modification will not be incompatible with the Butte.County
General Plan.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the
Variance for Ronald Hague on APN 073-190-012 to allow an expansion of a house that is
located within the 20 foot front yard setback. Approval shall be subject to the following
conditions:
B. Conditions of Approval:
1. A building permit for the expansion shall be obtained from the Butte County
Building Department.
2. The expansion of the dwelling unit shall substantially conform to the plans submitted
with the application.
3. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.

Mr. Sanders said the request meets the requirements of the Code and a recommendation of approval
will be forwarded to the Planning Commission hearing of April 23, 1998.

Environmental Setting:
32 & 33. The project site is located in Forbestown, CA at approximately 2800 feet
elevation. The parcel is fairly level and timbered. The soils are deep and fairly non erosive
here. The Forbestown ditch forms the northern boundary of the project site and the
Forbestown Road forms the southern boundary. The project site has 2 existing houses
one of which is my residence. It also has.an existing well house and an existing garage.
There are residences similar to mine up and down Forbestown Road. There is
approximately 400 feet between my residence and my nearest neighbors house. I am not
aware of any plants, animals, cultural or historical sites that would be adversely affected by
this project. I do not think this project will adversely affect the scenic aspect of the
neighborhood, but improve and enhance it.

Attachment to Submittal Requirements -Variance
1. My oxiating roaidonoo happono to bo with in tho $0 foot ootbaok ofForbowtown Road
(approximately 40 feet from the centerline). My wish is to add approximately 1236 ft2
on to my existing residence. I would like to do this insinde of the 50 foot setback,but
no closer to the Forbestown Road than my existing residence is now. I do not feel this
is an exceptional or extraordinary circumstance to my parcel as there are many others .
along Forbestown road that have residences within this 50 foot setback. Itis
impractical to add on to my existing residence in any other direction because I am too
close to the Forbestown Ditch. After talking to Oroville Wyandotte Irrigation District,
they said I needed to stay ten feet away from the edge of the ditch. Staying ten feet
away from the ditch makes in impractical to add on to my existing residence in this
direction.
2. The granting of the Variance is necessary for the preservation and enjoyment of
substantial property rights is supported by many reasons. I feel that my exisiting
residence was permitted by the county at the time it was built. I am not proposing to
build any closer to the centerline of Forbestown Road. I really do not have any other
options but to add on to the house in the directions I am proposing.
3. This project will not adversely affect the neighborhood or be detrimental to the public
health and safety, or welfare, or adversely affect property improvements in the
neighborhood for many reasons. The approved proposed septic system will greatly
improve the existing septic system. The proposed addition to the existing residence
will improve the existing residence and only enhance the neighborhood. The proposed
addition to the existing residence will not be any closer to Forbestown Road than the
existing residence is now, so there should not be any public safety hazard.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set
forth below: Ronald Hague is hereby granted a Minor Variance in accordance with application filed
February 23, 1998, to allow the expansion of a house that is located within the 20 foot front yard setback.
1. Failure to comply with the conditions specified herein as the basis for approval of application and
issuance of Permit, constitutes cause for the revocation of said permit in accordance with the
procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-
52.
2. A Minor Variance shall lapse and shall become. void one year following the date on which the
Minor Variance became effective, unless prior to the expiration of one year, a building permit is
issued and construction is commenced and diligently pursued toward completion on the site which
was the subject of the Minor Variance application.
3. The terms and conditions of this minor variance shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
4. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee, Prior to such approval, verification shall be made by each
Department or Division that the modification is consiste!,t with the.application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.
FINDINGS:
Section 1: Environmental Findings.
A. Upon careful and deliberate review of the project and the project site environs,the proposed
overhead canopy will have no significant environmental effects and has been determined

to meet the criteria for a categorical exemption under Section 15303 of the California
Environmental Quality Act guidelines; and
Section 2: Zoning Ordinance Findings.
A. There' are special circumstances applicable to the property (size, shape, topography,
location or surroundings) or the intended use of the property, and because of this, the strict
application of zoning standards Code deprives the property of privileges enjoyed by other
properties in the vicinity under identical zoning classification. These special circumstances
are:
1. The location of the OWID water ditch limits the amount of expansion that can
occur on the rear of the house; and
B. The Minor Variance or its modification is necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone and
denied to the property for which the Minor Variance is sought; and
C. This Minor Variance or its modification will not be materially detrimental to the public
health, safety or welfare, or injurious to the property or improvements in such vicinity and
zone in which the property is located because:
1. The expansion of the house will not increase the distance that the house projects
into the front yard setback; and
2. The expansion will not interfere with vehicle safety or sight distance; and
D. This Minor Variance will not constitute a special privilege inconsistent with the limitations
upon other properties in.the vicinity and zone in which such property is situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning
regulation governing the parcel of property.
F. This Minor Variance or its modification will not be incompatible with the Butte-County
General Plan.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the
Variance for Ronald Hague on APN 073-190-012 to allow an expansion of a house that
is located within the 20 foot front yard setback. Approval shall be subject to the following
conditions:

B. Conditions of Approval:
1. A building permit for the expansion shall be obtained from the Butte County
Building Department.
2. The expansion of the dwelling unit shall substantially conform to the plans
submitted with the application.
3. Applicant.must also comply with.all other applicable State and local statutes, .
ordinances and regulations.
I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in
fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully
by said conditions.

Dear Mr. Hague:
At the regular meeting of the Butte County Planning Commission held April 23, 1998, your request
for a Minor Variance to allow the expansion of a house that is located within the 20 foot front yard
setback, was approved subject to the conditions listed on the enclosures. Please sign both copies
and return both copies to this Division within 40 calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must
do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California,prior to 5:00 p.m., Monday, May 4, 1998. The appeal fee of$50.00 must be paid at that
time. If you do not appeal and if there are no other appeal within the 10 calendar-day appeal period,
the action of the Planning Commission is final.
A Notice of Exemption (NOE) should be filed for purpose of completing the California
environmental quality Act requirements. The fee for filing the NOE is a$25.00 document handling
fee. A check made payable to the Butte County Treasurer in the amount of$25.00 should be
submitted to the Planning Division in order to complete the process.
Please be aware that failure to return the signed copies within 40 calendar days will invalidate the
Planning Commission's approval. Re-application to this Division would then be necessary.
The Use Permit is deemed granted when the enclosures have been signed by the applicant, with the
counter signature of the Chairman of the Planning Commission, and said permit is received by the
applicant by-registered mail.
Pursuant to Section 66020 (d) (2)of the Government Code you are hereby notified that you have 90
days to register a protest challenging any fees, dedications, reservations, or exactions imposed as
conditions of approval for this project.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set
forth below: Ronald Hague is hereby granted a Minor Variance in accordance with application filed
February 23, 1998, to allow the expansion of a house that is located within the 20 foot front yard setback.
1. Failure to comply with the conditions specified herein as the basis for approval of application and
issuance of Permit, constitutes cause for the revocation of said permit in accordance with the
procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-
52.
2. A Minor Variance shall lapse and shall become void one year following the date on which the
Minor Variance became effective, unless prior to the expiration of one year, a building permit is
issued and construction is commenced and diligently pursued toward completion on the site which
was the subject of the Minor Variance application.
3. The terms and conditions of this minor variance shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
4. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee, Prior to such approval, verification shall be made by each
Department or Division that the modification is consistent with the application, fees paid and
environmental determination-as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.

A. Upon careful and deliberate review of the project and the project site environs,the proposed
overhead canopy will have no significant environmental effects and has been determined

to meet the criteria for a categorical 'exemption under Section 15303 of the California
Environmental Quality Act guidelines; and
Section 2: Zoning Ordinance Findings. .,
A. There are special circumstances applicable to the property (size, shape, topography,
location or surroundings)or the intended use of the property, and because of this, the strict
application of zoning standards Code deprives the property of privileges enjoyed by other
properties in the vicinity under identical.zoning classification. These special circumstances
are:
1. The location of the OWID water ditch limits the amount of expansion that can
occur on the rear of;the house; and
B. The Minor Variance or its modification is necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone and
denied to the property for which the Minor Variance is sought; and
C. This Minor Variance or its modification will not be materially detrimental to the public
health, safety or welfare, or injurious to the property or improvements in such vicinity and
zone in which the property is located because:
1. The expansion of the house will not increase the distance that the house projects
into the front yard setback; and
2. The expansion will not interfere with vehicle safety.or sight distance; and
D. This Minor Variance will not constitute a special privilege inconsistent with the limitations
upon other properties in the vicinity and zone in which such property is situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning
-regulation governing the parcel of property.
F. This Minor Variance or its modification will not be incompatible with the Butte County
General Plan.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the
Variance for Ronald Hague on APN 073-190-012 to allow an expansion of a house that

APN 073-190-012 A minor variance request to allow the expansion of a house
that is located within the 20 foot front yard setback. The property is zoned U
(Unclassified) is designated by the Land Use Element Map of the Butte County
General Plan as Low Density Residential. The property is located on the north side
of Forbestown Road, approximately 1,400 feet west of Bamford Way, at 5899
Forbestown Road, Forbestown. The project is located in Supervisorial District 1.

SUMMARY: Staff recommends approval of this application.
APPLICABLE BUTTE COUNTY REGULATIONS: This variance application is submitted pursuant
to Butte County Code Sections:
24-52 Minor Variance, which provides procedures for the preparation, filing, and processing by the
Planning Division, and the approval or disapproval of a discretionary permit that authorizes specific minor
variances of up to 20% of the zoning standards on specific sites.
PROJECT CHARACTERISTICS: This is a minor variance request to allow the expansion of an existing
dwelling that is located within a required setback. The property has been developed with two dwelling
units, a garage, and an OWID water ditch C'Forbestown Ditch"). The primary dwelling unit is located
approximately ten feet into the 20 foot front yard setback. The applicant proposes to add on to the house
on the sides and rear. No additions will be added onto the front of the house, so the house will not extend
further into the front yard setback,but will extend further into the setback on both sides of the house. The
house cannot be substantially expanded in the rear because of the OWID-owned water ditch which is
located approximately 15 feet behind the house. OWID will not allow any structures within ten feet of their
water ditch.
ANALYSIS: This is a minor variance request to allow the expansion of an existing dwelling that is located
within the front yard setback. The expansion will not increase the distance the house already extends into
the front yard setback,but will increase the length of the house in the setback. Minor expansion will occur
in the rear, however,that expansion is very limited due to the location of the OWID ditch and a septic tank

which prevents much expansion in that direction. The proposed expansion will not interfere with any
vehicle traffic or sight distance, nor will it create an aesthetic impact.
Section 65906 of the State Planning and Development Law and Section 24-52 of the Butte County Code
states that a Minor Variance may only be granted when, because of special circumstances applicable to the
property, including size, shape, topography, location or surroundings, the strict application of the zoning
ordinance deprives the property of privileges enjoyed by other property in the vicinity and under identical
zoning classification. Section 24-52.E of the Butte County Code allows the Director of Development
Services to grant a minor variance, at a maximum reduction of twenty percent (20%) of the prescribed
requirements of Section 24 of the Butte County Code with respect to front, rear, or side yard setbacks.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the
California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. The
project has been determined to be categorically exempt from environmental review under a Class 5
exemption.
RECOMMENDATION: Staff recommends that'the Director of Development Services approve this
variance application for Ronald Hague, File # WAR 98-01, and recommend approval to the Planning
Commission to allow an expansion of a dwelling unit that is located in the front yard setback, subject to the
following findings and conditions contained in Exhibit A.

NOTICE OF PROPOSED MINOR VARIANCE APPROVAL
Notice is hereby given that the Butte County Director of Development Services is proposing to grant a Minor
Variance Permit to allow the expansion of a residence within 40' of the centerline of Forbestown Road, for
Ronald Hague,on property zoned U-Unclassified, identified as AP 073-190-012, located on the north side
of Forbestown Road approximately 1,400'west of Bamford Way, at 5899 Forbestown Road. The permit is
proposed to be granted subject to the following findings and conditions:
Findings:
A. There are special circumstances applicable to the property(size,shape,topography, location
or surroundings)or the intended use of the property,and because of this,the strict application
of zoning standards Code deprives the property of privileges enjoyed by other properties in the
vicinity under identical zoning classification; and
B. The Minor Variance or its modification is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone and
denied to the property for which the Minor Variance is sought; and
C. This Minor Variance or its modification will not be materially detrimental to the public health,
safety or welfare, or injurious to the property or improvements in such vicinity and zone in
which the property is located; and
D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon
other properties in the vicinity and zone in which such property is situated; and
E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation
governing the parcel of property.
F. This Minor Variance or its modification will not be incompatible with the Butte County General
Plan.
Conditions:
1. A building permit for the expansion shall be obtained from the Butte County Building,
Department.
2. The expansion of the dwelling unit shall substantially conform to the plans submitted with the
application.
3. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.

NOTE: "Minor changes may be approved administratively by the Director of Development Services upon
receipt of a substantiated written request by the applicant. Prior to such approval,verification shall be made
by each Department or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be major or significant in nature
shall require a formal application for an amendment."
Persons wishing to comment on the project may submit written comments to the Butte County Planning Division
any time prior to April 22, 1998. The Director of Development Services shall consider all comments in
determining if the application meets all of the above conditions and criteria. Upon finding that the proposed use
does or will meet all of the conditions and criteria,the Director of Development Services will hold a hearing on
April 22, 1998 at 9:00 am in the Planning Division conference room,7 County Center Drive,Oroville.
Any interested person may attend this hearing. The decision of the Director of Development Services will be
submitted,to the Planning Commission,for final approval.
