It was moved by Commissioner Mooney, seconded by Commissioner Leland, and unanimously carried to approve the consent agenda per the findings and conditions in the individual agenda reports. I - I A ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ NOVEMBER 12, 1998 ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT - NOVEMBER 12, 1998 Applicant: Dennis Hutcheson Location: On the north side of Meadowview Drive, at 24 File#: MVAR 99-01 Meadowview Drive, approximately 250 feet west of Request: Minor Variance for a porch to Northview Drive, Oroville encroach 4 feet into the front yard setback Parcel Size: .21 acres G.P.: Low Density Residential Zone date: 02-28-98 Zoning: R-1 (Residential) Supervisor District: 1 APN: 068-190-082 Regulations: Section 24-52(Minor Variances). SUMMARY: The proposed project meets the criteria of the zoning code and the Butte County Code for variances. Staff recommends approval. ANALYSIS: The parcel is located in Olive Glen Estates Subdivision which was created in 1963. The lots were developed by the State. These houses are of a rectangular nature with no covered patios or porches to protect them from the weather. The applicant proposes to cover the front porch with posts and an eave. The posts will be placed approximately 4 feet into the front yard setback with a 2 foot overhang. These parcels appear to have been affordable housing at one time to lower income groups. Practically all the dwellings were built within or at the 20 foot setback, most averaging 18.5 ft. from the road centerline. County records show there were 2 applications for variances in the past. One was approved by the Planning Commission and the other was denied. It was subsequently appealed to the Board of Supervisors, at which time it was approved. CEQA ISSUES: This application for a Minor Variance is Categorically Exempt from environmental review under Section 15305, Class 5(a). ENVIRONMENTAL DETERMINATION: This project is categorically exempt from environmental review pursuant to Section 15305 of the CEQA Guidelines. RECOMMENDATION: Staff recommends that the Planning Commission make the findings and take the action listed below to approve the Minor Variance, File MVAR 99-01, for Dennis Hutcheson for a porch to encroach 4 feet into the front yard setback, subject to the conditions in attached Exhibit A. ■ Butte County Department of Development Services 0 Page 1 0 • �. FINDINGS: Section 1: Environmental Findings. A. The project has been determined to meet the criteria for a categorical exemption under Section 15305 of the California Environmental Quality Act guidelines; and Section 2: Zoning Ordinance Findings. A. There are special circumstances applicable to the property due to its small size. The dwelling unit was built up to the front yard setback line because of the .21 acre substandard size of the parcel The strict application of zoning standards Code deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification. Homes on larger parcels were built with enough room to construct a porch or carport without the request for a variance; and B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. F. This Minor Variance will not be incompatible with the Butte County General Plan. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Minor Variance 99-01 for Dennis Hutcheson to allow for a porch to encroach into the front yard setback. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Dennis Hutcheson is hereby granted a Minor Variance in accordance with application filed , to allow a Minor Variance for a porch to encroach 4 feet into the front yard setback located on the north side of Meadowview Drive, at 24 Meadowview Drive, approximately 250 feet west of Northview Drive, Oroville. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit,constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance,including Butte County Code Sec. 24-62. 2. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 3. A Minor Variance shall lapse and shall become void one year following the date on which the Minor Variance became effective, unless prior to the expiration of one year, a building permit is issued and construction is commenced and diligently pursued toward completion on the site which was the subject of the Minor Variance application. 4. The terms and conditions of this minor variance shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: 1. Meet the requirements of the Butte County Building Division. 2.
