APN: 059-092-021 SUMMARY: The proposed project meets the findings as set forth for the Minor Variance. Staff recommends approval. PROJECT DESCRIPTION: 1. Newly constructed addition to an existing Single Family Dwelling with an existing detached garage located in a residential district. ANALYSIS: Stirling City is a small community developed during the gold rush era. Numerous substandard size lots were created. The applicant has added a porch and extended a portion of the house during remodeling of the dwelling. The applicant was notified by the building division at the time his building permits were obtained that the front yard setback for the parcel was 50' from the centerline of Skyway. However, the actual setback requirement for the Skyway is 55' and most of the older buildings are situated within the front yard setback already. Therefore,the applicant desires to resolve possible building code violations and obtain a variance consistent with the way other properties have been developed in the vicinity under identical zoning classification. CEQA ISSUES: This application for a Minor Variance is Categorically Exempt from environmental review under Section 15305,"Minor Alterations in Land Use Limitations". RECOMMENDATION: Staff recommends that the Planning Commission approve Minor Variance No. 99-02 for Charles Garner on APN 059-092-021. ■ Butte County Department of Development Services ■ Page 1 ■ FINDINGS: Section 1: Environmental Findings. A. Upon careful and deliberate review of the project and the project site environs, the existing structure will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15305 of the California Environmental Quality Act guidelines; and Section 2: Zoning Ordinance Findings. A. There are special circumstances applicable to the property (size, shape, topography, location or surroundings)or the intended use of the property, and because of this,the strict application of zoning standards Code deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification; and B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property'is situated; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. F. This Minor Variance will not be incompatible with the Butte County General Plan. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Minor Variance, File#MVAR 99-01 for Charles Garner on APN 059-092-021 to allow Minor Variance for an existing addition to a house that extends 22 inches into the 20 foot frontyard setback. Approval shall be subject to the conditions listed in Exhibit A. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Charles Garner is hereby granted a Minor Variance in accordance with application filed September 1, 1998, to allow Minor Variance for an existing addition to a house that extends 22 inches into the 20 foot frontyard setback located on the northwest corner of Skyway and Granite Street, at 17061 Skyway, Stirling City. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit,constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance,including Butte County Code Sec. 24-62. 2. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval,verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 3. A Minor Variance shall lapse and shall become void one year following the date on which the Minor Variance became effective, unless prior to the expiration of one year, a building permit is issued and construction is commenced and diligently pursued toward completion on the site which was the subject of the Minor Variance application. 4. The terms and conditions of this minor variance shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
