(LP) (MVAR 99-03) A video was shown for Garner, Hutcheson, and Seltzer, minor variances. Mr. Doody said staff is recommending approval for the minor variances and time extension. It was moved by Commissioner Mooney, seconded by Commissioner Leland, and unanimously carried to approve the consent agenda per the findings and conditions in the individual agenda reports. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■NOVEMBER 12, 1998 ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT - NOVEMBER 12, 1998 Applicant: Joel Seltzer Location: At 1171 Santana Ct., Chico File#: MVAR 99-03 Parcel Size: 7,760 sq. ft. Request: Minor Variance to accommodate a garage addition proposed to encroach 2' 8" Zone date: 01-20-76 into the front yard setback Supervisor District: 3 G.P.: Agricultural Residential Applicable Regulations: Butte County Zoning: S-R (Suburban Residential) Code: Section 24-135(Suburban Residential Zones), Section 24-52(Minor Variances). APN: 048-082-110, SUMMARY: The proposed project meets the findings as set forth for the Minor Variance. Staff recommends approval. ANALYSIS: Applicant wishes to expand his house and move the garage width wise to within 7 feet from the side yard property Yline to add living space and a storage area where the garage is now. To make the expansion, the applicant will be encroaching approximately 2 feet within the front yard setback due to the radius portion of the cul-de-sac adjoining the parcel. The shape of the parcel reflects the cul-de-sac and creates a hardship in accommodating the expansion. Public Works has no objections to this request. The City of Chico has no concerns either. The main concern for this request would have been from.the City of Chico, if there were any, because this parcel will be annexed to the City at some time in the near future. CEQA ISSUES:This application is Categorically Exempt from environmental review under Section 15305,"Minor Alterations in Land Use Limitations", Class 5(a)". RECOMMENDATION: Staff recommends that the Planning Commission accept the decision of the hearing officer and make the findings and take the action listed below to approve the Minor Variance, MVAR 99-03 for Joel Seltzer to allow the expansion of a garage to encroach approximately 2 feet into the front yard setback subject to the conditions listed on Exhibit A. FINDINGS: Section 1: Environmental Findings. ■ Butte County Department of Development Services 0 Page 1 0 A. The project qualities as a categorical exemption under Section 15305 of the California Environmental Quality Act guidelines; and Section 2: Zoning Ordinance Findings. A. There are special circumstances applicable to the property due to its shape, such that the strict application of zoning standards deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification. This is due to the setback from the edge'of the cul-de-sac where the expansion is proposed. B. The Minor Variance or its modification is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance or its modification will not be detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. F. This Minor Variance or its modification will not be incompatible with the Butte County General Plan. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, approve the Minor Variance 99-03 for Joel Seltzer on APN 048-082-110 to allow the proposed garage addition encroachment of 2' 8" into the front yard setback. MVAR 99-03 VARIANCE NO. 048-082-110 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Joel Seltzer is hereby granted a Minor Variance in accordance with application filed to allow Minor Variance to the front property line setback,proposed garage addition encroachment of 2' 8" into the front yard setback located at 1171 Santana Ct., Chico. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit,constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance,including Butte County Code Sec. 24-62. 2. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 3. A Minor Variance shall lapse and shall become void one year following the date on which the Minor Variance became effective, unless prior to the expiration of one year, a building permit is issued and construction is commenced and diligently pursued toward-completion on the site which was the subject of the Minor Variance application. 4. The terms and conditions of this minor variance shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: 1. Meet the requirements of the Butte County Building Division. 2.
