APN 005-395-010. (LP) (MVAR 99-05) This item was pulled from the consent agenda for discussion after Thomas Norlie. Andy Hobbs asked that the item be pulled. Continued from earlier in the meeting. Mr. Hobbs said he is a neighbor and that an older mobile home was proposed. He said if the applicant uses a mobile home he is required to place a 1976 or newer HUD approved mobile home on the property. He said the proposed mobile.seems large for the size of the lot. He said they are trying to get this area cleaned up. Commissioner Cage said she understands the home will be a modular. Mr. Hobbs said he was concerned with the size of the lot. He said this mobile will leave no yard space and noarkin . p g Commissioner Lambert commented that the previous house burnt down. Mr. Wilson said correct, the previous house was in the front yard setback. Mr. Hobbs said he had problems with the parking from the previous house. He said he would prefer to see a small, nice home instead of a large modular. He said this will affect his property values. Dennis Piacentine said this Minor Variance does not effect the parking area. He said the 6 foot variance goes towards Boucher.Street. He said he will do a nice project. He said this Minor Variance will allow a three bedroom, 2 bath house. Commissioner Lambert said the previous house was destroyed. She said there are other houses in the neighborhood that are into the setback. It was moved by Commissioner Cage, seconded by Commissioner Lambert, and unanimously carried to approve the Minor Variance for Dennis Piacentine as follows: I. Determine the project to be under Section 15305 (a) of the California Environmental Quality Act based upon the following finding: A. Upon careful and deliberate review of the project and the project site environs, the proposed 6 feet encroachment will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15305(a) which allows for minor Alterations in Land Use limitations including, "Minor lot line adjustments, side yard and set back variances not resulting in the creation of any new parcel"; and II. Zoning Ordinance Findings. ■ BUTTE COUNTY PLANNING COMMISSION MINUTES ■ AUGUST 11, 1999 ■ A. There are special circumstances applicable to the property(size, shape,topography, location or surroundings) or the intended use of the property, and because of this, the strict application of zoning standards Code deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification in that the building area of the parcel leaves"no room for a rear yard; and B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be materially detrimental to the public health,safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located as the Department of Public Works has stated no traffic hazard will result from granting this Minor Variance; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated for there are approximately twenty-one variance applications in this area of which only one was denied; and E. This Minor Variance will not allow a use or activity which'is prohibited by the zoning regulation governing the parcel of property. The use;is residential and the proposed use is residential. F. This Minor Variance will not be incompatible with the Butte County General Plan as the plan allows for a maximum density of 6 dwelling units per gross acre. III. Action. • A. Subject to the findings indicated in Sections I and II of this report, move to recommend approval to the Planning Commission of a Minor Variance for Dennis Piacentine on APN 005-395-010 to allow a six foot encroachment into the front yard setbacks and subject to the conditions found in Exhibit Conditions of Approval: 1. Obtain necessary permits through the Butte County Environmental Health Division for the abandonment of the existing septic system. 2. Connect to City water and sewer service. 3. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Dennis Piacentine is hereby granted a Minor Vwiarce in accordance with application filed , to allow Minor Variance to allow six foot encroachment into the front yard setback located at the northeast corner of Boucher and Colorado Streets, at 1323 Boucher Street, Chico . 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit,constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance,including Butte County Code Sec. 24-62. 2. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant,or their respective designee, Prior to such.approval,verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 3. A Minor Variance shall lapse.and shall become void one year following the date on which the Minor Variance became effective, unless prior to the expiration of one year, a building permit is issued and construction is commenced and diligently.pursued toward completion on the site which was the subject of the Minor Variance application. 4., The terms and conditions of this minor variance shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: 1. Obtain necessary permits through the Butte County Environmental Health Division for the abandonment of the existing septic system. 2. Connect to City water and sewer service. y 3. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. . NOTE: Issuance of this Minor Variance does not waive requirement of obtaining Building and Health Department permits before starting construction, nor does it waive any other requirements. Staff recommends approval. PROJECT DESCRIPTION: Proposal for a minor Variance on a corner lot to allow a structure to encroach 6 feet into the 50 foot from centerline setback from two public roads. Granting of this Minor Variance would allow the placement of a 44 foot X 24 foot (1,056 sq.ft.) modular home on a 66 foot X 73.69 foot (4,864 sq.ft.)corner lot. ANALYSIS: This parcel is located on a corner lot which is half the size of most lots in the area. The lot is 4,864 square feet in size. Allowing for all applicable setbacks provides a building space of 1,198.77 square feet. Limitations to the building area deny's the applicant the ability of enjoying a rear yard without placing a dwelling within the setbacks.'Such a small space for a home places an undo hardship on the parcel. 0 Butte County Department of Development Services 0 Page 1 0 Section 24-50 of the Butte County Code states that a variance can only be granted when, because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. Section 24-52.E of the Butte County Code allows the Director of Development Services to grant a minor variance, at a maximum reduction of twenty percent (20%) of the prescribed requirements of Section 24 of the Butte County Code with respect to front, rear, or side yard setbacks. This parcel had a house that was destroyed by fire approximately three years ago. The house was located within the front yard building setbacks. The placement of the new dwelling will be placed 8% into the front yard setback. Public Works Division foresees no traffic safety problem with this request. The applicant proposes to connect to city water and sewer which will enable him to utilize as much space as is available. CEQA ISSUES: This application for a Minor Variance is Categorically Exempt from environmental review under Section 15305(a) which allows for minor Alterations in Land Use limitations including, "Minor lot line adjustments, side yard and set back variances not resulting in the creation of any new parcel". ACTION FOR CONSIDERATION: Staff recommends that the Planning Manager take the following action: I. Determine the project to be under Section 15305 (a)of the California Environmental Quality Act based upon the following finding: A. Upon careful and deliberate review of the project and the project site environs, the proposed 6 feet encroachment will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15305(a) which allows for minor Alterations in Land Use limitations including, "Minor lot line adjustments, side yard and set back variances not resulting in the creation of any new parcel"; and II. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be materially detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located as the Department of Public Works has stated no traffic hazard will result from granting this Minor Variance; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated for there are approximately twenty-one variance applications in this area of which only one was denied; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The use is residential and the proposed use is residential. F. This Minor Variance will not be incompatible with the Butte County General Plan as the plan allows for a maximum density of 6 dwelling units per gross acre. III. Action. A. I am writing this letter to object to the`Butte County Development Services Planning Division Notice of Proposed Minor Variance Approval'for Dennis Placentine, scheduled for July 26, 1999 at 9:00am(see copy attached). As a resident and property owner of the address directly adjacent to the proposed property for over 6 years, I feel my rights will be violated if concessions are made to this individual who wishes to "drop"a used, single-wide mobile into an area that is currently one of the better locations in the chapman town area. The community has been actively trying to"clean up"the community by removing trash and old cramped structures. Rebuilding has been a lucrative business for many in this area,taking an old run down shack and turning it into a decent livable home for primarily low-income individuals. It is very well known and many plans have been proposed to fight the severe overcrowding caused by building on such small lots,this has been ongoing for many years. However, to date most of the spacing issues seem to be left up to the neighbors and contractors. This has proven successful in-many areas of the neighborhood, with the contractors that "care" about the results of their efforts. Mr. Piacentine is not one of those individuals, - however, and I do not feel the lot at 1323 Boucher St. would be an improvement to the community with a mobile home dropped into such a tiny space. I do not see how we can improve our community, allow our starter homes to appreciate in value, work hard and move up in the community, if we continue to allow approval of the exact type of problem that is plaguing this area. Allowing this"minor"variance to the encroachment would be a"major"disaster. All the homes in this area, with the exception of one mobile located a full block and another street away, are homes.not mobiles, occupied primarily by property owners. My grandfather has lived at and owned 769 Colorado St. for over 45 years. The gentleman directly east of my residence has lived at and owned his home for nearly 5 years. The house on the south east comer of the same block is leasing, with an option and intention to buy. We all have a stake in this part of the community and will fight to keep our area on the right track to reform. PLEASE DO NOT LOWER OUR PROPERTY VALUES BY APPROVING THIS "MMOR"VARIANCE. I am writing this letter to object to the`Butte County Development Services Planning Division Notice of Proposed Minor Variance Approval"for Dennis Placentine, scheduled for July 26, 1999 at 9:00am(see copy attached). As a resident and property owner of the address directly adjacent to the proposed property for over 6 years, I feel my rights will be violated if concessions are made to this individual who wishes to-"drop"a used, single-wide mobile into an area that is currently one of the better locations in the chapman town area. The community has been actively trying to"clean up"the community by removing trash and old cramped structures. Rebuilding has been a lucrative business for many in this area, taking an old run down shack and turning it into a decent livable home for primarily low-income individuals. It is very well known and many plans have been proposed to fight the severe overcrowding caused by building on such small lots,this has been ongoing for many years. However, to date most of the spacing issues seem to be left up to the neighbors and contractors. This has proven successful in many areas of the neighborhood,with the contractors that "care" about the results of their efforts. Mr. Piacentine is not one of those individuals, however, and'I do not feel the lot at 1323 Boucher St. would be an improvement to the community with a mobile home dropped into such a tiny space. I do not see how we can improve our community, allow our starter homes to appreciate in value, work hard and move up in the community, if we continue to allow approval of the exact type of problem that is plaguing this area. Allowing this"minor"variance to the encroachment would be a"major" disaster. All the homes in this area, with the exception of one mobile located a full block and another street away, are homes.not mobiles, occupied primarily by property owners. My grandfather has lived at and owned 769 Colorado St. for over 45 years. The gentleman directly east of my residence has lived at and owned his home for nearly 5 years. The house on the south east comer of the same block is leasing, with an option and intention to buy. We all have a stake in this part of the community and will fight to keep our area on the right track to reform. PLEASE DO NOT LOWER OUR PROPERTY VALUES BY APPROVING THIS "MINOR"VARIANCE.
