Re: Pre-development conference 02/15/2000
Dear Mr. Laffins,
This letter is a follow up to the pre-development conference held on February 15, 2000. In
attendance at the meeting were:
Dick Jones - representative for the project
Bob Greenlaw - Butte County Public Works
Craig Erickson -Butte County Environmental Health
Craig Sanders -Butte County Development Services
The main points of discussion that resulted from the meeting are as follows:
The property is subject to a Conditional Zoning Agreement. A copy of the agreement is
attached. The conditions in the agreement must be met in your development design.
Butte County Environmental Health strongly recommends that the project have a source of
community water and not individual wells. Hooking up to Butte Creek Country Club is one
option for providing water. You will also have to show that the proposed leachfield area is
not within the 10 year flood plain.
Both the Department of Public Works and the City of Chico commented that the intersection
of the proposed road and Estates Drive should be located as far as possible from Highway 99
and-be at a right angle to Estates Drive.
On-site detention of drainage will be required so that peak flows off the site will not be
increased. Your tentative map should show the location of the detention area.

The entire '
� este is s within a 100 year flood plain. Development will have to comply with Butte
County ordinances for development in flood plains. Building pads must be constructed so
that the lowest floor elevation is at least 1 foot above the flood plain. Your tentative map
should show the what the lowest floor elevation.is for each lot.
P.G.&E requests that the 50 foot right-of-way be dedicated to include utilities. In addition,
10 foot strip along all lot lines fronting the road should be similarly dedicated.
It appears that the existing 60 foot easement coming off of Estates Drive has been abandoned
by a document recorded in Book 2377 at Page 491.
If the sound wall is to be 11 feet high, the homes on these parcels should be restricted to
single story dwellings to maintain sound protection.
These comments are intended to help you design your map so that it will conform the various
department and agency requirements when you make formal application: If you have any questions
or need clarification on any points, please call me.

AGREEMENT
THIS AGREEMENT made this T1, day ofJuly , 1990, by and between "First Party",
as identified in item (a) of Exhibit 1 of this Agreement, and the COUNTY OF BUTTE, a.political
subdivision of the State of California, herein called "Second Party".
WITNESSETH
WHEREAS, First Party is the owner of real property, herein called the "Property",
situated in the County of Butte, which Property is described in Item (f) of Exhibit I of this
Agreement; and
WHEREAS, the Property is now zoned as specified in Item (b) of Exhibit 1; and
WHEREAS, First Party has applied for a reclassification of zoning of the Property
pursuant to which application the Property is being reclassified from its present classification to the
classification or classifications specified in Item (c) of Exhibit 1; and
WHEREAS, public hearings have been held upon said application before the Board
of Supervisors of the County of Butte, State of California, and after having considered the matter
presented, it has been determined that certain conditions to the zoning reclassification of said real
property must be imposed so as not to create any problems inimical to the health, safety and the
general welfare of the County of Butte.
NOW, THEREFORE, IT IS MUTUALLY UNDERSTOOD AND AGREED that
inasmuch as the reclassification specified in Item (c) of Exhibit 1 is being granted, the said
reclassification shall be subject to the conditions specified in the following paragraphs:
1. That Exhibit 1, as completed and attached hereto,is incorporated into and made
a part of this Agreement with the same force and effect as if fully set forth herein.
2. That First Party shall construct and comply with all the following conditions:
2a. At the time of a submittal for a tentative map or development proposal, the
applicant shall provide a map that identifies all existing trees and riparian vegetation in relation to
roads and building pad locations. All native vegetation that is not impacted by roads or structures
shall be preserved.
2b. Development of the site shall comply with the sewerage disposal requirements of
the County Environmental Health Department. Grading of the topsoil shall be minimized,
especially at the north end of the project to enhance the sewage disposal capabilities.
2c. Any proposed roads that cross the Durham Mutual Ditch shall be approved by
the Department of Fish and Game.
2d. A sound attenuation wall of at least 6 feet in height and a landscape visual buffer
of fast-growing trees and shrubs (such as Oleander, Hopbrush, Aleppo Pine, or Poplars) shall be
provided along State Highway 99 frontage. The barrier is to be designed such that noise will be

reduced to 65 dB or less at the property lines of parcels fronting on Highway 99.
2e. Obtain.a written approval from Caltrans relative to Estates Drive access and
provide an easement for a future frontage road that complies with Caltrans requirements for width
and location.
2f. A permanent solution for drainage, including the protection of downstream
properties from any flooding. This shall be provided at the time of tentative map or development
submittal.
2g. Incorporate "pollution traps" into the storm drain design near the point of
discharge to minimize impacts during low flows.
2h. Comply with energy conservation measures as set forth in the Uniform Building
Code and Section 66473.1 of the Subdivision Map Act.
3. In the event First Party, any successor in interest of First Party, or any person
in possession of the property described in Item (f) of Exhibit I violates or fails to perform any of
the conditions of this Agreement within thirty (30) days after notice thereof as provided in
Paragraph 5, the Board of Supervisors of Second Party may instruct the County Counsel of Second
Party to institute legal proceedings to enforce the provisions of this Agreement. The Board of
Supervisors of Second Party may also initiate proceedings to rezcne the property to the classification
specified in Item (b) of Exhibit I or any other suitable classification.
4. Notice of violation of provisions of this Agreement shall be sent to First Party
at the address specific in Item (d) of Exhibit 1 and to the street address of the property described
in Item (d) of Exhibit 1. Any subsequent title holder, any lien holder, or party in possession of the
property shall also receive notice of such violation at an address,other than as specified in Item (d)
of Exhibit 1 by filing with the Clerk of the Board of Supervisors of Second Party the address to
which the notice is to be sent, with reference to this Agreement and the Resolution authorizing its
execution.
5. In the event suit is brought by the County Counsel of Second Party to enforce
any of the provisions of this Agreement, First Party agrees to pap to Second Party a reasonable sum
to be fixed by the Court as attorney's fees.
6. Each and every one of the provisions of this agreement herein contained shall
ind'and insure to the benefit of the successor in interest of each and every party hereto, in the same
manner as if they had herein been expressly named.

The Butte County Development Service Department has received a request for a pre-development
conference regarding a proposed Pre-Development Conference to review flexible lot design, creating
1.4 lots. The parcel is located on the south west side of Highway 99 on both sides of Estates Drive.
The purpose of the meeting is to inform the applicant of local or state requirements that may apply to
their project. This allows the applicant to incorporate those requirements into the design of the project
when the actual application is made.
The pre-development conference will be held in the Development Services Department conference
room located at 7 County Center Drive, Oroville on February 15, 2000, at 9:00 a.m. If your

We have reviewed the plans regarding the subject project. PG&E has both gas and electric
facilities in the area and is capable of serving this project.
PG&E requests that the 50 foot roadway easement be dedicated to include utilities, in addition
to a 10 foot wide P.U.E. dedication along all lot lines fronting streets or roads.

4. Notice of violation of previsions of this Agreement shall be sent to First Party
I the address specific in Item �d) of Exhibit I and to the street address of the property described
Item (d) of Exhibit 1. Any subsequent title holder, any.lien holder,or party in possession of the
roperty shall also receive notice of such violation at an address other than as specified in Item (d)
-�f Exhibit I by filing with the Clerk of the Board of Supervisors of Second Party the address to
Ahich the notice is to be sent, with reference to this Agreement and the Resolution authorizing its

5. In the event suit is brought by the County Counsel of Second Party to enforce

Re: Butte Creek Estatec-Laffins Condominium Project
Ladies & Gentlemen:
Please be advised that a certificate of occupancy should not
be granted to the Laffins Condominium Project, Lot 23 of Butte
Creek Estates, for more than one dwelling unit because water
service can only be provided to one unit pursua! t to corporation
securities laws until additional shares in Butte Creek Estates
Service Corporation are qualified with the Department of
Corporations.
Although Butte Creek Estates Service Corporation issued a
"Will Serve" letter in the past on this project, the parties knew
that additional shares entitling the property owner to water
service would need to be qualified with the Department of
Corporations. At the present time, only one share is qualified for
Lot 23, which entitles water service to only one unit owner.
Occupancy should not be granted the other three units until three
additional shares are qualified to entitle those properties to
water service.

1. At the time of a submittal for a tentative map or development proposal, the
applicant shall Provide a map that identifies all existing trees and riparian vegetation
in relation to roads and building pad locations. All native vege. tion that is not
impacted by roads or structures shall be preserved.
2. Development of the site shall comply with the sewerage disposal requirements of
the County Environmental Health Department. Grading of the topsoil shall be
minimized. especially at the north end of the project to enhance the sewage disposal
capabilities.
3. Any proposed roads that cross the Durham Mutual Ditch shall be approved by the
Department of Fish and Game.
4. A sound attenuation wall of at least 6 feet in height and a landscape visual buffer
of fast-growing trees and shrubs (such as Oleander, Hopbrush, Aleppo Pine, or
Poplars) shall be provided along State Highway 99 frontage. The barrier is to be
designed such that noise will be reduced to 65 d13 or less at the property lines of
parcels fronting on Highway 99.
5. Obtain a written approval from Caltrans relative to Estates Drive access and provide
an easement for a future frontage road that complies with Caltrans requirements for
width and location.
6. Provide for a permanent solution for drainage, including the protection of
downstream properties from any flooding. This shall be provided at the time of
tentative map or development submittal.
7. Incorporate "pollution traps"into the storm drain design near the point of discharge
to minimize impacts during low flows.
8. Comply with energy conservation measures as set forth in the Uniform Building
Code and Section 66473.1 of the Subdivision Map Act.

1. Recommend smaller lots clustered on the southeasterly portion of the site.
2. Recommend access be further away from intersection of SHR 99 and Estates
Way. As proposed, it intersects too close to SWR 99. Should be at right angles
to Estates Way.

members.of your.staff regarding..possible.options for the subject land_presently
encumbefed:witb.an:app'royed"tentative subdivision map. Staff members present were Mr.
Stuart.Edell and Mr:Craig,Sanders.
The Laffins' have asked me.to contact you regarding the results of that'3meeting and to
reaffirm their understanding of those results.
According to my notes, the following items were discussed`
a) If the tentative map approval is abandoned, the original boundary lines can be
adjusted through the merger process. Conditions of approval relating to the subdivision
will not be in force.
b) Newly design parcels north of Estates Drive.can be served by a private (60
foot) roadway easement.
c). The highway 99 frontage road would not be required for development of
parcels north of Estates Drive.
d) The highway 99.frontage road would not be required for development of the
single parcel south of Estates Drive,.but an access easement will be reserved. .
e) A fire protection system (well, hydrants, etc.)wil 'not be required for
:development of,the four parcels.,
