We have had the opportunity to review the questions raised at the April 17, 2000,
meeting, with the Director of Public Works and have the following response:
1. If lots 5 through 9 or any portion thereof are to remain less than five acres in
gross area, we will require improvement of the Cassandra Drive frontage to RS-
8-LD III road standard and that Cassandra Drive be improved to the RS-8-LD II
from the project boundary to Durham Pentz Road.
2. If lots 5 through 9 are all to be five acres or larger in gross area, we will require
improvement of the Cassandra Drive frontage to RS-8-LD II road standard and
that Cassandra Drive be improved to the RS-8-LD I from the project boundary to
Durham Pentz Road.
3. Traffic circulation is a major issue since Cassandra Drive currently serves more
than twenty parcels (approximately 34), each of which is less than 20 acres in
gross area. We will require circulation in accordance with Section 20-133 of the
Butte County Code as a condition of approval for this project.

Subject: Richard Cochrane Pre-development review for proposed Flex Lot Subdivision
(FRED 00-05) ,
This letter is a follow-up regarding the meeting held April 17, 2000 on this proposal. During this
meeting, I distributed the comments that were received,to date, regarding the proposal. Additionally,
staff from the Public Works Department and Health Department were present and provided input.
Based upon this meeting, and review of the proposal by the County, staff finds that the proposal
qualifies for a Flexible Lot Size Subdivision as a 184 (+/-) acre parcel zoned U (Unclassified, 20 acre
parcels), to be divided into 9 parcels, with the following exceptions:
1. In order to proceed with this proposal it will be necessary that the open space area be
increased to 50 percent of the parcel size, as required by Butte County Code Section 24-82
(g)(4), which states:
For projects in zoning districts with a minimum lot size requirement of greater than five(5)and
less than forty (40) acres, a minimum of fifty (50) percent of the total project site shall be,
dedicated as permanent open space.
Since the U zone allows for 20 acre parcels, a 50 percent open space requirement is
necessary. The current tentative map notes this standard,but the open space lot needs to be
defined with a boundary and proper size.
2. Butte County Code Section 24-82(6)(a) states that subdivisions creating less than 25 parcels
must provide individual sewage disposal systems located on the parcel it serves, approved by
U.S. Postal Service

the Butte County Environmental Health Division. Your proposal includes plans to develop
a community sewage disposal system. These systems are only permitted for subdivisions

creating 25 or more parcels. This requirement ensures that a homeowner's association will
have the resources to maintain the system. If this cannot be accommodated, you may petition
the Development Review Committee for an exception to this standard.
3. The FEMA flood zone needs to be more accurately delineated on the tentative map. All other
natural features should also be delineated to assess primary and secondary open space areas
in accordance with Butte County Code Section 24-82 (g)(1).
Additionally, as I indicated at our meeting, appropriate biological and archaeological assessments
shall be required in order to conduct environmental review pursuant to the California Environmental
Quality Act.
The Department of Public Works indicates that comments will be forthcoming regarding the issues
discussed at the meeting. Their staff is contacting Ted Crawford regarding the use of Cassandra
Drive, which is a cul-de-sac serving over 20 parcels. As soon as I receive these comments, I will
forward them to you.
Thank you for your participation at this meeting. This concludes the pre-development review of your
proposal. With the noted changes, your tentative subdivision map may be submitted pursuant to
Section 24-82 (d) of the Butte County Code and the County Subdivision Ordinance. The pre-
development review meeting is intended to ensure that your proposed Flexible Lot Subdivision
conforms to County code. Additional comments and requirements will be provided to you upon
review of the formal subdivision application.

Based on the preliminary information available to us at Ns time, the following
requirements would meet the CDF/BCFD minimum standards:
1. Meet the"firesafe regulations" of PRC 4290 and Butte County. These pertain to
road and driveway standards, addressing and building setbacks from property
lines.
2. Automatic fire sprinklers will be installed in all new dwellings if there is no
community pressurized water system available.
These are preliminary requirements and may change as any of the presented

PRE-DEVELOPMENT REVIEW FOR RICHARD COCHRANE FLEXIBLE LOT
SUBDIVISON, (FRED-00-05)
We have comments regarding four general aspects of the proposed development:
Wetlands and/or stream course alteration - Water quality certification is required for any project which
impacts waters of the State (such as streams and wetlands). Impacts include, but are not limited to;
stream crossings, the modification of stream banks or stream courses, and the filling or modification of
wetlands. The Certification must be obtained prior to construction. Failure to obtain certification, when
required, may result in enforcement action.
Storm Water- A construction Activity Storm Water Permit is required for storm water discharges
associated with a construction activity where clearing, grading, and excavation results in a land
disturbance of five or more acres. Storm water discharges from a construction activity that results in a
land disturbance of less than five acres, but which is part of a larger common plan of development, also
requires a permit. The Construction Activity Storm Water Permit must be obtained prior to
construction. Failure to obtain a permit, when required, may result in enforcement action.
Construction Dewatering - If improvements such as sewer, or other utility installation require dewatering
of any excavation, a general NPDES dewatering permit must be obtained. This office may be contacted
to obtain the forms for this permit if necessary.
Wastewater Treatment and Disposal - Sufficient information must be provided by the applicant to enable
evaluation of the treatment and disposal options in relation to conditions in the area such as local ground
and surface water hydrology and soil types and depths. Potential impacts or benefits which must be
addressed include: contamination of ground and surface waters, protection of public health, generation
of vectors and nuisance conditions such as odors, and short-term impacts during construction such as
accelerated erosion. A septage disposal plan must also be considered if the development will be on
septic tanks.
In order for Regional Board staff to comment further on the proposed project, please submit the
information required in the Regional Board's Information Needs for Waste Disposal from Land
Developments (copy enclosed). After this information has been supplied we will determine its
adequacy. After review of the data, staff may decide to recommend adoption of Waste Discharge

FOR
WASTE DISPOSAL FROM LAND DEVELOP14ENTS
At a public hearing on 15 December 1972, the California Regional Water Quality
Control Board, Central Valley Region, adopted Guidelines For Waste Disposal.
From Land Developments. The Guidelines have been incorporated into the Water
Quality Control Plan for the Central Valley.(1) The Guidelines contain a
description of how the Board will evaluate waste disposal from land develop-
ments especially with regard to the installation of individual septic tank
leaching systems.
Contained herein is a description of the information which' inust -be supplied
to enable the Board's staff to determine if the proposed development conforms
with the Guidelines. The information should be submitted along with the
tentative map to the local planning agency. The planning agency will transmit.
this information and the tentative map to the Regional Board and to the local
health department. It is suggested that local planning agencies require the
submittal of such information along with a preliminary map to a subdivision
review committee prior to submittal of a tentative map.
The following information needs have been developed with regard to 'developments
which propose individual waste disposal systems. Much of this information may
also be needed if the developer proposes to build a community -collection and
treatment system. In such case, the developer must.submit a report of waste
discharge to the Regional Board.
Existing Conditions
The. report must contain sufficient information describing the physical environ-
ment of the development to allow the Regional Board to evaluate the effect of
waste disposal and associated construction activities on ground and surface
waters. It is expected that the developer will maid use of locally available
data 'to develop this report. The amount of testing to be done on each sub
division will vary depending on the area involved.. In general, the frequency
of testing will be left to the discretion .of the engineer. Sufficient infor-
mation must be available to generally categorize the development according to
controlling criteria in the Guidelines. Local requirements may require sub-
sequent testing of certain parameters on each lot for purposes of designing
treatment and disposal systems.

applicable so noted. The attached form together with the tentative subdivision .
or land development map and certification will generally suffice.
Proposed Development Plan
A. Show extent of development including all existing, currently proposed, and. .,
contemplated future land developments for area and immediately adjacent
areas. If development is to be staged, show.extent of each stage and
expected time for implementation.
B. If sewage disposal is to be by individual systems, provide the following :.
data for each lot as determined-by representative testing within the
development- . .
1. Percolation Rates (min/in)
a. Describe and show location of percolation tests.
2. . Soils and geology
a. Show depth of soil to rock or first impervious layer:
.b. Evaluate grain size distribution, organic content, presence of
swelling clays, etc. -
c. Show location and extent of all rock outcrops, and if limestone
is present, discuss the possibility of solution cavities serving .
as conduits to carry effluent into water supplies. :
d. Define, geological hazards as. they relate to waste disposal in-
cluding degree and nature of fracturing and weathering and discuss
the possibility of fractures serving as .conduits to carry effluent
into water supplies. .
e. Show depth and distribution of impervious layers including.slope
and direction of these layers.
f. Present information used to compile soils data (include Soil Con-
servation Service appraisal where applicable) .
3. Slope
a. Show slope of existing ground surface.
b. Show location of all cut or fill banks over n o feet in height
and designate area not available for waste disposal.

4. Available disposal area
a. Show the total available disposal area that can be reached by
gravity for each lot or proposed discharge.
5. Ground water
a. Show depth to seasonal high ground water and discuss anticipated
and/or historic high level.
b. Indicate direction of movement.
C. Discuss recharge sources and amounts .in areas where they may be a
problem..
d. Submit data on chemical and/or bacteriological. quality.
e. Show location or marshy areas .and springs.
f. S4ow location and identify use of all existing or proposed water'
wells, including those abandoned, both in development and on
adjoining properties within 100 feet of development boundaries,
and show areas not available for waste disposal.
6. Surface waters
a. ` Show location and extent of all.flowing streams, drainage courses,
ephemeral streams, canals, lakes, and reservoirs.
b. Discuss relationship to ground water.
c. Discuss any flood hazards. .
7. Climate
a. Describe annual precipitation slarAng form and seasonal pre—
cipitation.
b. Describe evapotranspiration rates and show seasonal distribution.
Master Plan for Waste Disposal
Discuss plans for handling both liquid and solid wastes and the resulting im-
pact on water quality at all stages of development.

a. Identify flows and characteristics of sewage and industrial v antes.

b. Discuss the changes in water quality that may be expected to occur as
a result of waste discharges.
c. If individual systems are to. be used, indicate why existing,
. systems were not used or why such a system was .not constructed.
d. If installation of community system is -proposed at a later date shoo
that system can be economically installed, provide evidence of capa-
bility to finance and construct such a system.
e. Discuss the public entity and indicate maintenance and operation
schedules of the individual systems.
f. Show how disposal of septic tank pumpings will be accomplished.
2. Solid Waste
A. Identify expected solid waste volumes and point of disposal.
b. Discuss how, and by whom, the waste will be transported to the disposal
site. _
c. If disposal, is to an existing site, indicate that solid waste from the
development will be accepted at the site, provide information on capa-
bility of site to accommodate wastes- and discuss the effect upon the
life of the site:
Stores Drainage and Erosion Control Plan _
A storm drainaova and erosion control plan must be'submitted with
the tentative .-
map which indicates: ----
1. Expected volumes, peak rates, .characteristics and other pertinent infor-
mation concerning storm water runoff and dry weather drainage from both
construction and ultimate development .phases.
2. Adequate collection and treatment systems are, or j:-i.11 be, available as
necessary to protect the water environment from any. adverse effects.
3. Stabilization and/or erosion control of all cuts, fills, and other exca-
vations or gradings by planting, riprapping, or other effective means
that will prevent erosion.
4. Installation of adequate storm drainage facilities which will minimize the
amount of silt, sand, and debris discharged to area receiving waters.

5. Stabilization of all storm water runoff channels by the installation of
culverts, ripraps, or other effective means that will prevent erosion. ,
6. Scheduling of work,so as to minimize erosion .from weather conditions and
the stabilization of work in progress against inclement weather.con-
ditions. .
The Regional Board will prescribe requirements when necessary .pertainino to
waste discharges from land development or other construction and earth moving
operations located in areas having a high potential for soil erosion and re-
sultant siltation problems affecting water quality and water use.

DEFINITIONS OF TERMS USED IN GUIDELINES
Abandoned Well
A well whose original purpose and use has been permanently discointinued
or which is in such a state of _disrepair that it cannot be.used for. its
original purpose. If an abandoned well has been properly -destroyed so that
it will not produce water nor act as a conduit for the. movement of water,
it will not be subject to minimum criteria in the Guidelines.
Community Sewerage System
A piped collection system which delivers sanitary wastes from a number of
dwelling, business, commercial, etc., units to one or more wastewater
treatment plants. The community sewerage system is normally under the
jurisdiction of a public entity and operates under waste discharge require
ments issued by the Regional Board.
Disposal Area
The area to be used for installation of leaching systems (normally trenches
or seepage pits) from septic tanks.

Subject: Pre-development Review for Richard Cochrane Flexible Lot Size Subdivision,
(PRED- 00-05)
The Butte County Development Service Department has received a request for a pre-development
review meeting with County staff regarding a Flexible Lot Size Subdivision, in accordance with Butte
County Code 24-82 (c) (3). This is a proposal to create 9 parcels on a 184-acre parcel zoned U
(Unclassified) with a General Plan designation of Agricultural Residential. This property is located
south of and adjacent to Durham Pentz Road at Assessor Parcel Number 041-120-120. This meeting
is being held prior to formal submission of the application.
At this meeting, representatives from the Development Services Department, Environmental Health
Division, Public Works Department, County Fire Department, and any other agency with applicable
interest in the proposed development site will review the proposal. The purpose of this meeting is
to provide the following preliminary direction to the applicant: 1) Identify any potential
inconsistencies with County ordinances and policies, 2) Identify design components and filing
requirements recommended for the formal tentative subdivision map application, 3) Discuss the
review process, 4)Identify potential environmental impacts, and 5) Identify special studies that may
be required to accompany the formal application. Planning Division staff will also review this
proposal for conformance with the Flexible Lot Size Provisions of Butte County Code.
Any direction given shall be preliminary and is subject to further refinement or change as the
application progresses to and through the formal application process. Following the meeting, the
Development Services Department shall send a letter to the applicant describing recommended
direction, additional filing requirements for the formal application, and other determinations reached
at the meeting.
The pre-development conference will be held in the Development Services Department conference
room located at 7 County Center Drive, Orovi lie on April 17, 2000 at 10:00 a.m. If your department
or agency has concerns or comments regarding the proposal, please have someone attend or submit
written comments to this department prior to the meeting. Comments may be faxed to (530) 538-7785
