The property is located at 13602 Lucas Court off of Woodbury Drive,Paradise Pines. (LP) (MVAR99-06 It was moved by Commissioner Lambert, seconded by Commissioner Cage, and unanimously carried to approve the Minor Variance for Thomas Norlie subject to the following: I. Determine the project to be under Section 15305 (a)of the California Environmental Quality Act based upon the following finding: A. Upon careful and deliberate review of the project and the project site environs, the proposed 3 feet encroachment will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15305(a)which allows for minor alterations in land use limitations including,"Minor lot line adjustments, side yard and set back variances not resulting in the creation of any new parcel"; and II. Zoning Ordinance Findings. A. There are special circumstances applicable to the property(size, shape, topography, location or surroundings) or the intended use of the property, and because of this, the strict application of zoning standards code deprives the property of privileges enjoyed by other properties in the vicinity under identical zoning classification in that the irregular shape of the parcel with easement setback and rear yard setback along with septic space requirement poses a hardship; and B. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be materially detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The use is residential and the proposed use is residential. F. This Minor Variance will not be incompatible with the Butte County General Plan. III. Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to recommend approval of a Minor Variance for Thomas Norlie on APN 066-250-013 to allow Minor Variance to allow a structure 3 feet into a 15 foot rear yard setback and subject to the conditions found in Exhibit"A". ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■'AUGUST 11, 1999 ■ Conditions of Approval: 1. The hearing was opened to the public. Thomas Norlie said he was here to answer questions. He said he had no problems with the conditions. The hearing was closed. Mr. Wilson recommended to the Planning Commissi6n that the Minor Variance for Thomas Norlie to allow a structure three feet into a 15 foot rear yard setback be approved subject to the findings and conditions listed int he Agenda Report-and that the item be scheduled for the August 11, 1999, Planning Commission Consent Agenda. If the Planning Commission concurs with the recommendation; the Minor Variance can be issued. Vicinity Map B. Site Plan SUMMARY: The proposed project meets the finding as set forth for the Minor Variance. Staff recommends approval. PROJECT DESCRIPTION: Proposal for a Minor Variance on a triangular lot situated on a cul-de-sac. Granting of this Minor Variance would allow the placement of a 1,684 sq.ft. residence and a 726 sq.ft. garage to be placed 3 feet into the 15 foot rear yard setback. ANALYSIS: The parcel is located on a cul-de-sac and is triangular in shape. The setback for side yards in the R-1 zone are 5 feet. This particular parcel has a recreational easement on the southern property line of 10 feet which lessens the building space for development. In order to provide space for the septic system the applicant will need to move the dwelling and garage three (3) feet into the rear yard setback, maintaining the ten foot recreational easement, and space between the garage and the dwelling. In December of 1994 the parcel setbacks were greatly increased by the rezone requested from the Paradise Pines Property Owners Association from 5 feet to 15 feet for rear yards. The rezone from 0 Butte County Department of Development Services 0 Agenda Report 0 Page 1 0 RT-1 (Residential Mobile Home) was to stop older mobile homes and trailers from being placed within the Paradise Pines Subdivision. This rezone has placed a hardship on many undeveloped parcels. Section 24-50 of the Butte County Code states that a variance can only be granted when, because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification. Section 24-52.E of the butte County Code allows the Director of Development Services to grant a Minor Variance, at a maximum reduction of twenty percent (20%) of the prescribed requirements of Section 24 of the Butte County Code with respect to front, rear, or side yard setbacks. The placement of the house and garage within the rear yard setback will be equal to the 20% encroachment allowed. The Paradise Pines Architectural Control Committee has approved this request. The Butte County Public Works Division along with the Environmental Health and California Department of Forestry have on problems with this request. CEQA ISSUES: This Application for a Minor. Variance is Categorically Exempt from environmental review under Section 15305(a) which allows for Minor Alterations in Land Use limitations including, "Minor lot line adjustments, side yard and setback variances not resulting in the creation of any new parcel". ACTION FOR CONSIDERATION: Staff recommends the Planning Manager take the following action: I. Determine the project to be under Section 15305 (a)of the California Environmental Quality Act based upon the following finding: A. Upon careful and deliberate review of the project and the project site environs, the proposed 3 feet encroachment will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15305(a) which allows for minor Alterations in Land Use limitations including, "Minor lot line adjustments, side yard and set back variances not resulting in the creation of any new parcel"; and II. Zoning Ordinance Findings. A. The Minor Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property for which the Minor Variance is sought; and C. This Minor Variance will not be materially detrimental to the public health, safety or welfare, or injurious to the property or improvements in such vicinity and zone in which the property is located; and D. This Minor Variance will not constitute a special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated; and E. This Minor Variance will not allow a use or activity which is prohibited by the zoning regulation governing the parcel of property. The use is residential and the* proposed use is residential. F. This Minor Variance will not be incompatible with the Butte County General Plan. III. Action. A.
