Re: Guernsey TSM Pre-Development Review
This memo confirms this departments comments regarding the aforementioned development review
meeting on 4/2/02.
The project is of a size and complexity that will require review and possibly approval from the Regional
Water Quality Control Board. If the applicant pursues the path of providing a community sewage
disposal system they most certainly will be required to file with the RWQCB as a "reporter of waste
discharge" and be required to obtain a permit from the state to discharge sewage generated from the
project.
The community sewage system has other problems associated with it. The only area available for the
treatment facility is in a FEMA flood zone. Special conditions must be met to place it there.
The applicant suggests individual wells for drinking water. If he goes with a community system we
would not object to this proposal. If he options for individual on-site septic systems well locations could
become problematic and we suggest going with a community water system.
The applicant and his engineer indicated they would probably go with a retention pond for storm water.
This would be acceptable and the pond has setbacks from wells and septics.
We will be responding to the applicant regarding his Pre-Application review pending in our office.

COMMENTS FOR PRE-DEVELOPMENT MEETING, GUERNSEY FLEXIBLE LOT SIZE
SUBDIVISION (PRED-02-06), BUTTE COUNTY
Your 11 March 2002 letter solicited comments to be discussed at a pre-development meeting on
Tuesday, 2 April 2002. The meeting concerns the Guernsey Subdivision, which is proposed to consist
of 50 residential lots-on a 50.9-acre parcel. We understand that wastewater will be handled by on-site
septic tanks in,combination-with a community disposal system. ,
The following comments should be considered at the meeting:
Waste Discharge Requirements—If a community disposal system is used, the wastewater treatment and
disposal system must be covered under waste discharge requirements (WDRs) adopted by the Central
Valley Regional Water Quality Control Board (Regional Board). Tobe covered, the project proponent
must submit a Report of Waste Discharge, consisting of a completed application form, filing fee, and
any relevant technical information needed to draft WDRs. After the Report of Waste Discharge is
deemed complete by Regional Board staff, the Regional Board has 120 days to adopt WDRs. A WDRs
application package can be obtained by telephoning this office at 530-224-4845.
California Environmental Quality Control Act (CEQA) - The project is subject to environmental review
under CEQA. Such environmental review must be completed prior to the Regional Board taking action
to adopt WDRs. To be considered adequate for adopting WDRs, CEQA must fully discuss water quality
issues related to the project. CEQA must describe site conditions relevant to wastewater handling and
water quality protection, as well as potentially significant impacts to water quality and how they will be
mitigated. At the request of the project proponent, Regional Board staff will provide a list of the kinds
of information and analyses typically required to conduct a water quality assessment for a project of this
sort.
100 year flood zone - The lot,layout shown on the provided drawing includes "open space." The
drawing suggests that this open space, entirely within the 100-year flood zone, is the only area within
the 50.9-acre parcel with sufficient room for a community disposal system. A standard requirement of

WDRs is that treatment facilities and disposal areas be designed, constructed, operated, and maintained
to prevent inundation or washout due to floods with a 100-year return frequency. If the project
proponent plans to construct wastewater treatment and disposal facilities within a 100-year flood zone,
steps must be taken (e.g., raising the disposal area or building a levy) to ensure wastewater facilities will
not be subject to flooding.
Adequate unsaturated soil horizon separating disposal area from groundwater— Groundwater, which is
or may be used as a drinking water supply, must be protected from pathogenic organisms that could be
present in the wastewater. Percolating wastewater through five feet or more of unsaturated soil is
generally thought sufficient to kill most pathogens. For this reason, five feet or more of suitable,
unsaturated soil must be included in the design of the wastewater disposal system. If an adequate
thickness of suitable soil is not present at the site, the project proponent may propose an engineered
solution, such as importing soils or building synthetically lined disposal ponds. If groundwater or tight
soils are close enough to the ground surface where mounding could be a problem (i.e., putting all or a
portion of the 5-foot unsaturated soil layer at risk of being saturated), a mounding analysis will be
required.
Construction storm water—The subdivision area is greater than five acres and requires coverage under a
general construction storm water permit. Information on the general storm water permit can be obtained
by telephoning Scott Zaitz of this office at 530-224-4784.
Wetlands and/or stream course alteration—The project proponent may need to apply for a Clean Water
Act Section 404 permit (§404 permit) from the U.S. Army Corps of Engineers. A §404 permit is
required for activities involving a discharge of dredged or fill material to waters of the United States.
"Waters of the United States" include wetlands, riparian zones, streambeds, rivers, lakes and oceans.
The Army Corps of Engineers contact for §404 permits in Butte County is Mr. Matt Kelly,
530-557-7724.
Projects requiring a §404 permit also require a water quality certification (pursuant to Section 401 of the
Clean Water Act) verifying that the project does not violate State water quality standards. A water
quality certification is required for any project that impacts water of the State (such as streams and
wetlands). Activities that fall under the water quality certification process include, but are not limited
to: stream crossings, the modification of stream banks or stream courses, and the filling or modification
of wetlands. A water quality certification, if required, must be obtained prior to construction. Failure to
obtain a water quality certification, when required, may result in enforcement action. The Regional
Board contact for water quality certifications is Scott A. Zaitz, whose telephone number is given above.

LAFCO concerns on the Guernsey Subdivision project areas follows:
Subject area is located in the Chico Sphere of Influence. LAFCO is presently considering all aspects of
future growth in the north Chico areas and this project should reflect an urban use in all ways possible.
It would be preferable to develop the site with a community system that could be integrated with Cal
Water Service in the future. It would be even more preferable to determine if Cal Water has any interest
in developing a community well on this site that could eventually serve the north Chico area.
It would be preferable to construct a community sewer system that could eventually be incorporated into
the municipal sewer system.
LAFCo supports the creation of smaller parcels with increased density in this area in anticipation of a
future annexation to the City of Chico.
Please provide clear conditions concerning the disposition of park fees collected. CARPD has indicated a
desire to be contacted up-front on this issue to ensure the collection of fees is coordinated with their
office.
If a CSA is required for maintenance of sewer/water/drainage/street,lighting/etc... it is preferable to
annex to an existing CSA such as Autumn Park for this function. The creation of new CSA's or other
service districts in the Chico Sphere of Influence is discouraged.

Dear Dan:
Thank you for the opportunity to comment on the proposed Tentative Subdivision Map for 50
residential parcels to be located on a 50.9 acre parcel located west of Garner Lane,south of the future
extension of Autumn Park Drive. The City Planning Division forwards the following comments for
your consideration.
1) Use of the flexible lot size provisions in this situation, places a community leach field
within the 100-year flood plain subjecting these facilities to inundation and potential
failure. Allowing one acre minimum size lots would provide for on-site primary and
secondary leach fields and provide lot sizes consistent with the North Chico Specific
Plan. It is not anticipated that this area will be served with sanitary sewers in the future
and all precaution should be taken to insure the long term operation and adequacy of on-
site sewage systems.
2) This development will generate 500 to 250 additional vehicle trips per day (depending
on whether it is approved at its current density or one acre minimum)which will add its
proportional impact to traffic on the SHR 99 corridor and the Eaton Road interchange
which is already at Level of Service F at AM and PM peak hour. Transportation impact
fees should be charged to mitigate said impacts and to pay fair share to urban area
transportation improvements.

The following are the Butte County/ California Department of Forestry and
Fire Protection requirements for the proposed 50 parcel subdivision using the Flex
lot concept on Autumn Park Drive in the North Chico area:
1. Construction, installation or development of structures or facilities on the
parcels/lots shall comply with the latest California Fire Safe Regulations, (Public
Resources Code 4290), and all other applicable State and County codes,
ordinances and regulations in effect.at the time of application for improvement
permits.
2. .Building identification and/or addresses shall be installed in conformance with
Public Resources Code 4290 and shall be posted at the beginning of building
construction and maintained continuously thereafter.
3. A pressurized community water system for fire protection is required. The
speck locations and fire flow requirements shall be in accordance with the Fire
Department specifications and to the satisfaction of the County Fire Warden.
Average required hydrant spacing is 500 feet, hydrant size is 6 inches, and
residual fire flow in 750 gallons per minute for 2 hours. Submit plans to the Fire
Department for review and approval prior to construction of facilities.
4. Autumn Park Drive must be connected between State Highway 99 and Garner
Road to eliminate the dead end road problem.
5. CSA 172 currently serves the Autumn Park Subdivision for fire protection and
annexation to that system may be a solution for a pressurized water system.
These requirements are preliminary and may change as the project continues.

Subdivision Map proposing to create 50 residential parcels on a 50.9 acre parcel located east of and
adjacent to State Route 99, at the intersection of Autumn Park Drive in the north Chico area.
Based on the information submitted the District recommends implementing mitigation measures as
suggested in the District's Indirect Source Review Guidelines which seek to reduce emissions
resulting from vehicular activity. These measures encourage walking, bicycling, transit use and
other alternative travel modes by making them more convenient and safe to use.

The District has reviewed the Guernsey Flexible Lot Size Subdivision, and offers
comments with regards to the drainage plans for the development. The construction of
surface channels should be graded to prevent standing water. Construction of
detention basins should have a 3:1 side slope to prevent emergent vegetation from
occurring along the ponds perimeter to prevent a habitat For breeding mosquitoes.
Drainage plans for this development should include a maintenance district to insure the
facility will function properly for its intended purpose, and not become a mosquito
problem.

The Butte County Development Service Department has received a request for a pre-development review
meeting with County staff regarding a Flexible Lot Size Subdivision, in accordance with Butte County
Code 24-82 (c) (3). This meeting is being held.prior to formal submission of the application. This is a
proposal to create 50 parcels on a 50.9-acre parcel zoned SR-1 (Suburban Residential, 1-acre parcels)
and OS (Open Space/Greenbelt) with a General Plan designation of Agricultural Residential. The
property is located east of and adjacent to State Route 99,at the intersection of Autumn Park Drive in the
North Chico area and is within the North Chico Specific Planning Area. This property is shown to be

At this meeting,representatives from the Development Services Department,Environmental Health
Division,Public Works Department,County Fire Department,and any other agency with applicable
interest in the proposed development site will review the proposal. The purpose of this meeting is to
provide the following preliminary direction to the applicant: 1)Identify any potential inconsistencies
with County ordinances and policies, 2) Identify design components and filing requirements
recommended for the formal tentative subdivision map application,3)Discuss the review process,4)
Identify potential environmental impacts, and 5) Identify special studies that may be required to
accompany the formal application. Planning Division staff will also review this proposal for
conformance with the Flexible Lot Size Provisions of Butte County Code.
Any direction given shall be preliminary and is subject to further refinement or change as the
application progresses through the formal application process. Following the meeting, the
Development Services Department shall send a letter to the applicant describing recommended
direction,additional filing requirements for the formal application,and other determinations reached
at the meeting.
