Immediately following they Addendum submittal in December, a meeting was conducted between CVRWQCB staff and Gilbert Engineering. The goal of this meeting was to determine the ultimate concerns with the system and come to an agreement of how these concerns could be addressed. As a result, there were three key issues that would need to be resolved. Based on the Report of Waste Discharge Update and Summary letter dated April 25, 2006, they were outlined as follows: ITEM#1: • If available, the construction details of the existing well used for mounding calculations need to be submitted. Also, determine if reliable hydro geologic information exists for the area. If not, it would be required that an extend-a-hoe be used to study the soil at depths greater than seven feet. The construction details of the existing well could not be found. With the exception of the geological information recommended to us by the Ci7RWQCB and used for the mounding calculations, there are no other known, reliable hydro geologic studies for this area. We propose to use an extend-.a-hoe to study the soil strata at depths of at least IS-20 feet. ITEM#2: • There was discussion on the groundwater calculation variables. It seemed as though Gilbert Engineering mounding results were similar to the CVRWQCB values — is it required that we re-calculate the mounding calculations with the CVRWQCB recommended variables? Gilbert Engineering will revise our calculations utilizing the CVRWQCB variables. If the results from this revision yield solutions that are less conservative than the previous results, the previous results shall be deemed acceptable. ITEM#3: • The concern for sufficient wastewater setbacks from adjacent property lines and wells is still an issue. There is no "prescriptive standard" so a few mitigation ideas were discussed. These potential solutions included incorporation of a de-nitrification treatment system, system relocation to the center of the project, incorporation of monitoring wells along the westerly property line, and a field investigation/study of the geological features of the soil and groundwater movement. We propose to design an Orenco Systems® AdvanTex® de-nitrification treatment system after each community dosing tank, prior to the pressurized disposal trenches. In addition, the leach fields will be alternated across the entire disposal and replacement fields. Three, 20 feet deep monitoring wells will be located along the westerly boundary line. 1 ITEM#1: Investigation for hydro-geologic information for the area was not found. The state well number 21N/01E-26KO1M used in the Butte County Groundwater Inventory Analysis also did not include construction details. It was determined that the well has an irrigation use and that it is within a confined aquifer system. Please refer to Appendix A for the reference out of the Butte County Groundwater Inventory Analysis. To supplement our knowledge of available (treatment providing) soil depth and to determine existence an aquitard, an extend-a-hoe was used to excavate three deep soil profile holes. The holes were dug over the length of the disposal and replacement fields. As a result of each excavation, no evidence of an aquitard was observed. The deepest hole was fifteen feet. A report of the soils observation holes and revised Soil Test Locations Site Map is included in Appendix B. ITEM#2: The mounding calculations submitted in December 2005 have been revised with recommended variables provided by the CVRWQCB. MoundHT was again utilized for the calculations. As a result, the maximum mound height after five years was 3.595 feet. The results from the MoundHT program are enclosed as Appendix C. ITEM#3: There is a concern for nitrate contamination of the groundwater table. For this reason, reasonable setbacks must be incorporated into the design of the disposal system. In addition, a monitoring program needs to be established that will periodically test the water quality. A couple of steps were taken to set .reasonable set-backs. ' Multiple agency standards within California were researched for guidance. Since there are no published or set specific guidelines for community system setbacks, the disposal field has been alternated with the replacement area to provide a larger soil area to disperse and treat the effluent. Furthermore, the leachlines will be placed at a minimum, 50-feet from the property line and 300-feet from the existing well located to the south. Appendix D includes a revised Subdivision Site Plan and Preliminary Wastewater Design sheets. To ensure that there is not contamination of nitrates from the disposal area, groundwater monitoring wells will be installed down gradient from the leachfield. As shown in the Butte County Groundwater Inventory Analysis, the aquifer tends to have a movement to the west, or southwest. DWR and BCDWRC monitoring wells are shown on Plate 6,Appendix A. Historic groundwater level'data for the Durham-Dayton Sub-inventory Unit indicate that the annual fluctuations in groundwater levels in the confined or semi-confined portions of the aquifer system average about 15 feet during years of normal precipitation and up to 40 feet during years of drought. The annual fluctuations in groundwater levels monitored in a composite section of the aquifer system are highly variable,ranging from 5 to 30 feet during normal years and up to 40 feet during years of drought. Composite monitoring wells measure a combined groundwater level in multiple water-bearing zones within the aquifer system. Table 7. Box 907 Durham, CA 95938 RE: Predevelopment Review for The Reserve Subdivision, General Plan Amendment, and Rezone (Pred 02-07) Dear Mr. Jones: Thank you for your participation in the predevelopment review meeting held on July 17, 2002. Attached, please find comment letters received during the review period. The following information includes a discussion regarding the various land use policies that factor into this proposal, and a summary of comments made at the predevelopment review meeting. Planning_Division Comments: The proposed General Plan Amendment, Rezone, and Tentative Subdivision Map is located in an area that is not currently provided with basic community services such as sewer, water, and drainage infrastructure. This area is designated as Orchard and Field Crops by the General Plan, meaning it has been established as an area for commercial agricultural activity. Butte County has specific land use policies contained within the Agricultural Element and Land Use Element of the General Plan that are applicable to this project. In addition, the project lies within the Durham-Dayton-Nelson (D2N) Plan Area. The D2N Plan is discussed in more detail below. Based on the location of this property within the Orchard and Field Crops General Plan designation, the following goals, programs, and policies from the Agricultural Element and Land Use Element are applicable to this project: Agricultural Element Goal 1: Maintains parcel sizes that ensure the long-term preservation, conservation and continuity of those General Plan areas identified as Orchard & Field Crops and Grazing and Open Lands. Goal States that agricultural land at city and community boundaries should be conserved and stabilized in order to protect agricultural lands from encroachment and conversion to urban uses. Policy 2.1 States that agriculture shall not be made unviable by the economic impacts of urban development. Program 2.2 Requires that a buffer be established on property proposed for residential development in order to protect existing agricultural uses from incompatible land use conflicts. The desired standard is 300 feet, but may be adjusted to address unusual circumstances. Guidelines, as part of the General Plan's implementation, shall be developed illustrating buffer requirements for various situations. 0 Program 2.5 Encourages urban development to the Local Agency Formation Committee's adopted Sphere of Influence for incorporated Cities. Program 2.6 States that LAFCo adopted sphere of influences be utilized for cities and the identified unincorporated community cores as areas for urban and/or more intensive development. Restrict urban and intensive development to those areas outside agriculture and other low-intensity uses. Program 2.7 States that limited conversion of agricultural land to urban uses could be permitted when the following criteria are met: • A General Plan amendment and rezone has been approved. 0 The lots for which the conversion are requested is adjacent to uses identified as other than agriculture or agriculture support uses, i.e. receiving plants, hulling plants. • The conversion will not' be detrimental to existing agricultural operations. • The conversion land is adjacent to existing urban infrastructure and would constitute a logical contiguous extension of the urban area. • No feasible alternative exists which is less detrimental to agriculture. • Infill within the adjacent designated urban area has reached a 75% level of development. Development is defined as improvements to property including, but not limited to non- agricultural buildings and structures. Policy 3.5 Indicates that the primary purpose of the Orchard & Field Crops land use categories shall be for agricultural production, related processing, and services in support of agriculture. Land Use Element Policy 2.1.b. Retain in an agricultural designation on the Land Use Map areas where location, natural conditions and water availability make lands well suited to orchard and Eeld crop use, while considering for non-agricultural use areas where urban encroachment has made inroads into agricultural areas and where past official actions have planned areas for development. Policy 2.I.d. Maintain minimum parcel sizes in designated agricultural areas by following comprehensive zoning principles. Policy 2.Le. Encourage urban expansion toward the least productive soils. Policy 2.Lf. Allow rural residential developm--nt as a buffer between urban development and intensive crop land. The application of these policies to the proposed General Plan Amendment and Rezone is subject to interpretation by the Planning Commission and Board of Supervisors. The Planning Commission and Board of Supervisors must also determine if the proposed General Plan is consistent with the General Plan, and that the General Plan Amendment is in the public interest, in accordance with Government Code Section 65358 (a). In reviewing any future proposal, the County would also have to take into account the influence the project may have on the surrounding area. Approval of this General Plan Amendment and rezone could result in subsequent amendments of the General Plan within the Orchard & Field Crops General Plan designation. Similar Rezones and General Plan Amendments could be approved in the area and, depending upon each proposal, the number of acres converted to urban uses could dramatically increase. This would further compromise Orchard and Field Crop lands. Durham-Dayton-Nelson Plan This project lies within the D2N Plan Area. The D2N Plan states that general plan amendments, rezones, subdivision approvals, and subsequent urban development warrant the imposition of additional development criteria. This is due to the interrelationships of development in the Plan Area and the necessity to balance agricultural and residential land uses. In addition, the Plan requires consideration of various County's policies, plans, and standards. Towards this end, the Plan imposes Urban Reserve Policies as outlined below. Additional Plan policies that are applicable to this project are also outlined below. Urban Reserve Policy Statement Any proposal for a General Plan Amendment, rezoning, or subdivision which would permit parcels of less than three (3) acres to be created for residential use shall be coordinated with all public agencies which provide utility and public services for extension of water, sewer, circulation, drainage, and shall be required to submit the following plans prior to or concurrently with the application: 1. A capital improvement plan/program that indicates where and when physical improvements are to be made, the size of these improvements, standards, phasing of,treatment facilities and lines to service the area, and how they will be financed. This plan should be based on the desired land pat-.ern for future growth, the costs of initial service, and the continued operation costs to the designated area. 2. A park and open space plan that identifies locations and standards for park and recreation areas to serve future growth, and natural open space areas that are to be preserved. 3. An environmental plan that identifies critical areas that should be protected from development if applicable. 4. A street and transportation plan that indicates the location, capacity, and nature of the system and off-site transportation impacts. 5. Health department standards for control of septic systems, and water wells. Areas where wells and septic systems are not permissible should be identified. 6. A fiscal plan that identifies the proportion of costs of public facilities and services that is to be reimbursed from new subdivisions. Additional Durham-Dayton-Nelson Plan Policies Goal I, Objective 1 Policy 9. An east-west interlink between Durham-Dayton Highway and the Midway shall be adopted prior to any subdivision approvals for property located north of the school. In addition, a north-south route shall be considered as part of the circulation system to the area north of the school. Goal I, Objective 3 Police 2 Require new subdivisions to incorporate transit design characteristics in street designs. Goal I, Objective 3 Police 3 Conduct traffic safety studies in connection with residential development and identify pedestrian/traffic conflicts. Goal II, Objective 1 Policy 4 Extend public services to vacant areas ready for new housing starts by forming improvement districts. 9 Goal IV, Objective 1 Policy 3 Develop a program of growth phasing, wherein only those lands which are adjacent to existing urban densities and have public facilities and services available will be able to develop at urban densities and standards. Goal IV, Objective 1 Policy 4 Foster a compact rather than a scattered development pattern in order to discourage urban sprawl to reduce the extend and cost of public services, and to preserve open space within the Planning Area. Goal IV, Objective 1 Policy 7 Review the option of package treatment plants or sanitary sewer systems for the communities of Durham, Dayton and Nelson. Goal IV, Objective 2 Policy 2 Support the continued viability of agricultural production as the major source of income, employment, and economic viability of the Planning Area. Goal VI, Objective 2 Policy 2 Protect agricultural lands which currently produce, or have the potential to produce, from encroaching urban uses. Goal VIII, Objective 1 Policy 1 Concentrate future residential uses within or near the existing developed communities. Goal VIII, Objective 1 Policy 7 Encourage and maintain agriculture as the predominant land use of the Planning Area. Goal VIII, Objective 1 Policy 12. Adopt an urban boundary surrounding Durham-Dayton-Nelson to require infrastructure improvements that meet the urban standards as established by the Butte County -Public Works Department. Goal VIII, Objective 1 Policy 13. All General Plan Amendments which allow densities of less than one acre per dwelling unit shall be incorporated into the urban boundaries. Summary of Policy Issues The interrelationship of the various General Plan and Area Plan policies influencing the review of this project is complex. Butte County has generally strived to protect agricultural land from conversion to urban development. This is supported by existing General Plan policy and past land use decisions concerning urban development within the Orchard & Field Crops General Plan designation. the integration of a 300-foot agricultural buffer into the Subdivision design helps miti-gate the impact the subdivision may have on adjacent agricultural land. However, the piecemeal conversion of agricultural land into smaller urban parcels will not promote long-term preservation, conservation, and continuity of those General Plan areas identified as Orchard & Field Crops. Encroachment of urban uses into productive agricultural land such as is proposed can influence adjacent commercial agricultural activities. Agricultural lands can become less desirable for agricultural uses or be completely converted to other land uses. This arises from market pressures, complaints from adjacent property owners, and decreases in production caused by the encroachment of incompatible land uses. The D2N Plan policies do not prohibit urban growth, but they do require the provision of services and infrastructure improvements necessary to serve urban development. In addition, the D2N Plan requires the County to support the continued viability of agricultural production, as well as encourage and maintain agriculture as the predominant land use of the planning area. All of these factors would have to be assessed by staff, the:Planning Commission, and the Board of Supervisors during the review of any future application for this project. Because of the complexity involved in this project's assessment, there can be no guarantee as to outcome regarding future application submittals. It would, however, be Planning staff's recommendation that this proposal is inconsistent with policies of the General Plan and the D2N Plan. These policies encourage the retention and viability of productive agricultural land. Department of Public Works Public Works indicated that a traffic study would be required to assess traffic impacts. The traffic study would be required when the County conducts an environmental review for the project. Public Works also indicated that pro-rata cost shares would be assessed for intersection improvements in the vicinity of the project. In addition, a left-turn pocket would be required for the Subdivision. A County Service Area would need to be established for lighting and drainage if these improvements are not maintained by a homeowner's association. Additionally, Public Works requested that information be provided as to whether the subdivision roads would be dedicated for public use. Local Agency Formation Commission LAFCo staff indicated that the project is outside the sphere of influence for the Durham Irrigation District and that the Commission may not be in support of extending urban water services to an area currently designated by the General Plan for intensive agricultural uses. Environmental Health Division The Environmental Health Division discussed issues relative to the provision of sewer service. Environmental Health staff indicated that the Regional Water Quality Control Board would be the entity to review and approve a community sewage disposal system and that a Report of Waste Discharge would be necessary. This would involve working closely with regional board staff and ensuring that application materials contained enough information to allow the Regional Board to make recommendations on the project. Environmental Health also indicated that individual on-site sewage disposal systems may be an option for the development, but that this may require larger parcels. The provision of water was also discussed. Individual wells may be an option if proper setbacks can be maintained from sewage and drainage areas. A small water system may also be permitted, but would require an.additional permit. Environmental Considerations The California Environmental Quality Act (CEQA) requires that the County review projects for potential environmental impacts. Although this property appears to have been used for agricultural purposes, the Planning Division would require appropriate level biological surveys to ensure that any future development project would not impact any sensitive plant or animal species. The current use of the property for agricultural purposes does not preclude the possibility that biological impacts could be incurred from future projects. Biological surveys would typically include a wetland delineation and surveys for sensitive plant and animal species including raptors and bird species. Information from these surveys must be taken into account in the design and lay-out of any future proposal. You are encouraged to have these studies completed by qualified consultants for your own planning purposes. However, the county reserves the right to have any such study independently reviewed and/or performed again by a consultant of the County's own choosing. A traffic impact study would also be required in conjunction with the project's environmental review as requested by Public Works. In addition, Butte County Constraints mapping identifies this area as having a high archaeological significance. The use of the property for agricultural pursuits does not preclude the presence of archaeologically significant resources. It is County policy to require an archaeological resources survey in these areas as a part of any project's environmental review. The Planning Division would also like to disclose to you that submittal of this pre- development review, or any future application, does not authorize work to be performed in conjunction with site development. You should be aware that the Regional Water Quality Control Board, the California Department of Fish and Game, the U.S. Fish & Wildlife Service, and the Army Corps of Engineers have regulatory authority over impacts associated with wetlands and sensitive plant and animal species that are potentially located on any project site. Disturbance and/or grading on any property could result in violations of the Endangered Species Act, the Clean Water Act, and other State and Federal laws. These agencies, including the County of Butte, should be consulted prior to any ype of land clearing or grading completed in conjunction with site development. An east-west interlink between Durham-Dayton Highway and the Midway shall be adopted prior to any subdivision approvals for property located north of the school. In addition, a north-south route shall be considered as part of the circulation system to the area north of the school. 1. Require new subdivisions to incorporate transit design characteristics in street designs. 4. Extend public services to vacant areas ready for new housing starts by forming improvement districts. 3. Develop a program of growth phasing, wherein only those lands which are adjacent to existing urban densities and have public facilities and services available will be able to develop at urban densities and standards. 4. Foster a compact rather than a scattered development pattern in order to discourage urban sprawl to reduce the extend and cost of public services, and to preserve open space within the Planning Area. 7. Review the option of package treatment plants or sanitary sewer systems for the communities of Durham, Dayton and Nelson. 12. Adopt an urban boundary surrounding Durham-Dayton-Nelson to require infrastructure improvements that meet the urban standards as established by the Butte County Public Works Department. 13.
