Our comments are as follows: Page 11. Wastewater Treatment Analysis. It is stated that soil depth in the area of the disposal fields averages four feet. Although this may be technically correct, an analysis of soil depth variation throughout the proposed disposal field is needed, with a discussion of potential problems in areas with soils shallower than average. The original proposal for this development consisted of 40 units utilizing a total area for disposal similar to that currently proposed. The proponent must explain why this same soil area is thought to be adequate for 113 units. In addition, with the approval of the previous subdivision map, we required soil testing to determine the disposal field wastewater acceptance rate. Until such testing is performed, there is inadequate information to determine the ability of the proposed disposal area to accept wastewater. The operation of the wastewater treatment system by a homeowners association presents significant management challenges. We strongly suggest that the project proponent investigate the formation of a public management agency, such as a County Service Area or Community Services District. If a homeowners association is chosen for the development, the governing documents of the association must be reviewed by our staff counsel. This review is necessary to assure the documents contain appropriate authority to manage the system and to collect fees. In addition, financial assurance for repair of any catastrophic failure of the system, as well as replacement of the treatment and disposal system at the end of its useful life musube provided. We will likely require that these financial assurances be held by Butte County as a condition of the waste discharge requirements for the development. Page 18• It appears that approximately 72 acres of the site will be "remaining acreage." How much of this acreage will be taken up by the waste disposal system, fire hazard vegetation clearance, water facilities, and access roads? Stephen Betts - 2 - 6 December 2002 Page 20. Treatment. What is the definition of tertiary treatment as used in this section? Does it refer to BOD, TSS, filtration, nutrient removal, or all of these parameters? What levels of effluent concentrations are expected from this tertiary treatment?Define what "instant repair" means as stated in this section. Disposal. Until,the soil and basal area wastewater acceptance rate is determined, conclusions as to the potential for surfacing effluent cannot be supported. Disinfection. Chlorination is mentioned as the disinfection method in this section, but ozone is mentioned in other sections. Which disinfection method will be used? If chlorination is used, dechlorination will be necessary. Operation. We have previously discussed our preference for a public entity for this project. The statement is made that "Operation and Maintenance will not be difficult or expensive." It is our experience that the difficulty and expense of maintaining a small wastewater treatment plant are often underestimated. See the attached article from the Small Flows Quarterly discussing problems associated with small package plants. A statement is also made that pumps and fittings will be "off the shelf items" and easily interchangeable. Even if an item is "off the shelf," stock may not be available, the component may have been modified since plant installation, or shipping may cause difficulty in quick replacement. Page 60. Soils Survey for Wastewater Treatment and Disposal. The second page of this survey discusses the groundwater monitoring tubes installed in 1997. The Statement is made that the tubes were installed to approximately four feet. However, the actual installation data shows that two of the tubes were 4 feet, one tube was between 3.5 to 4 feet, one was approximately 3.5 feet, one was 3 feet, and one was 2 feet 8 inches. These depths should be noted in the report. In addition, although the tubes were installed after very heavy rains, measurements were obtained only twice. Although it is likely that the measurement taken in late January of 1997 were taken during a time of peak groundwater levels, this assumption requires further justification by placement of additional, deeper, piezometers. Soil Profiles 10, 13, 14, 16,17,18, 19, 20 28, 29, 42,and 43 indicate potential problems with-wastewater disposal because of shallow soil, very low permeability soil, or in one case, soil mottling, yet the profiles are within the area marked as being acceptable for disposal. These profile areas should be more thoroughly investigated, especially since our field visit (6 November 2002) indicates that these supposedly problematic soils may be better suited for disposal than the soil logs indicate. On the third page of the soil profile section, it is indicated that waste strength will be reduced by at least 99%. Such a reduction would result in an effluent BOD of approximately two milligrams per liter. We doubt that any cost effective treatment process can consistently achieve this level of BOD reduction. Please clarify the expected degree of treatment. Miscellaneous. In the original.project proposal, the area near Soil Profile 50 was eliminated from use as a disposal area because of an adjacent swale. Why is this area being included in the current proposal? Stephen Betts - 3 - 6 December 2002 Due to the proposed loading of the soil, there is a potential that some of the applied wastewater may be indirectly discharged to the nearby watercourses. This potential must be addressed by discussing the potential for unacceptable nutrient loading to the stream, as well as potential pathogen contamination. We will have to examine whether such a discharge may require us to issue an NPDES permit_rather than a simpler set of waste discharge requirements. Although short of personnel, an attempt shall be made to have a member of town staff attend and participate at the scheduled pre- development conference meeting on November 21,2002. The Town of Paradise has identified several concerns, comments, and observations relative to the proposed "tentative subdivision map project design". Stated as follows is a partial list of the concerns,comments,etc.: 1. The project site is primarily designated with a "Agricultural-Residential" land use designation by both the Butte County General Plan and the Paradise General Plan. Moreover, a majority of the site property is zoned "A-R" [Agricultural Residential] by Butte County and prezoned "AR-1" [Agricultural Residential, 1-Acre Minimum] by the Town of Paradise. I 2. The"Agricultural-Residential" General Plan land use designation is intended to apply to existing and/or planned residential areas characterized by"larger parcels and accessory agricultural uses, etc.". The project site is located on the south side of Skyway, just west of Skyway Crossroad. Development would occur on 73 acres of the 122-acre project site. The proposed residential lots would vary in size from.0.21 to 1.16 acres. An on-site pressurized water system would provide domestic water to the proposed lots. Sewage disposal would be:handled by an on-site community wastewater treatment and disposal system. The area of the site adjacent to Skyway is zoned S-H (Scenic Highway)and the remainder of the site is zoned A-R(Agricultural Residential). The site is designated by the Butte County General Plan as Agricultural-Residential. The Town of Paradise is located on the east side of the project and is within the Town of Paradise Sphere of Influence. Those items checked are conditions of approval. The project site is located on the south side of Skyway, just west of Skyway Crossroad. Development would occur on 73 acres of the 122-acre project site. The proposed residential lots would vary in size from 0.21 to 1.16.acres. An on-site pressurized water system would provide domestic water to the proposed lots. Sewage disposal would be handled by an on-site community wastewater treatment and disposal system. The area of the site adjacent to Skyway is zoned S-H (Scenic Highway)and the remainder of the site is zoned A-R (Agricultural Residential). The site is designated by the Butte County General Plan as Agricultural-Residential. The CSA formation process will require the Developer to fund the service until the beginning of the first fiscal year in which service charges can be collected for the CSA,and agree to an annual maximum service charge to ensure continued operation of the facilities. B. DRAINAGE 1. Prior to the recordation of the Final Map a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. Prior to or concurrently with the recordation of the Final Map, pay in full any and all delinquent, current and estimated taxes and assessments as specified in Article 8, of Chapter 4 of Division 2 of Title 7, of the California Government Code commencing with Section 66492. 4.
