The following is submitted for the pre-development conference scheduled for
January 7, 2004 on the subdivision shown above:
1. Construction, installation or development of structures or facilities on the
parcels/lots shall comply with the latest California Fire Safe Regulations, (Public
Resource Code 4290), and all other applicable State and County codes,
ordinances and regulations in effect at the time of application for improvement
permits.
2. A pressurized community water system for fire protection is required. The
specific locations and fire flow requirements shall be in accordance with the Fire
Department specifications and to the satisfaction of the County Fire Chief.
Average required hydrant spacing 800 feet, hydrant size 6 inches, and residual
fire flow of 1000 gallons per minute. A back up generator may be required to
guarantee un-interrupted power supply to the fire protection pump.
3. Provide for maintenance and long term operation of water system by creating a
Mutual Water Company or establishing a County Service Area (CSA).
4. Fire hydrant identification, reflector or post reflectors shall be installed
acceptable to the County Fire Chief.
5. Meet the requirements of the North Chico Specific Plan (NCSP) and pay the
appropriate fees.
6. Provide solution to circulation to avoid dead end road.

The Butte County Department of Development Service, Planning Division has received a request for a pre-
application conference regarding a proposed Tentative Subdivision Map to divide the above-referenced parcels into
95, 1-acre residential lots, to be developed in 7 phases. The property is currently zoned SR-1 (Suburban
Residential, 1-acre minimum parcel size)with a General Plan designation of Agricultural Residential. The project
is proposed to utilize individual on-site septic systems and community]each fields, and community wells. The
property is improved with a single family dwelling and barn. The property is located within compatibility zone"D"
of the Chico Municipal Airport. A project description and map is enclosed. The project is located south of and
adjacent to Keefer Slough and east of and adjacent to State Route 99,approximately 600 feet south of Keefer Road
in the north Chico area.
This meeting will be used to inform the applicant of local or state requirements that may apply to this project.
This allows the applicant to incorporate those requirements into the design of the project when the actual
application is made. The applicant will be present to answer questions and receive comment.

Mr. Hauselt has submitted the attached application for a pre-application conference on the
above referenced property, which property is also- the subject of the referenced suit. A
preliminary comparison of the new application tentative map with the map denied by the
Board of Supervisors on May 13, 1997 (copy.of denial letter attached), indicates the lots
.have been renumbered, `open space" notation has been added to the Keefer Slough area,
the notes section has been revised in the area of sewerage disposal and road standards
(referencing current North Chico Specific Plan standards) and the word vesting has been
added to the title of the map.
The purpose of a pre-application conference is to provide information related to
development criteria for a specific property based upon a proposal submitted by the

Dear Mr. Hauselt:
At the regular meeting of the Butte County Board of Supervisors held May 13, 1997, final
action was taken on the continued hearing of your appeal of the Development Review
Committee's denial of a tentative subdivision map for property zoned SR-1, located on the
east side of Highway 99, approximately 500 feet south of Garden Brook Drive and
approximately 1 1/2 miles north of Garner Lane, Chico. The Board action was to deny your
appeal and Tentative Subdivision Map application.
The findings for the denial are as follows:
Environmental Findings.
A. This application was reviewed for compliance with the North Chico Specific Plan
Certified Environmental Impact Report (CEIR) which was adopted on March 28,
1995, identifying potentially significant environmental effects of development in the
North Chico Specific Plan area. Based upon an Initial Study completed on the
project and a review of the CEIR, staff has determined that the project design.does
not meet the mitigation requirements contained in the CEIR and that significant
impacts cannot be fully mitigated. The areas of significant impact include but are
not limited to; protection of habitat along Keefer Slough and flooding/drainage
impacts.
i Subdivision Map Act Findings.
A. The proposed map is inconsistent with the North Chico Specific Plan policies as set
forth in the agenda report to the Development Review Committee dated October 24,-
1996,
4;1996, specifically: Circulation policies 3 and 4; Park and Open space policy 1;
Wastewater policies 1 and 2; and Resource Protection policies 7-4.1; and

B. The design and 'improvements of the proposed subdivision are inconsistent with
County standards and policies in that all lots do not meet County and North Chico
Specific Plan width requirements of 130'; and
C: The project is not physically suitable for the use and density of the proposed
development because adequate sewage disposal area has not been proven; and
D. The design and improvements of the project may cause public health or safety
problems because of the lack of useable sewage disposal area. The applicant has
failed to provide a sewage disposal design meeting the requirements of both the
Bute County Environmental Health Division and California Regional Water Quality
Control Board; and
E. The project site is located within a 100 year flood plain. The project design has the
potential to alter the floodplain, subjecting future residents and adjacent property
owners to increased flood hazards. The applicant has failed to provide detailed
design information showing that it is feasible to develop within the floodplain while
providing for adequate ingress and egress during flood events and providing
suitable building pads above the flood levels, without affecting surrounding
properties.
The time within which judicial review of this decision must be sought is governed by
Government Code Section 66499.37. Any action or proceeding to attack, review, set
aside, void or annul the decision, or any of the proceedings, acts or determinations taken,
done or made prior to such decision, or to determine the reasonablene6s, legality or validity
of any condition attached thereto, shall not be maintained by any person unless such
action or proceeding is commenced and service of summons effected within 90 days after
the date of such decision. Thereafter all persons are barred from any such action or
proceeding or any defense of invalidity or unreasonableness of such decision or of such, .
proceedings, acts or determinations.
