The purpose of the Pre-Development Conference is to inform the applicant of local or state requirements that may apply to their project This allows the applicant an advanced opportunity to incorporate those requirements into the design of the project prior to when the actual application is formally submitted. Ft. convenience store, with two fuel islands, including three gas pumps each, and a 980 sq.ft. carwash, on property zoned M-2 (Heavy Industrial). The property is located on the southwest corner of State Highway 99 and West Liberty Road, opposite Hollis Lane, south of the City of Gridley. APN 021-170-052 (DB) (UP 00-10) ACICION FOR CONSIDERATION: Staff recommends that the Board of Supervisors consider the new Mitigation Measures provided by CalTrans concerning traffic impacts, and the City of Gridley's comments regarding these Mitigation Measures, prior to taking the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, and that said initial study identified significant potential environmental effects, that revisions in the project made by, or agreed to by the applicant before the proposed mitigated negative declaration and initial study were released for public review would avoid the effects to a point where clearly no significant effects would occur, and a Mitigated Negative Declaration is proposed. B. Find that the Board of Supervisors has considered the proposed Mitigated Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Board of Supervisors, including the Initial Study and comments received pertaining to it, the Agenda Report dated August 22, 2000, and October 10, 2000, and all other oral and documentary evidence received,that there is no substantial evidence that the Use Permit for Chander Sidher, Planning Division File No. UP 00-10, as mitigated, will have a significant effect on the environment. D. Find that the proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. E. Adopt the Mitigated Negative Declaration regarding environmental impacts, with Mitigation Measures 1 thru 4, as detailed in the Agenda Report dated October 10, 2000, and authorize the Chair to sign. i� F. Find that this Mitigated Negative Declaration conforms to Section 15074.1 of CEQA, 601 which allows for substitution of a mitigation measure in a proposed Mitigated Negative Declaration, provided that the new measure is equivalent or more effective in mitigating or avoiding potential significant effects. A revised mitigation measure has been provided by CalTrans, which constitutes a substitution of CalTran's previous mitigation measures, and is more effective in mitigating the project's traffic impacts on SR 99 than the previous measure. ,✓���G II. Deny the appeal, and approve Use Permit 00-10 for Chander Sidher, subject to the conditions found in Exhibit "A", and subject to the following findings: A. Installation of underground fuel tanks and storage of hazardous material shall be in accordance with Environmental Health Department Conditions #13 and #14. 6. Installation of on-site sewage disposal systems shall be provided for the Regional Water Quality Control Board's Needs for Waste Disposal from Land Development, in accordance with Condition#15. The property is designated as Industrial by the General Plan. Proposed store hours are 5:00 a.m. to 12:00 a.m. There are no curb, gutter or sidewalk improvements where the property fronts.West Liberty Road and State Route (SR) 99. ANALYSIS The California Department of Transportation has completed a detailed traffic impact analysis of this project's impact on SR 99. CalTrans indicates that the offset of Hollis Lane and West Liberty Road at SR 99 presents an undesirable situation, which was created over 30 years ago when the Hollis Lane Subdivision was approved. The project's impact would double the total number of turning movements at these locations. Delays and conflicts would increase, and the number of collisions may probably increase if no significant improvements associated with this project are required. In order to mitigate the traffic impacts of this development, CalTrans recommends that a traffic signal be installed at the West Liberty Road intersection with SR 99. In addition, CalTran's recommends providing a second northbound through-lane through the intersection, widening West Liberty Road to provide two eastbound traffic lanes approaching SR 99, and increasing the setback of the project's frontage improvements along the highway to allow for the construction of another southbound through-lane in the future. ti/o�k ��5 � k1:� e:�y' /ZX' /0 5 CalTrans indicates that the cost for develo/g"these improvements are to be borne by the developer. CalTrans recommends that five lanes be developed at the West Liberty Road intersection with SR 99. Funding for this new road connection must be developed locally. The County does not collect traffic impact fees to pay for these recommended improvements. Comments From the City of GridleX The County's General Plan Land Use Element outlines policies for the Gridley-Biggs Area Land Use Plan. These policies indicate that the County coordinate land use planning with the City of Gridley, and that development standards compatible with the City of Gridley be utilized for urban development projects within the City's established sphere of influence (SOI). Although this project is not located within Gridley's SOI, the SOI is located directly across SR 99 to the east, and across West Liberty Road to the north of the project site. Staff contacted the City of Gridley regarding the new Mitigation Measures proposed by CalTrans. The City indicates that, while a traffic signal will improve the existing hazardous conditions at the West Liberty Road/SR 99 intersection, alignment of Hollis Lane with West Liberty Road is still necessary to completely address traffic impacts of the project. The City strongly encourages the County to take the steps necessary to acquire the right-of-way needed to reroute Hollis Lane in accordance with CalTran's long-term recommendation outlined above. The City also indicates that this measure will enhance circulation to the industrial land located within the City's SOI north of this project. Review Under the California Environmental Quality Act ,CSA) Section 15074.1 (b)(2) of CEQA allows for substitution of a mitigation measure in a proposed Mitigated Negative Declaration, provided that a written finding is made that the new measure is equivalent or more effective in mitigating or avoiding potential significant effects and that it in itself will not cause any potentially significant effect on the environment. The revised mitigations as provided by CalTrans constitutes a substitution of Ca1Tran's previous mitigation measures. According to CalTrans, these new measures are found to be more effective in mitigating the project's traffic impacts on SR 99. RECOMMENDATION: ACTION FOR CONSIDERATION Staff recommends that the Board of Supervisors consider the new Mitigation Measures provided by CalTrans concerning traffic impacts, and the City of Gridley's comments regarding these Mitigation Measures, prior to taking the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. Find, on the basis of the whole record before the Board of Supervisors, including the Initial Study and comments received pertaining to it, the Agenda Report dated August 22, 2000, and October 10, 2000, and all other oral and documentary evidence received, that there is no substantial evidence that the Use Permit for Chander Sidher, Planning Division File No. UP 00-10, as mitigated, will have a significant effect on the environment. D. Find that the proposed Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. E. Adopt the Mitigated Negative Declaration regarding environmental impacts, with Mitigation Measures 1 thru 4, as detailed in the Agenda Report dated October 10, 2000, and authorize the Chair to sign. F. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not recommended. III. Deny the appeal, and approve Use Permit 00-10 for Chander Sidher, subject to the conditions found in Exhibit "A", and subject to the following findings: A. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Prior to use of the site for the proposed use the applicant shall contact the Planning Division for a field inspection to verify that all conditions and ordinance requirements have been met. t 7. The applicant shall comply with all applicable State and local statutes, ordinances and regulations. Conditions of Approval: Planning Division: 1. The applicant shall erect a fence along the Union Pacific Railroad of sufficient design and height to discourage trespass along the railroad property. The fence shall run parallel to the developed portion of the property. This fence shall be installed prior to any issuance of a certificate of occupancy for this project. 2. In accordance with Butte County Code Section 24-240.10 (e), 5-percent of the gross lot area, approximately 3,900 sq.ft., shall be devoted to landscaping. California Department of Forestry/Butte County Fire Department 3. The following mitigation measures are required to address Public Resources Code 4290 (Fire Safe Regulations). They shall be completed to the satisfaction of the California Department of Forestry, prior to issuance of a certificate of occupancy for the project. (Mitigation Measure #2) A. Building identification and/or addressing shall meet Public Resources Code 4290 (Fire Safe Regulations). B. Provide an all weather access of at least 10 feet wide with a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus to all structures. C. The applicant shall be required to meet the California Building Code and California Fire Code requirements for the type of occupancy and related fire hydrant requirements. Reclamation District #2056 4. Prior to site development the applicant shall mitigate increased storm water runoff to Reclamation District #2056 and Drainage District #1. This shall be accomplished by providing an engineered study to the District Engineer for Reclamation District #2056. If storm drainage continues to drain into Drainage District #l, the increased flow shall not increase the water surface elevation within the District. In addition, the discharge from the site shall not exceed a 10-year pre-development flow-rate. All storms up to a 200-year event shall be considered in the analysis. If storm drainage is redirected to a Drainage District #2056 canal, the discharge from the site shall not exceed a 20-year pre-development flow- rate. All storms up to a 100 year event shall be considered in the analysis. The City of Gridley Improvement Standards shall be used for runoff coefficients, rainfall intensity, and other associated design criteria. Drainage District #1 and Reclamation District #2056 shall review and approve all designs and plans. Satisfaction of this condition should be coordinated with Condition 910, which requires the submittal of drainage plans acceptable to the Department of Public Works. (Mitigation Measure #3) California Department of Transportation 5. The following mitigation measures are required to be performed to the specification of the California Department of Transportation, prior to issuance of a certificate of occupancy for the project, in order to address the project's traffic impacts on SR 99. An encroachment permit is required for all work within the State right-of-way.(Mitigation Measure #4) A. Install a traffic signal at the West Liberty Road/SR 99 intersection B. A second northbound lane must be provided through the West Liberty Road/SR 99 intersection, to begin at least 200 feet to the south of the intersection. C. In coordination with the Department of Public Works, West Liberty Road must be widened to provide two lanes approaching SR 99. Each lane must be at least 100 feet long. D. The project's frontage improvments along SR 99 must be setback to allow for another southbound through lane in this area in the future. This may require the relocation of at least one utility pole. Right-of-way dedication to CalTrans may be necessary. E. The driveway location on SR 99 must be signed to prohibit left turns onto the highway. F. This project's mitigation measures shall be coordinated with CalTran's project to install street lights in this area. Department of Public Works 6. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 7. Prior to the issuance of building permits deed to Butte County, in fee simple, 40 feet of right- of-way from the centerline of West Liberty Road. The right of way shall be sufficient for the installation of standard No. S-5 at all street intersections. 8. Prior to the issuance of building permits submit road and drainage improvement plans for the installation and construction of the street frontage improvements on West Liberty Road and State Route 99 to RS-1 standard, including but not limited to P.C.C. curb, gutter and sidewalk and the required street section for parcels with gross acreage of one acre or less. Construct or install the required improvements. 3 9. Prior to the issuance of building permits dedicate a one foot "no access strip" or relinquish abutter's rights to Butte County, along the West Liberty Road and State Route 99 frontage of parcel except at approved access points. 10. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Environmental Health 11. The applicant must comply with all Public Health Department requirements for the provision of domestic water supply to the public. 12. Owner/operator of any proposed Food Establishment shall submit plans to Environmental Health for the approval (prior to construction) and shall meet all applicable requirements of the California Uniform Retail Food Facilities Law (CURFFL). Owner/Operator of a Food Establishment shall submit an application and fee to Environmental Health for a Permit to Operate a Food Establishment and obtain such permit prior to opening. Such permit can only be issued after an inspection by Environmental.Health verifies that the Food Establishment is in compliance with CURFFL. 13. Prior to installation of Underground Storage Tanks (UST's), obtain plan approval and installation permit from Environmental Health. Obtain a permit to operate UST's prior to fuel sales. 14. Prior to storage of fuel or other hazardous materials at facility, submit a Hazardous Materials Release Response Plan to Environmental health. Regional Water Quality Control Board 15. Prior to operations, the applicant shall submit the information required for a determination of the Regional Water Quality Control Board's (RWQCB)Needs for Waste Disposal from Land Development. Upon review of this information, the RWQCB shall determine if Waste Discharge Requirements are necessary. Upon finding that Waste Discharge Requirements are necessary, the applicant shall submit a Report of Waste Discharge and filing fee to the RWQCB at least 120 days before it is expected that any wastewater will be discharged. (Mitigation Measure#1) Air Quality Management District 16. The applicant shall obtain a District Authority to Construct Permit from the Air Quality Management District, prior to site development. 1 Pacific Gas& Electric 17. The Pacific Gas & Electric Company indicates that both gas and electric facilities are in the subject area. An existing 8 inch gas transmission line is located 10 feet north of the south property line of West Liberty Road. Any grading over this line is subject to review by PG&E. Detailed grading plans will be required for review to determine conflicts and any possible relocation work in order maintain minimum cover over the pipe and to protect the pipe. Any relocation or rearrangement of PG&E facilities to accommodate the project will be at the developer's expense. There shall be no building of structures or the storage of any materials over or under any existing PG&E facilities. This letter supercedes our letter of March 29, 2000, from Dennis Azevedo, Chief of the Office of Rural Regional Planning. Existing Conditions Highway 99 has a total of five lanes just north of the W. Liberty Road intersection. There are two through lanes in each direction, with a left turn lane in the middle. One of the southbound through lanes is trapped into a right turn only lane at the W. Liberty Road intersection. There is only one northbound through lane at this intersection. Highway 99 had an average of 16,000 vehicles per day in this area in 1998. West Liberty Road had 3090 vehicles per day when it was counted in 1995. On Wednesday, March 10`h, 1999, Caltrans staff counted all vehicles that passed through the W. Liberty Road intersection with Highway 99 from 4:30 to 6:30 PM. These counts were used as a base for this analysis. It is difficult to make left turns from W. Liberty Road at certain times of the day, and it is likely that some drivers take alternate routes to avoid making this left turn movement. There has been an average of one collision per year in the past five years that was related to this turning movement. This is about average for this type of intersection. There is only one signal warrant (out of eleven) that is fully met at this time, and that is the System Warrant. Caltrans does not have a project scheduled to install a traffic signal at this intersection, although a project to install street lights in this area has been initiated. Hollis Lane intersects Highway 99 about 60 meters (200 feet) to the south of the W. Liberty intersection. This offset only allows for short left turn lanes to be striped on the highway for each intersection. This means that drivers making a left turn must slow down in the through lanes and/or drive across the centerline that separates these two turn lanes. This situation is not desireable, but it was created over 30 years ago when the subdivision on Hollis Lane was approved. r, V �q...��� a Mr. Dan Breedon Page 2 of 3 Project Impacts This proposed development includes a 3300 square foot convenience store, and. gas pumps with 12 fueling positions. According to the Institute of Transportation Engineer's publication "Trip Generation, 6' Edition", this development could generate over 300 vehicles turning in or out of the driveways in the PM peak hour based on the size of the market. It would generate over 2000 turning movements per day at the driveways. Land Use Code #845, Gas Station with Convenience Market, was used. Most of the turning movements at the W. Liberty Road driveway would also require a turning movement at the W. Liberty Road intersection with Highway 99. It is estimated that this development would generate over 70 left turns onto the highway in the PM peak hour. This is much greater than the 44 left turns from West Liberty Road that were counted between 5:00 and 6:00 PM in March of 1999. The total number of turning movements in this.area would more than double with this development. Delays and conflicts would increase, and the number of collisions would probably increase if no significant improvements were required. It is estimated that five signal warrants would be met soon after this development is occupied. This development would also generate increased pedestrian activity in this area, including crossings of the highway to the residential areas. This could cause safety problems also. Long Term Improvements In the future, a traffic signal will be needed at the W. Liberty Road intersection with Highway 99, as well as five lanes on the highway through this intersection. The Gridley General Plan calls for the realignment of W. Liberty Road to line up with Hollis Lane. This would be an expensive and difficult project due toAhe at-grade railroad crossing and the additional right-of-way that would be required.It may be better to plan for a new road directly across from the existing W. Liberty connection to Highway 99. The property that would be directly affected has a house and anorchard on it at this time,but it is zoned for commercial and residential development. A connection from Hollis Lane to this new road should also be planned. This would also eliminate the need for left turn movements from the highway at the existing Hollis Lane intersection, which would allow for a longer left turn lane to be striped on the highway for W. Liberty Road. Project Mitigation Measures In order to mitigate the traffic impacts of this development, a traffic signal must be installed at the W. Liberty Road intersection with Highway 99. To reduce the effects of the short left turn lane to W. Liberty Road, and to reduce the stacking of northbound vehicles through the Hollis Lane intersection, a second northbound through lane must be provided through the intersection. This second lane would have to begin at least 60 meters (200 feet) to the south of the intersection. Little, if any, widening would be required along the easterly side of the highway to provide this second lane, but the highway would have to be overlaid and re-striped. West Liberty Road must be widened to provide two lanes approaching the highway. Each lane should be at least 30 meters (100 feet) long. This may require the relocation of at least one utility pole. Right-of-way dedication to Caltrans.may be . necessary. The driveway location on the highway that is shown on.the preliminary site plan appears to be acceptable,but it will be signed to prohibit left turns onto the highway. It does not appear to be necessary to install curb, gutter, and sidewalk from this driveway to the southerly property line. It would have to be removed and replaced in the future. This project's mitigation measures would have to be coordinated with Caltrans' project to install street lights in this area. We understand that an appeal of the Planning Commission's decision will be heard by the Board of Supervisors on August 22"d. Our concerns are related to issues identified in a memorandum from our City Engineer Ray Rolls on March 7, 2000. Hollis Lane and West Liberty Road form an offset intersection at the location where Highway 99 changes from four to two traffic lanes. The construction of a mini mart and yet another offset entrance onto Highway 99 will compound an existing traffic problem. While this property is not located within the City of Gridley or our sphere of influence, its proximity to the Hollis Lane area(included within our sphere of influence) raises concerns about traffic safety that will impact an area we plan to annex in the future. These issues were brought to the attention of both County'staff and Cal Trans earlier this year. The County staff report on this matter (page 22) doesn't accurately address our concerns. The report contains the following statement "The City agreed that although realignment would be the best approach to increasing traffic safety and circulation, the proposed improvements would adequately address the traffic impact presented by the proposal at this intersection. " Please be advised that this statement does not reflect the position of the Gridley City Council or staff. We believe that approval of the proposed project would aggravate an already unsafe situation. We are unaware of any current proposal that mitigates traffic impacts at this location.
