We most likely would not get comments from State agencies due to the short time period (most of the time State agencies don't comment or show up for the meeting anyway). Friday (Dec. 12)would be the best day, with morning (10-12) probably being the best time. I will have to find an open conference room, though. The recommended form of sewage disposal, in accordance with the City of Chico's Area of Joint Cooperation Plan, is community sewer. Should an on-site sewage disposal system be necessary it will require the approval of RWQCB. The water system shall be an approved community system such as Cal Water. • The fueling station will require permits for underground fuel storage tanks. • The retail food service and the grocery store will require permits form our office. • Solid waste disposal will require approval from our office. • The siting of the storm drainage system will need approval from our office. • A hazardous materials business plan will be required. We have a septic application dated October 17, 2003 from Jeff Farrarin our file. Ground water monitoring was begun on the site under this application. If you desire we will roll the fee received for this application over into a pre-application for the parcel map you mentioned intending to do as part of this project. A pre-application is normally required to be completed prior to submission of an application for a parcel map with the Department of Development Services. CA 95927 (530) 895-4851 Fax (530) 895-4726 http://www.ci.chico.ca.us December 11, 2003 Stephen Betts, Senior Planner Development Services Department Planning Division 7 County Center Drive Oroville, CA. 95965-3397 Subject: APN: 006-400-025 through 029, Pre-Development Review for PACLAND Dear Stephen: Thank you for the opportunity to comment on this proposed commercial redevelopment of 20 acres. with a 208,300 square foot retail building and parking facilities for 1,039 vehicles, located north of the intersection of Garner Lane and the Esplanade. The City Planning Division forwards the following comments: 1) The City recommends that the County deny the use permit because the proposed development is located on property that is unserved by sanitary sewer. The use of on- site wastewater treatment for a retail facility of this scale and intensity does not appear appropriate. 2) Connection to sanitary sewer, which would need to be extended from its location at Eaton and the Esplanade, requires annexation to the City of Chico. It is not known whether the project site can be served by gravity flow,the unknown being the crossing of Mud/Sycamore Creek. 3) Should the County conduct environmental review (which is not required for projects that are denied),the City recommends that an environmental impact report be prepared that addresses aesthetics, hydrology and water quality, land use and planning, population,and housing,public services,transportation/traffic,and utilities and service systems (as well as any additional impacts that may be identified). Cumulative and growth-inducing impacts should be addressed, and the required analysis of project alternatives should include discussion of potential alternative sites that may be environmentally superior. 4) As noted above, and with comments sent recently for the Guernsey and Hauslet subdivision proposals, traffic analysis should be required to assess impacts to area g�� Made From Recycled Paper roadways, particularly SHR 99 at Garner Lane and Eaton Road. At a minimum, improvements should be consistent with the "Garner Lane - Mid to Long Term Alternative"plan(copy attached)from the Chico Corridor Study prepared for the Butte County Association of Governments in January, 2001, and the improvements mentioned in 5, 6 and 7. 5) Garner Lane should be improved with full urban improvements to the 2-lane collector standard. 6) Esplanade/Garner Lane Realignment: the realignment as shown could be considered. 7) Esplanade: Full urban improvements should be required consistent with the results of the current planning effort for the Northwest Chico Planning Area Specific Plan. 8) Provide a circulation and parking analysis should be provided. 9) Storm drainage will need to be conveyed to Mud/Sycamore Creek. The lines will need to be sized for the entire tributary area identified as 776-44 (copy attached). Preliminary sizes show a 60 inch outfall. The project developer will be responsible for storm drain and sewer improvements on Garner Lane as well as in the Esplanade. 10) The fire flow requirements for a building of 208,300 square feet and protected by automatic fire sprinklers would 6,000 gallons per minute. This would require a minimum of 4 public fire hydrants. 11) The minimum turning radii of 28 feet inside and 48 feet outside should be provided for on-site circulation. 12) Access roads less than 36 feet require Fire Lane No Parking identification on one side and roads less than 28 feet require Fire Lane No Parkin identification on both sides. DEC 12 20M DEVELOPMENT SERVICES Stephen Betts Butte County Planning Division 7 County Center Drive Oroville, CA 95965-3397 PRE-APPLICATION COMMENTS ON PROPOSED PACLAND SHOPPING CENTER, GREATER CHICO,BUTTE COUNTY We have reviewed a pre-application package for a proposed shopping center just north of Chico. The project proponent, PacLand proposes to construct a 208,300 square-foot shopping center on 20.02 acres of land. According to our information, the nearest regional sewer is 1.4 miles from the project location. Therefore, on-site sewage disposal is proposed. We have the following comments on the proposed project. Wetlands and/or stream course alteration—The project proponent may need to apply for a Clean Water Act Section 404 permit(§404 permit) from the U.S. Army Corps of Engineers. A §404 permit is required for activities involving a discharge of dredged or fill material to waters of the United States. "Waters of the United States" include wetlands, riparian zones, streambeds, rivers, lakes and oceans. The Army Corps of Engineers Butte County contact for §404 permits is Ms. Laura Whitney, (916) 557-7455. Projects requiring a §404 permit also require a water quality certification(pursuant to Section 401 of the Clean Water Act) verifying that the project does not violate State water quality standards. A water quality certification is required for any project that impacts water of the State (such as streams and wetlands). Activities that fall under the water quality certificationprocess include, but are not limited. to: stream crossings, the modification of stream banks or stream courses, and the filling or modification of wetlands. A water quality certification must be obtained prior to construction. Failure to obtain a water quality certification, when required, may result in enforcement action. Industrial storm water—The USEPA on 16 November 1990 promulgated storm water regulations (40 CFR Parts 122, 123 & 124) which require specific categories of industrial facilities discharging storm water to obtain NPDES permits and to implement Best Available Technology Economically Achievable (BAT) and Best Conventional Pollutant Control Technology (BCT) to reduce or eliminate industrial storm water pollution. Aggregate will be mined and processed at the site. As such, Standard Industrial Classification (SIC) 1442 (Construction Sand and Gravel) applies. Operations with a 1442 SIC code must be covered by a General Permit for Discharges of Storm Water Associated with California Environmental Protection Agency �a Recycled Paper 'y Stephen Betts - 2 - 10 December 2003 Industrial Activities. Construction storm water - A Construction Activities Storm Water Permit is required for storm water discharges associated with a construction activity where clearing, grading, and excavation result in a land disturbance of one acre or more.. Storm water discharges from construction activity that results in a land disturbance of less than one acre, but which is part of a larger common plan development of one acre or more, also requires a construction storm water permit. A construction storm water permit, if required, must be obtained prior to construction. Failure to obtain a construction storm water permit, when required, may result in enforcement action. Construction sto--n water permits can be obtained from Scott A. Zaitz(see above contact information). Dewatering Alternative 1: discharge to storm drains or waters of the United States - A dewatering permit, General Order for Dewatering and Other Low Threat Discharges to Surface Waters, may be required for construction activities. This general NPDES (National Pollutant Discharge Elimination System)permit covers the discharge to waters of the United States of clean or relatively pollutant-free wastewater that poses little or no threat to water quality. The following categories are covered by the dewatering permit: well development water; construction dewatering; pump/well testing; pipeline/tank. pressure testing; pipeline/tank flushing or dewatering; condensate discharges; water supply system discharges; miscellaneous dewatering/low threat discharges. The dewatering permit applies only to direct discharges to waters of the United States. Failure to obtain a dewatering permit, when required, may result in enforcement action. An application form and a copy of the permit are available at this office. Dewatering Alternative 2: discharges to land - Construction dewatering discharges that are contained on land (i.e., will not enter waters of the United States) are allowed under a general waiver adopted under Regional Board Resolution No. R5-2003-0008,provided the following conditions are met: (1) the dewatering discharge is of a quality as good as or better than underlying groundwater; and (2)there is a low risk of nuisance. Examples of dewatering discharges to land include a terminal basin, irrigation (with no return to waters of the United States), and dust control. You may request written confirmation from this office that the waiver is applicable. Wastewater treatment and disposal - On-site disposal of wastewater may require issuance of Waste Discharge Requirements by the Regional Board. The City Planning Division forwards the following comments: 1) The City recommends that the County deny the use permit because the proposed development is located on property that is unserved by sanitary sewer. The use of on- site wastewater treatment for a retail facility of this scale and intensity does not appear appropriate. 2) Connection to sanitary sewer, which would need to be extended from its location at Eaton and the Esplanade, requires annexation to the City of Chico. It is not known whether the project site can be served by gravity flow,the unknown being the crossing of Mud/Sycamore Creek. 3) Should the County conduct environmental review (which is not required for projects that are denied),the City recommends that an environmental impact report be prepared that addresses aesthetics, hydrology and water quality, land use and planning, population,and housing,public services,transportation/traffic,and utilities and service systems (as well as any additional impacts that may be identified). As you know, the site is zoned Commercial, C-2. In the C-2 zone, all C-1 uses are allowed outright, including retail. The C-1 zoning classification does not place any size restrictions on these uses. In our meeting we also discussed the section of the C-2 zoning code, which states, "shopping centers greater than 5 acres require a separate use permit approval." At the time of our meeting, we were not able to provide many specifics on how the site would likely be developed and whether the development should'formally be classified as a shopping center. To follow-up on this discussion, we have prepared the enclosed Site Plan, reflecting a single tenant. For your review, we have summarized below industry standard and other jurisdictions' municipal code definitions of the term "shopping center" to establish the fundamental characteristic of that specific type of development. Urban Land Institute Definition As you know, the Urban Land Institute (ULI) provides industry standard definitions and guidance regarding development, and the American Planning Association (APA) frequently uses the ULI publications. The ULI defines a Shopping Center as, "a group of architecturally unified commercial establishments." They also list the elements, which "characterize the Shopping Center and set it apart from other commercial land uses." One fundamental element, which is carried through the ULI definitions, is the presence of multiple tenants. The ULI also distinguishes between department stores and shopping centers. Municipal Code Definitions Furthermore, there are numerous jurisdictions that have defined "shopping centers" in their respective codes, which also reflect a shopping center being defined by whether there are multiple tenants. For instance, both the City and County of Sacramento define "shopping center" as a group of stores or commercial establishments that have common facilities such as parking, signage, landscaping and loading areas. The common thread in these shopping center definitions is the multiple tenancies and commonly owned public areas. As noted above, this commonality necessarily relies upon different ownership and shared space. The shopping center concept does not apply to this proposed development because there is one tenant and no shared access to any public or common areas. Based upon the ULI definitions above, and use of the term"shopping center" by other jurisdictions, since the proposed development includes only a single retail tenant, this project would not be considered a shopping center; thus, a Use Permit is not required. The retail store use requires approval of a Use Permit. The retail store use requires approval of a Use Permit. The proposed retail store project would consist of the following elements: • A 208,300 square foot retail store with general merchandise, pharmacy, grocery, minor auto service, and garden supplies • 1,039 parking stalls • Access to the proposed store would be from both Esplanade and Garner Lane • Realignment of the existing Esplanade/Garner--ane intersection • Widening of Esplanade and Garner Lane, installation of curb, gutter, and sidewalk, and the relocation of existing utility poles Please refer to the attached Conceptual Site Plan prov_ded by the applicant for additional information on the proposed project. The application indicates that sewage disposal would be handled by an on-site septic system(s) and domestic water supplied via a public water system. The project site is located on the'northeast corner of Esplanade and Garner Lane, Chico. The project site is zoned C-2 (General Commercial), and has a General Plan land use designation of Commercial. The purpose of the pre-development conference meeting is to inform the applicant of local or state requirements that may apply to their project. The applicant proposes to develop a residential resort on approximately 411 acres adjacent to the eastern bank of Lake Oroville on the North Fork Feather River arm. The project includes home sites, a golf course, shopping center, restaurants and various other associated amenities. This residential resort project has the potential to significantly impact the water quality of Lake Oroville during and after construction. Lake Oroville is the largest reservoir of the California State Water Project and provides water to agencies around and downstream of it. Best management practices should be strictly adhered to during the construction phase to prevent water quality impacts to the Lake. In addition, this project should be designed to avoid any direct discharge of wastewater or surface runoff into Lake Oroville, treated or otherwise. During the early stages of this proposal, North American Guan Yin Pu Sa Inc. should identify.proposed methods for the collection, treatment, and disposal of wastewater and surface runoff from this project. have included a copy of our Property Management Map No. 04-24 depicting DWR's right of way in this area.
