(The Agricultural Buffer is a requirement found in the Agricultural Element of the General Plan applied to particular agricultural land use situations. Ida TSM Dear Mr. Mayer: We understand that time is critical for your project, due to expire August 30, 2003. We have not received plans showing how you will mitigate the peak runoff from your development to at or below pre-development levels, however if you propose publicly maintained drainage facilities then formation of a County Service Area (CSA) is necessary. The Constitutional notice requirements, related to establishment of maximum service charges in connection with a CSA, add a great deal of time to the process, so it is suggested that you start as soon as possible. In addition to the normal LAFCo application (available from the LAFCo'website at http://www.buttelafco.or.q/Home Page/Home Page.asp) you must provide the following information/materials are necessary before we can process your request: A. You must.submit an annual Operation and Maintenance budget for the Subdivision. This budget must clearly indicate the type of streetlights to be installed if any and the operation costs related to the storm drainage system. B. Application map and legal description conforming to State Board of Equalization (SBE) requirements must clearly show the type and location of the facilities to be maintained. The typical processing procedure'for this type of application is as follows: 1. Submission of Cost Estimates. � The, property owner's (Owner's) engineer must submit to Public Works, for review and approval, two estimates of the costs for operation and maintenance of the drainage facilities and street lights (if the Owner elects to install the lights, which.is not required), one estimate for the first year, and one estimate for the next two years. The cost estimates will be checked with the review of the plans. 2. Preparation and Mailing of CSA Petition, Ballot and Resolution. Upon receipt of satisfactory and for the costs in item 3 above, Public Works will, within 5 working days: prepare and mail to the Owner, the petition and ballot for signature; and prepare the Resolution. This Resolution will seek LAFCo action and will also start the County's Proposition 218 hearing process. Public Works will also forward copies of the approved budget estimates to LAFCo. 3. Return of Petition and Ballot; Board Agenda Request. When the Owner returns to Public Works the signed petition and ballot voting "Yes" for the proposed service charges, Public Works will request the Chief Administrative Officer to place the Resolution on the Board of Supervisors agenda for approval at the earliest regular meeting. Agenda requests must be submitted at least 14 days prior to the meeting date. Regular meetings of the Board are normally held twice each month, normally on the 2nd and 4th Tuesdays. 4. Proposition 218 Hearing. Upon adoption of the Resolution by the Board of Supervisors, the Clerk of the Board will send the Owner notification of the Proposition 218 hearing. The notice must be sent at least 45 days in advance of the hearing. The notice will include the date, time and place, and other information regarding the hearing and the Owners voting rights. The Owner will have the right at any time up to the close of the hearing to change his/her vote regarding the proposed service charges; however, if the final vote is "No" on the charges, the County will withdraw its request for LAFCo to approve formation of the CSA. 5. LAFCo processing. Upon adoption of the Resolution by the Board of Supervisors, the Clerk of the Board will forward a copy of the Resolution to LAFCo requesting approval of formation of the CSA. After receipt of the Resolution, LAFCo processing will occur as follows: a. Requirements for complete application. Upon receipt an application, copies of the approved budget estimates from Public Works (see item 1 above), and receipt of the required fees and deposit from Owner, LAFCo staff will review the application for completeness. This review will occur within 30 days from the date the Resolution is received. If the application is not complete and additional information is needed, a letter will be sent to Owner and Owner's engineer within the 30-day period requesting the needed information. CSA Formation Process Page 3 of 4 April 11, 2003 The fees and deposits include a $1,500 application deposit, a $25 per acre sphere of influence ("sphere") fee, and a check payable to the State Board of Equalization ("SBE") in the amount of$1,200. b. Staff Review and Report. When LAFCo receives all information, fees and deposits required to complete the application, LAFCo staff will start the review of the substance of Owner's complete application and will prepare a staff report and recommendation. c. Notice of LAFCo Hearing. The application must be scheduled for hearing by LAFCo within 90 days of LAFCo staff determining it is complete. The Owner will be notified of the hearing date, time and place. d. LAFCo Hearing. LAFCo will review the staff report and recommendation and open the hearing to the public, at which time Owner or anyone else may address the Commission, if they wish. e. LAFCo Action After Hearing. Assuming the CSA formation is approved by the Commission, LAFCo staff has 35 days in which to have LAFCo's resolution signed by the Commission Chairman and forwarded to the Board of Supervisors. LAFCo staff will prepare a proposed resolution for adoption by the Board of Supervisors. (We will refer to this second Board resolution as the "Action Resolution".) If LAFCo disapproves the application, all CSA formation proceedings will cease and the CSA will not be formed. f. Board of Supervisors Action After LAFCo Hearing. Upon receipt of the . LAFCo resolution and the proposed Action Resolution, the Clerk of,the Board of Supervisors will place an item on the Board's agenda to schedule a public hearing for CSA formation. The Board will set the hearing to be held at a meeting not less than 15 and not more than 30 days after LAFCo adopts its resolution. The Owner will be notified of the hearing date, time and place. g. Board of Supervisors Action Resolution. When the Board of Supervisors approves the CSA formation, the Board will adopt the Action Resolution and return it to LAFCo. h. Completion of CSA Formation. If the Board Action Resolution, map, and legal description are in order and all local and SBE fees and charges are paid, the LAFCo Executive Officer will submit a Certificate of Completion to the County Recorder for recordation. The fees and charges required at this stage are LAFCo fees exceeding the initial $600 deposit and SBE filing fees. Of course if annexation is not approved, the development project will generally not be able to continue as planned. Our process to determine completeness is not that different than yours...we need to fully understand the proposal submitted, including all land use plans that may become effective following annexation. Without such plans or a full understanding of the proposal, we would not be able to provide the Commission a full and complete review on which to make an informed decision. In essence, annexation without an approved project is a blank check. As I understand the process for submitting an application to Development Services, an applicant must first receive a preliminary approval from the Environmental Health Division as to the feasibility of the water and sewer needs of the project. Doug indicated at the Pre-development meeting that to gain a EH clearance for a project connecting to a district for sanitary sewer, the applicant must first be annexed to that agency which requires approval from LAFCO. The catch-22 is, for LAFCO to properly evaluate an annexation proposal, we must be able to at a minimum, review the project application (preferably the tentative or final map) that will alter the identified land use. In this case, the proposal for a 136 lot subdivision requires annexation to LOAPUD. It is also located within the Oroville Sphere of Influence and thus, our policies would expect the project to be developed consistent with the standards of the City of Oroville as the eventual future municipal service provider in the area. The City representative indicated that the City would require full urban improvements (curb, gutter, sidewalks) if it was a City project. The County indicated that these improvements would not be required. There in is the dilemma. Should LAFCO approve an annexation to LOAPUD without the benefit of an approved map to review, we would basically be allowing the project to go forward without any assurances that the County would require the appropriate urban improvements within the Oroville Sphere of Influence. This issue speaks to the need for Development Services to consider the inclusion of LAFCO in its predevelopment and IDR processes so as to allow a more comprehensive understanding of the inter-relationships between local agencies and their identified needs and concerns. Our comments on the application (project) are as follows: Potential traffic/circulation impacts; mitigation requested: • The proposed project will generate approximately 1,360 average daily trips, and approximately 136 peak hour trips (ITE Trip Generation). Based on the anticipated traffic volumes, the proposed project may generate potentially significant traffic impacts to the intersection of SR 162 and Wyandotte - Miner's Ranch Road. • Therefore, a focused Traffic Impact Study (TIS), which contains appropriate mitigation measures, should be provided for in the environmental document prepared for the project in accordance with the "Guide for the Preparation of Traffic Impact Studies" updated December 2002. .
