While there are no minimum parcel size or density requirements, the Butte County Airport Land Use Compatibility Plan 9 requires all major land use actions (more than five residential lots) apply for consistency (Section 1.5.3 (a)(1)). I have enclosed an ALUC application(Fee is $1,531.00). 2. An issue was raised with regard to the length of the cul-de-sac. Under Butte County Code (BCC 20-133), A cul-de-sac street in an urban area, as shown in appendix I of the design standards, shall not exceed five hundred (500) feet in length and shall not serve more than twenty(20) lots or parcels. 3. An exception to BCC 20-133 can be requested per BCC 20-4: The hearing body in an action relative to a matter before it may authorize exceptions to any of the requirements and regulations relative to the design of a subdivision. (1) Application. Application for any such exception shall be made by a verified petition of the subdivider or designated agent, stating fully the grounds of the application and the facts relied upon by the petitioner. In order for the property referred to in the petition to come within the provisions of this section, the hearing body must find that all of the following facts apply with respect to the subject property: a. That there are special circumstances or conditions of topography or size or shape or location or existing development affecting the property,which circumstances, conditions or development existed at the time the application for the map was determined or deemed to be complete. b. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the territory in which the property is situated. (2) Appeals. All determinations of the advisory agency may be appealed to the board of supervisors. (Ord. No. 3188, § 1(Exh. A), 3-14-95) 4. The proposed project must still apply for a pre-application review by Butte County Department of Environmental Health. 5. There will subdivision improvement requirements (not limited to what was given to you from Public Works, the Fire Department, Agricultural Commissioner, Department of Transportation and the California Regional Water Quality Control Board). 6. Drainage requirements require that no net increase in Peak Flow/Peak run-off. A retention or detention pond is a possible way to handle the drainage issue. 7. Review requirements of the Thermalito Drainage Plan. Please contact Eric Schroth at Butte County Department of Public Works at (530) 538-7266 to obtain a copy of get necessary information. 8. Get copies of the Abandominent Records for underlying streets. 9. There will be requirements of development impact fees required. Usually they apply at the time of applying for building permits for a residential dwelling. Impact fees include, but not limited to, School, Parks, and Sheriff. Please contact the Butte County Building Division at (530) 538-7541 for what impact fees apply 4.0 10. Street lighting was discussed. I've included the Lighting Standard per BCC 20- 152: Street lighting shall be provided as set forth below and in the improvement standards: (1) A street lighting system shall be furnished in place by the subdivider along all interior and boundary streets within all subdivisions in accordance with the standards set forth in the improvement standards of the county, except that only electrical outlets for lighting would be required where not detrimental to health and safety. (2) The electroliers and all appurtenances thereto shall be located within the street right-of-way or within easements dedicated for such purpose, and the electroliers shall be spaced along the street as required for the type of electrolier placed in accordance with the improvement standards of the county. (3)For single-family residential subdivisions having an average lot street frontage of more than one hundred twenty-five (125) feet,but not more than two hundred(200),feet, the street lighting system need not be placed along the streets, but shall, as a minimum, be placed at all street intersections, cul- de-sac and at other locations as required by the director of public works. (4)For planned developments, residential, commercial or industrial developments where the internal streets are not offered for dedication, a. street lighting system need not be installed on the internal nondedicated streets, but shall be provided by the developer on the external public street frontage. (5) Street lights'are not required for single-family residential subdivisions with an average lot street frontage of more than two hundred(200) feet. In determining the average lot street frontage, lots not designed for single- family residential use shall not be considered. 11. The City of Oroville sent over additional information that maybe required as part of the project 12. The Planning Division would prepare and environmental review of the project. Part of the environmental document could be mitigation measures to reduce potential environmental impacts. These mitigations are determined during the project review process. The project planner may decide after a thorough site inspection that additional studies are required. Possible studies include, but not limited to, wetlands delineation, archeological and/or traffic impact. Another issue that wasn't discussed at the pre-application meeting was it might be in your best interest to get copies of the creation deeds for the+three parcels and send to me. There could be an issue on how the parcels were created (in their current configuration). The CSA formation process will require the Developer to fund the service until the beginning of the first fiscal year in which service charges can be collected for the CSA, and agree to an annual maximum service charge to ensure continued operation of the facilities. B. DRAINAGE ® 1. Prior to approval of the improvement plans, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. ® 2. Prior to final improvement inspection by the Department of Public Works, all new drain inlets 0 shall be labeled with the county approved drain marker per County Standard S-40. ❑ 3.
