The following Agency/Department comments.are included with this letter: 1. Butte County Public Works 2. Butte County Environmental Health 3. Butte County Fire Department(CDF) 4. Agricultural Commissioner 5. Butte County Development Services(Planning Division) The following is a brief summary of the comments received: 1. Note that the Public Works condition A.14 (Streets) has been modified to require full improvements to the parcel frontage on Van Zant Lane. Please clarify with Public Works. 2. Environmental Health will require soil profile tests as well as water quantity and quality tests. 3. Butte County Fire standard conditions. See email document. 4. The Agricultural Commissioner's office did not submit written comments.- However, the meeting representative did point out that a 300-foot setback will be required because the property is designated OFC (Orchard and Field Crops). The setback applies to all property lines, and will affect the size,and number,of lots for the project. 1 In addition to the above, the Development Services Department, Planning Division, noted the following: 1. The property is heavily wooded with Blue Oak Trees, providing a significant flora and fauna habitat. Conditions will be applied that lead toward the protection of this woodland habitat. 2. The 300-foot buffer requirement mentioned above by the Agricultural Commissioner is confirmed by this Department. This letter informs you that in all likelihood the Department will recommend denial of the project to the Planning Commission if an application for a Tentative Parcel Map is submitted based on the map submitted for Pre- Development Review. Based upon your proposal as contained in materials submitted with your Pre-Development Conference application, the following items may be required for us to prepare an environmental evaluation: • Archaeological Study(survey for historic and pre-historic cultural resources) • Biological/ Botanical Study (survey for rare, threatened, or endangered plant and animal species) • Oak Tree Study • Sewer and Water Study Note that these issues are not exhaustive. Prior to or concurrently with the recordation of the Parcel Map, provide a fully executed road maintenance agreement for all non-publicly maintained access roads on the County approved form. A note shall be placed on a separate document which is to be recorded concurrently with the map or on an additional map sheet of the Parcel Map stating: "In accordance with Civil Code Section 845, maintenance of the road as shown hereon shall be shared by those properties with a legal interest in it." ® 2. All access rights shall be reserved by deed per County Ordinance, offered for dedication, and depicted on the Parcel Map. For each private access within the map boundary,place the following note on the Parcel Map: "approved road name is a non-exclusive easement for ingress, egress, road and public services purposes, to be reserved in deeds and is hereby offered for dedication to the County of Butte." ❑ 3. Prior to the recordation of the Parcel Map,demonstrate to the Department of Public Works that there is approved access conforming to County Code to each parcel from a publicly maintained road. ® 4. Prior to or concurrently with the recordation of the Parcel Map,Deed to Butte County in fee simple 30 feet of right-of-way from the centerline of Grubbs Road along the entire property frontage.
