Dear Mr. Hanley: This letter is intended to provide a summary of the information provided in the meeting held . on September 14, 2005, regarding your proposal for a Use Permit to develop a Church School and Retreat facility. The project site is located south of the intersection of Coal Canyon Road and State Highway 70, and on the west side of Coal Canyon Road, northeast Oroville. The following written comments are included with this letter: 1. Butte County Public Works 2. Butte County Fire (CDF) Department 3. Butte County Agricultural Commissioner 4. Butte County Assessor 5. California State Department of Transportation (SDOT). The following is a brief summary of the comments received: 1. Note that Public Works was not able to comment because of a lack of information. 2. Butte County CDF submitted their standard conditions. Note that building fire suppression systems will be required. 3. The Agricultural Commissioner will be requiring at least a 300 foot buffer between the property lines and any buildings or play areas allowed for children. 4. The Butte County Assessor's office notes that the property is,under a Williamson Act Contract. See Planning comments below. 5. The SDOT submitted a letter with several concerns. They include: Traffic impacts to the intersection of State Highway 70 and Coal Canyon .Road both north and south intersections; Hydrologic impacts to State Highway 70 drainage facilities; and, Encroachment permit requirements for work at the above intersections. In addition to the above, the Development Services Department, Planning Division, noted the following: 1 I. It was noted at theOeeting that there was the probability J*wetlands on the property. This was confirmed by U.S. Fish and Wildlife, and their mapping of these areas which became effective on September 12, 2005. See enclosed map. A study will be required to determine the extent of protected flora and fauna. 2. The property is within a Williamson Act Contract with a minimum size of 160 acres. We discussed the fact that the proposed use does not conform to uses permitted by the contract. Options were discussed including cancellation of the contract or the filing of a notice of non-renewal. 3. In addition to the above SDOT issues, staff noted that there would be significant impacts to Coal Canyon road. A traffic study would be required for this and the State issues mentioned above. 4. Environmental Health noted that ponds for sewer disposal are not allowed. Soils are poor for standard septic systems in the property area. These factors, and others, will have a significant bearing on the ultimate design and intensity of the project. Based upon your proposal as contained in materials submitted with your Pre-Development Conference application, the following items may be required for us to prepare an environmental evaluation: • Archaeological Study(survey for historic and pre-historic cultural resources) • ' Biological/ Botanical Study (survey for rare, threatened, or endangered plant and animal species) 0 Wetlands Delineation • Traffic Study • Noise Study • Sewer and Water Study Note that these issues are not exhaustive. Our comments.are as follows: More information requested to access potential State highway impacts: • The preapplication did not include a detailed site plan that delineated the proposed square footage of the proposed church, school, and related facilities, as well as number of students and parking spaces, location of the proposed facilities, topography and drainage pattern of the site, project phasing, proposed ingress and egress, and anticipated attendance for church services, parish hall, and retreat facility, Therefore, it is difficult to assess what the potential impact will to the State Highway System. If a formal application is submitted, then a site plan, which includes the above, referenced contents should be included in the application. Potential transportation/traffic.impacts; mitigation requested: ., ;4!,-.:,The proposed use can be expected to generate significantly higher volumes of traffic .;than the volumes from.the current.agricultural'use. Concerns have.been.and continue to be raised by local citizens regarding the number of gravel trucks using Wheelock Road and the potential degradation of the safety and operations of the Coal Canyon Road/Wheelock Road intersection with SR 70. Additional vehicle traffic from the prospective project's combined facilities may cause a significant traffic impact to this intersection. A copy of the guide can be downloaded at: http://www.dot.ca.gov/hq/traffops/developsery/operationalsystems/reports/tis ug ide.l)df. • The focus of the TIS should be at the intersection of SR 70 and Coal Canyon Road/Wheelock Road. The percentage of trips that can be expected from SR 70 south of the site including trips from SR 149, SR 99 and SR 191, and from SR 70 north of the.sitel-should be identified. It is assumed.that most of the trips would access the site from SR 70 at Wheelock/Coal Canyon rather than from the southerly access of Coal Canyon Road. • Depending on anticipated trips from this project, potential mitigation measures might entail improvements including, but not limited to, a right turn lane to Coal Canyon Road and left turn channelization at both Wheelock Road and Coal Canyon Road. • Caltrans recently took A.M. turning movement counts and P.M. turning movement counts at Coal Canyon/Wheelock Road and SR 70. These can be made available upon request. • Prior to commencing with the preparation of the TIS, we would like to meet with the County and the County's traffic consultant to review the scope of work. Potential hydrologic, hydraulic, and water quality impacts; analysis requested: • The contours on the preapplication diagram show that the project site drains towards the SR 70 right-of-way (ROW) and drainage facilities. The development of this site will increase impervious surface area through the construction of buildings, parking lots, and driveways with a corresponding increase in surface water (storm water) runoff. This development will decrease surface water detention, retention, and infiltration. The prospective project has the potential to create a significant negative hydrologic, hydraulic, and water quality impact to the State's highway ROW. Any cumulative impacts to the SR 70 ROW drainage facilities arising from the effects of P g g the development on surface water runoff discharge from the peak (100-year) storm event should be minimized through project drainage mitigation measures. • The project should be designed to insure that there is no direct or indirect net increase of runoff or backwater effects on to the SR 70 ROW drainage facilities. It is the developer's responsibility to ensure that runoff from the project site to the SR 70 ROW will meet all Regional Water Quality Control Board standards. Prior to recordation of the final map,'when a homeowner's association is required, obtain approval of the By-laws and CC&Rs by Butte County Environmental Health, and, if required, by the California State Regional Water Quality Control Board. Approval shall be obtained prior to recordation of the Final Map. a. Bylaws, Articles of Incorporation, etc., relating to wastewater authority and financing cannot be changed without approval of Board of Supervisors and Regional Board (exception: wastewater authority and financing may be assumed by a public entity at any time). b. Association cannot terminate its existence without approval of Board of Supervisors and Regional Board. Note: Sacramento County has covered the above two points by requiring Associations to include the County Board of Supervisors in the Association's name. C. Membership in Association is mandatory for all lots (perhaps by deed restriction). d. Association shall have power to inspect, monitor and report on the operation of all kinds of individual and collective wastewater facilities (including ground water monitoring wells). e. Association shall have power to maintain above wastewater facilities, including, but not limited to, pumping septage, discharging to alternate leachfields, repairing and replacing septic tanks, discharge lines and leachlines. f. Association shall have power to construct, or order construction, of new leachfields on same property or common property. g. Association shall have power to construct collective wastewater facilities if individual systems threaten public health or water quality. h. Association shall have power to,raise money to do all of the above by dues, liens, service charges or mortgages. i. Association shall have power to do all of the,above (except construction of collective systems) by action of Board rather than majority of homeowners. J. Association shall discharge monitoring and maintenance requirements with appropriately qualified personnel (wastewater treatment certificates or registered sanitarian) by contract or its own employees. k. Association shall provide for short and long-term reliability of treatment systems by: i. including reserve leachfield areas. ii. including easements for sewers. iii. including immediate reserve funds for operations until sufficient income is generated by homeowners. iv. contracting for maintenance and monitoring until its own staff is available and qualified. V. constructing required monitoring wells before discharge begins. I COMMUNITY SEWER SPECIAL NITRATE AREA ❑ 1. Prior to recordation of the final map, in accordance with'the Chico Area Nitrate Compliance Plan, provide for a connection to the public sewer, if practical and feasible. A determination that connection is not practical and feasible shall be made with the concurrence of the Central Valley Regional Water Quality Control Board and the Environmental Health Division. Note: Board staff is currently requiring a density of no greater than.one equivalent residential unit per acre for development on septic tanks where sewer is not available. ❑ 2. Prior to recordation of the final map, when connection to a public sewer is not feasible: a. Cancellation is not an easy endeavor. The State makes cancellation of williamson act contracts purposefully hard to discourage cancellations except in the most unusual of circumstances. The reason for this is the goal of the Williamson Act itself, to preserve agiculture. If cancellation was a simple process there would not be any incentive for a landowner to continue the contract if he can convert the land over to a non-ag use. The break in property taxes that the landowner receives comes at a price, maintaining an agricultural use for the extent of the contract. The desire to develop an alternative non-ag land use is definitely not cause to support cancellation of the contract. The other option provided for under the code is non-renewal, which you discuss in you email. This process esentially begins the non-renewal of the contract over a 9 year period during which taxes are raised incrementally until the non-williamson act tax is being paid. The chruch, shool, and parish hall is not considered an agricultural use under the Williamson Act Contract. So it appears that you are willing to wait the 9 years until the contract runs out under non-renewal to develop the church? If so, a Use Permit application is premature. The County cannot approve a use permit for a non-ag use on land subject to a Williamson Act Contract, even during non-renewal. The landowner would have to wait until the..contract is expired and then apply for a Use Permit. I hope that this information is helpful to your future meeting. So far, I've submitted an application but 7/27/2005 Page 2 of 2 r the map is still unfinished. Carl DU199 informed me that it falls under the WilliaMon Act. The parcel (AP 041- 140-065) is 160 acres. The client wants to split the piece with 90 acres for a school and the remainder for a church and parish hall. Would I be better off telling the client to leave it at 160 acres? I've reviewed the Williamson Act web site. It appears to be a question.of Cancellation vs. Nonrenewal. Alternate land use does not appear to be reason enough to cancel the contract. This leaves the question of nonrenewal. If we file for nonrenewal, this means we Icannot develop for 9 years...until the contract runs out. Last question. The Catholic Church plans have not yet gone to the drawing board...if you will. However, The Bishop knows what he wants as far as structures. They want to build a high school, elementary school and parking on the northern half of the property. The southern piece will have the new Church (1500 seats)and Parish Hall. As far as building sizes go, The present Church occupies an entire city block. This includes the Church, elementary school and administration buildings. So we're talking big buildings, lots of parking and athletic fields. Since the Church does not have any hard examples of buildings, etc., can I deal with this in a note on the map? I'm not only running out �.... of time, I've also exceeded my budget. Here in lies my dilemma.
