Predevelopment Conference Informational Sheet Attachment for Butte County Humane
Society(BHS)
Question 18. If institutional, indicate the major function, estimated employment per shift,
estimated occupancy, loading facilities, and community benefits to be derived from the
project.
The Butte Humane Society would like to build a 15,000 sq ft shelter to house, and
ultimately adopt to thepublic, approximately 100 dogs and 200 cats. We estimate
that 15 employees will be required for one shift per 24 hour period, and estimate
further that 2-3 volunteers will be on site at any given time. We would like to
have a residential caretaker on the property, as well. This person, or family, will
be the only human resident on the property.
We believe this facility will be a benefit to Butte County as, currently, the facility
in which the BHS operates is too small for the number of animals housed there.
A facility in North County will be very beneficial to both BHS and to Butte
County. BHS wants a facility that.will be comfortable for animals and inviting
for the public and volunteers. The communities in Butte County want a shelter
that does not euthanize healthy, adoptable animals, therefore, we believe our
adoption rate will increase in a better, more appropriate facility, and that the
public will readily support this project.
Question 19. If the project involves a variance, conditional use, rezoning application, or
any development permits, state this and indicate clearly why the application is required.
To date, no permits have been issued. Per County zoning regulations, the project
will involve a conditional use permit and BHS believes it will also involve a
variance on the septic system due to the percolation issues on the property.
Environmental Setting:

The project site is flat. There are no buildings on the property. It is
mostly grassland with a few trees. It is unknown what types of plants and
animals exist on the property, or what the cultural, historical or scenic
aspects are of the property.
33. Describe the surrounding properties, inlcuding information on plants and animals
and any cultural, historical or scenic aspects. Indicate the type of land use
(residential, commercial, etc...), intensity of land use(one-family, apartment
houses, shops department stores, etc...), and scale of development(height,

Directly to the south of the project site is a cattle/sheep ranch with a
single-family residence on it. Across Hwy 99 to the east is a Gentleman's
Club, a clothing store and a statuary shop. There do not appear to be any
other residences or businesses in,the area.

PRE-DEVELOPMENT CONFERENCE
INFORMATIONAL SHEET
The Pre-Development Conference is a chance to meet on an informal basis with County staff.
The Department of Development Services staff shall schedule a pre-development review meeting
that includes the applicant and/or applicant's representative and representatives from the
Development Services Department, Environmental Health division, Public Works Department,
County Fire Department, and any other'agency with applicable interest in the proposed
development site. The purpose of the meeting is to inform the applicant of local, state and/or
federal requirements that may apply to their project. This allows the applicant an advanced
opportunity to incorporate those requirements into the design of the project prior to the actual
application being formally submitted.
Any direction given shall be preliminary and is subject to further refinement or change as the
application progresses to and through the formal application process. Following the meeting, the
Development Services Department shall send a letter to the applicant summarizing what was
discussed, including any additional filing requirements for the formal application.
The Pre-Development Conference is held in the Development Services Department Conference
Room A, located at 7 County Center Drive, Oroville. Please refer to the attached County of
Butte Environmental Information Form for submittal requirements. Include a concept site plan,
if available. The more information you subrrut at this stage will help us evaluate your project
more fully. The fee is $1,576.00 and a meeting is usually arranged within two to four weeks,
depending on the complexity of the project and current work load of County staff. If you have

A. STREETS
❑ I. Prior to the issuance of building permits,obtain encroachment permit for all new or existing driveway
approaches and construct them to County standards,as specified in County Improvement Standards.

installation of Standard No. S-5 at all street intersections.

B. DRAINAGE
❑ 1. Prior to the recordation of the issuance of building permits, a plan for a permanent solution for
drainage shall be submitted to and approved by the Department of Public Works. The drainage plans
shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or
publicly maintained drainage channel or facility and shall provide that there shall be no increase in the
peak flow runoff to said channel or facility.
❑ 2. Prior to the issuance of building permits, establish 100 year floodplain elevations and the lowest floor
elevations for any structures. Show on the site plan map for building permits the elevations (by
contours)and the location of an accepted NVGD benchmark and a temporary benchmark on-site.

H. BUILDING PERMITS
❑ 1. Building Permits Required. Prepare# sets of construction plans and make an application for
permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared,
sealed and signed by a California Licensed Architect or Registered Engineer for non-residential
buildings and certain residential buildings.
❑ 2. Proposed improvements constitute,a"change in use"or"change in the character of use"as stated in
the building code. Improvement plans shall incorporate all code-required elements for the new use.

regulations. A FEMA Elevation Certificate,prepared by a qualified professional, shall be completed
and submitted with improvement plans for the Building Division.

J. FIRE CLEARANCE
❑ 1. Construction, installation or development of buildings and/or roads, driveways, gates and
bridges on parcels/lots shall comply with the latest California Fire Safe Regulations—Public
Resources Code 4290, 4291 and current Butte County Improvement Standards, whichever is
stricter.
❑ 2. Prior to construction, a pressurized community water system for fire protection is
required. Bonding may be allowed with the approval of the County Fire Chief. Average
required hydrant spacing is feet, hydrant size inches, and residual fire flow of
GPM. Fire hydrant identification, road reflectors or post reflectors acceptable to
the County Fire Chief shall be installed or bonded, prior to Parcel or Final map recordation.
Submit plans to the Fire Department for review and approval prior to construction.
❑ 3. Place a note on a separate document and recorded concurrently with the Parcel, Final map or
an additional map sheet stating that "Fire suppression sprinkler systems shall be installed in
all new residential dwellings in accordance with NFPA Standard 13D, unless a pressurized
community water system with hydrants that meet Fire Department specifications serves the
property." A note stating "Automatic Fire Sprinklers conforming to NFPA Standard 13D
required"is to be added to all affected building plans.
❑ 4. In lieu of hydrant installation, prior to recordation of the Parcel or Final map, payment shall
be made into the hydrant fund at the current rate per lineal foot of street frontage.
❑ 5. Prior to building construction, provide an all weather access of at least 10 feet wide and
vertical clearance of 15 feet that will allow for ingress and egress and accommodate a
40,000-pound fire apparatus to within 150 feet of all structures.

Final map, or on an additional map sheet stating, "Building identification and/or addresses
shall be installed in conformance with Public Resources Code 4290 and shall be posted at

The Butte County Department of Development Service,Planning Division, has received a request
for a pre-application conference regarding the above referenced parcels. The property is currently
zoned A-40 (Agricultural with 40-acre parcels), with a General Plan designation of OFC (Orchard
&Field Crops). A project description and map are enclosed.
The purpose of the meeting is to inform the applicant of local or state requirements that may
apply to their project. This allows the applicant to incorporate those requirements into the design

Re: Pre-Development Review for a Use Permit for the relocation and expansion of the Butte
County Humane Society Animal Shelter. The parcel location is on the west side of State
Highway 99, approximately one mile north of Cana Highway, and a half a mile south of
Hamilton-Nord-Cana Highway, at 15521 Highway 99, APN 047-100-187.
Dear Ms. Augros:
This letter is intended to provide a summary of the information provided in the meeting held on
October 5, 2005,regarding your proposal for a Use Permit for the relocation and expansion of the
Butte County Humane Society Animal Shelter.
The following written comments are included with this letter:
1. Butte County Environmental Health
2. Butte County Department of Public Works
3. Butte County Fire (CDF)Department
4. Butte County Agricultural Commissioner
5. Department of Transportation(Caltrans)
6. California Regional Water Quality Control Board.
The following is a brief summary of the comments received:
1. Major concern is that property is unable to support a standard sewage disposal system for the
proposed use. Current Environmental Health Department policy is to not allow an
engineered sewage disposal system for initial development on an existing lot.
2. Concern over the total water use of the facility. Projected amounts would be based on the
number of employees/volunteers, activities, clinic, and number of animals. A permit for a
non community water system will be required.
3. Public Works determined that additional information will need to be submitted with regard to
a plan for permanent solution for drainage. Requirement of right-of-way dedication will also
be required on Hamilton-Nord-Cana Highway.
4. Butte County CDF will require fire suppression sprinkler systems to be installed in all new
commercial structures.-A pressurized community water system if available or the creation of
a private water system for fire protection is required. There will also need to be a 10-foot
wide and 15-foot high clearance to all structures.

5. The Agricultural Commissioner may require an agricultural buffer from adjacent agricultural
uses.
6. Department of Transportation has concerns with drainage and water quality that could runoff
onto State Highway 99. They are also requesting that access be provided from a county road,
rather than State Highway 99. They also discuss'all structures, parking, wells and septic area
(leach field area) be located at least.85 feet, but preferably 100 feet from the centerline of
State Highway 99. Any improvements within the State's right-of-way will require an
encroachment permit from the State.
7. California Regional Water Quality Control Board discussed the requirements of a Clean
Water Act Section 404 Permit from the U.S. Army Corps of Engineers, and a construction
storm water permit.
In addition to the above, the Development Services Department, Planning Division, noted the
following:
1. The main issue discussed was how to handle the waste water. Ponding was discussed, but at
this time is not an option. Please contact Environmental Health to discuss possible solutions
to waste water.
2. Possible requirements of a wetlands delineation study.
3. If a caretaker facility is going to be part of the animal shelter, it will need to be included as
part of the Use Permit.
4. The zoning on the parcel does allow the development of a single family dwelling with or
without the issuance of a use permit for the animal shelter. Based on environmental health,
there is an existing septic'system that would allow a single family dwelling to be placed on
the property. For size of dwelling (number of bedrooms); please contact Butte County
Environmental Health in Chico at 891-2727. The use permit requires all existing
improvements be shown on the submitted site plan.
5. Based on the number of animals at the current animal shelter, approximately 60 dogs and 120
cats in the 4,500 square foot building, the proposed 15,000 square feet in phase one and
another 15,000 square feet in phase two, seems to be quite an expansion. The Humane.
Society determined a possible doubling of the number of cats and dogs. An more accurate
amount of animals should be included if an application is submitted.
6. A kennel permit will also need to be acquired.
These factors, and others, will have a significant bearing on the ultimate design and use of the
project.
Note that these issues are not exhaustive. During the processing of the actual application, other
issues may arise that could place significant conditions on your project.

COMMENTS ON BUTTE COUNTY HUMANE SOCIETY PREDEVELOPMENT

The Butte County Humane Society is applying for a use permit to construct and operate a 15,000 square
foot animal shelter on a 20-acre property several miles northwest of Chico. The facility is proposed to
be on septic. The following comments maybe relevant to the project.
Wetlands and/or stream course alteration—The project proponent may require a Clean Water Act
Section 404 permit (§404 permit) from the U.S. Army Corps of Engineers. A.§404 permit is required
for activities involving a discharge of dredged or fill material to waters of the United States. "Waters of
the United States"include wetlands, riparian zones, streambeds, rivers, lakes and oceans. The Army
Corps of Engineers Butte County contact for §404 permits is Ms. Laura Whitney, (916) 557-7455.
Projects requiring a §404 permit also require a water quality certification(pursuant to Section 401 of the
Clean Water Act) verifying that the project does not violate State water quality standards. A water
quality certification is required for any project that impacts water of the State (such as streams and
wetlands). Activities that fall under the water quality certification process include, but are not limited
to: stream crossings, the modification of stream banks or stream courses, and the filling or modification
of wetlands. A water quality certification must be obtained prior to construction. Failure to obtain a
water quality certification, when required, may result in enforcement action. The Regional Board
contact for water quality certifications is Scott A. Zaitz, who can be reached at the letterhead address or
by telephoning(530) 224-4784.
Isolated wetlands not covered by the federal Clean Water Act—Wetlands not covered by the Clean
Water Act are known as "isolated wetlands." Should the U.S. Army Corps of Engineers determine that
isolated wetlands exist at the project site and should the project impact or have potential to impact the
isolated wetlands, a Report of Waste Discharge and filing fee must be submitted prior to commencing
the construction activity. The Regional Board will consider the provided information and either issue or
waive Waste Discharge Requirements. Failure to obtain waste discharge requirements or a waiver
thereof, when required, may result in enforcement action. Report of Waste Discharge application forms
are available by calling our office at (530) 224-4845.

when required, may result in enforcement action. Construction storm water permits can be obtained

Dewatering Alternative 1: discharge to storm drains or waters of the United States—A dewatering
permit, General Order for Dewatering and Other Low Threat Discharges to Surface Waters, may be
required for construction activities. This general NPDES (National Pollutant Discharge Elimination
System)permit covers the discharge to waters of the United States of clean or relatively pollutant-free
wastewater that poses little or no threat to water quality. The following categories are covered by the
dewatering permit: well development water; construction dewatering; pump/well testing; pipeline/tank
pressure testing; pipeline/tank flushing or dewatering; condensate discharges; water supply system
discharges; miscellaneous dewatering/low threat discharges. The dewatering permit applies only to
direct discharges to waters of the United States. Failure to obtain a dewatering permit, when required,
may result in enforcement action. An application form and a copy of the permit are available at this
office.
Dewatering Alternative 2: discharges to land—Construction dewatering discharges that are contained on
land (i.e., will not enter waters of the United States) are allowed under a general waiver adopted under
Regional Board Resolution No. R5-2003-0008, provided the following conditions are met: (1) the
dewatering discharge is of a quality as good as or better than underlying groundwater; and (2) there is a
low risk of nuisance. Examples of dewatering discharges to land include a terminal basin, irrigation
(with no return to waters of the United States), and dust control. You may request written confirmation
from this office that the waiver is applicable.
Wastewater treatment and disposal—The applicant should describe how animal wastes and pen wash
water will be handled.

Thank you for inviting us to the pre-application IDR Committee conference for the subject
project to be conducted on October 5, 2005. The potential project would permit an animal
shelter facility on 20 acres of land located on the west side of SR 99, one mile north of
the Cana Highway, one-half mile south of the Hamilton-Nord-Cana Highway, across the street
from an adult commercial business, north of the City of Chico. The facility would
accommodate up to 100 dogs, 200 cats, and other animals, and employ up to fifteen people.
Although we will not be able to attend the meeting, we do have the following concerns:
Drainage and Water Quality: Depending on topography and design of the septic system, there
could potentially be water and leachfield runoff into the State's highway right-of-way and
drainage facilities. It should be noted that any post development runoff may not exceed
the pre development r-noff into the State's facilities.
Access: A site plan was not included in the pre-application package. If possible, access
should be secured from an existing country road and not from a new access to the State
highway. In the event that new access off SR
99 is needed, an encroachment permit from the State will be required.
ROW: The State' s Transportation Concept Report for the portion of SR 99 fronting the
property identifies the ultimate concept to be a four to five lane wide conventional
highway facility. As such, all structures, parking, and leach field areas should be
located at least 85 feet and preferably over 100 feet from the centerline of SR 99.
Encroachment Permit: Any work to be conducted in the State' s highway ROW will require an
encroachment permit from the State.

J. FIRE CLEARANCE
1. Construction, installation or development of buildings and/or roads, driveways, gates and
bridges on parcels/lots shall comply with the latest California Fire Safe Regulations—Public
Resources Code 4290, 4291 and current Butte County Improvement Standards, whichever is
stricter.
X 2. Prior to construction, a pressurized community water system if available or the creation of a
private water system for fire protection is required. Bonding may be allowed with the

❑ 3. Place a note on a separate document and recorded concurrently with the Parcel,Final map or
an additional map sheet stating that "Fire suppression sprinkler systems shall be installed in
all new residential dwellings in accordance with NFPA Standard 13D, unless a pressurized
community water system with hydrants that meet Fire Department specifications serves the
property." A note stating "Automatic Fire Sprinklers conforming to NFPA Standard 13D
required"is to be added to all affected building plans.
❑ 4. In lieu of hydrant installation, prior to recordation of the Parcel or Final map, payment shall
be made into the hydrant fund at the current rate per lineal foot of street frontage.
X 5. Prior to building construction, provide an all weather access of at least 10 feet wide and
vertical clearance of 15 feet that will allow for ingress and egress and accommodate a
40,000-pound fire apparatus to within 150 feet of all structures.
