B. DRAINAGE ❑ 1. Prior to recordation of the Parcel/Final Map, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained on- site and/ or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. ❑ 2. Prior to final improvement inspection by the Department of Public Works, all new drain inlets shall be labeled with the county approved drain marker per County Standard S-40. Improvement plans shall show and/or note the requirements for labeling inlets pursuant to Butte County Standard S-40. ❑ 3. Prior to recordation of the Parcel/Final Map, establish 100 year flood plain elevations and the lowest floor elevations for any structures, in accordance with Butte County Code §26-25. At a minimum, creation of the entity shall: a. Insure financing of operation, repair and maintenance. b. Provide qualified individuals and operational procedures for facility operations, repair and maintenance. C. Provide adequate resources to comply with all monitoring and other Regional Water Quality Control Board Waste Discharge Requirements. d. Provide adequate resources for facility inspections and reports. e. Provide adequate resources and/or mechanism to insure adequate funding of a major sewage treatment and a disposal facility replacement or reconstruction if necessary. f. Provide a liability risk assessment for review by the County of Butte. g. Indemnify the County of Butte and community services district or other government entity for all claims and liability that may occur relative to the sewage disposal facilities. ❑ 4. Locate wastewater ponds separate, as required, from areas of residential development. Meet design requirements for control of mosquitoes and nuisance insects in the wastewater ponds to the satisfaction of the appropriate Mosquito and Vector Control District. ❑ 5. If a homeowners association is provided, obtain approval of the By-laws and CC & Rs by Butte County Environmental Health, and, if required, by the California State Regional Water Quality Control Board. Approval shall be obtained prior to recordation of the Final Map. J. COMMUNITY SEWER SPECIAL NITRATE AREA ❑ 1. In accordance with the Chico Area Nitrate Action Plan, provide for a connection to the public sewer, if practical and feasible. A determination that connection is not practical and feasible shall be made with the concurrence of the Central Valley Regional Water Quality Control Board and the Environmental Health Division. NOTE: Board staff is currently requiring a density of no greater than one equivalent residential unit per acre for development on septic tanks where sewer is not available. ❑ 2. If connection to a public sewer is not feasible prior to recordation of the Final Map: a. Provide the minimum required sewage disposal area as required by the Butte County Subdivision Ordinance and the Nitrate Action Plan. b. In conformance with the City of Chico Sanitary Sewer Master Plan, dated December 20, 1985, construct dry line sewer mains to serve the project and stubbed out to the property line to for future public sewer connection. C. Provide a community services district or other legal (government) entity adequate to ensure the maintenance of the dry sewer main and, when necessary, the activated sewer main. d. The typical street section throughout the site is a reduced width with no parking on the streets and small parking areas scattered through the development. Drainage Drainage for the site has been analyzed based on the existing topography and use and the proposed design for the site. The no net increase design will include oversized pipes to store the increase in runoff and a system to meter out the flow at the current rate. The current flow from the site is taken by the existing irrigation ditch that runs.through the site. This will continue to be the outfall point for the development. Sanitary Sewer The site is currently within the Lake Oroville Area Public Utility District(LOAPUD)for sanitary sewer service. The plan checking process will continue until the plans and specifications are ready for approval. Once the plans and specifications have been approved by the Agency's engineer,they must be reduced in size to 11"x 17°and attached to the conveyance agreement as an exhibit The conveyance agreement will be taken before the Agency's Board of Directors for approval. The agreement,with all of the exhibits attached and signed by the developers,must be delivered to the Agency within 60 days of plan approval and at least one week prior to the Board meeting (fourth Tuesday of each month)for placement on the agenda. Dear NorthStar Engineering: This letter is intended to provide a summary of the information provided in the meeting held on January 31, 2007, regarding your proposal for a PUD/Tentative Subdivision Map for residential and commercial mixed-use development. The following written comments are included with this letter: 1. Butte County Public Works 2. Butte County Fire (CDF)Department 3. Butte County Agricultural Commissioner 4. California Department of Transportation (CalTrans) 5. City of Oroville The following is a brief summary of the comments received: 1. Planning - Appropriate biological studies will need to be prepared to identify issues on site. Possible wetlands delineation,studyneeded. Try and preserve existing oak trees. Discussed the parking requirements (Retail/Commercial 1 space/200 sq ft and Office 1 space/300 sq feet). Talked about modifying the plans so all residential development is single-family detached. Discussed impacts to existing drainage way and obtaining necessary permits. Discussed the need for a focused traffic study (see CalTrans attachment). Appreciated the level detail on the plans and illustrative presented at the meeting. Mixed-use of retail/residential lofts was good. The idea of a pool and clubhouse was a nice addition. 2. Public Works - Drainage — A preliminary drainage plan will need to be submitted as part of the application. Discussed minimum road widths of 24 feet. PUD does give the ability to modify the standards, but still would like 24 feet private road. Please review attached draft conditions of approval. Note that draft conditions submitted are based on preliminary review and based on plans submitted for the Pre-Development Meeting. The project will be re-evaluated at time of project application submittal. 3. Butte County CDF determined the project does not meet Butte County Code 20-133 and Public Resources Code 1273.9. The issues are the number of lots on a cul-de-sac. A possible emergency access onto Miners Ranch Road for the residential area. Project is designed to add the emergency exit onto Miners Ranch Road. 4. Butte County Environmental Health — Please provide willing and able to serve letter from South Feather Power and Water Agency (SFPWA) and Lake Oroville Area Public Utility District (LOAPUD)with you pre-application submittal to Environmental Health. 5. The Agricultural Commissioner determined there are no adverse agricultural issues. 6. City of Oroville — The project's density is not consistent with the City's General Plan designation and long term development goals for the area. If the County moves the project forward for approval, please require full urban improvements along Miners Ranch Road and Oroville Quincy Highway (including separated parkway landscaping strip (of at least 8') and street trees planted in the strip. 7. CalTrans — Discussed traffic/circulation, Hydrology and right-of-way issues. Please refer to their attachment. 8. SFPWA — Discussed the 50-foot wide easement (1100 O.R 574). Please provide a letter from SFPWA that addresses the easement and the restrictions. These factors, and others, will have a significant bearing on the ultimate design and intensity of the project. Based upon your proposal as contained in materials submitted with your Pre-Development Conference application,the following items may be required for us to prepare an environmental evaluation: • Archaeological Study(survey for historic and pre-historic cultural resources) • Biological/Botanical Study (survey for rare,threatened, or endangered plant and animal species) • .. The Developer must complete the formation of a County Service Area (CSA) or other Department of Public Works approved maintenance entity for landscaping prior to recordation of the Final Map. The maintenance entity formation process will require the Developer to fund the service until the beginning of the first fiscal year in which service charges can be collected for the maintenance entity, and agree to an annual maximum service charge to ensure continued maintenance of the facilities. B. DRAINAGE ® 1. Prior to recordation of the Final Map,a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained on- site and/ or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. If storm drainage facilities serve new public roads, the developer must complete the formation of a County Service Area(CSA)or other Department of Public Works approved entity prior to recordation of the Final Map. The CSA formation process will require the Developer to fund the service until the beginning of the first fiscal year in which service charges can be collected for the CSA, and agree to an annual maximum service charge to ensure continued operation of the facilities. ® 2. Prior to final improvement inspection by the Department of Public Works, all new drain inlets shall be labeled with the county approved drain marker per County Standard S-40. Improvement plans shall show and/or note the requirements for labeling inlets pursuant to Butte County Standard S-40. ❑ 3. Prior to recordation of the Final Map, establish 100 year flood plain elevations and the lowest floor elevations for any structures, in accordance with Butte County Code §26-25. Show on the additional map sheet the elevations(by contours)and the location of an accepted NGVD29(National Geodetic Vertical Datum of 1929)benchmark and a temporary benchmark on-site. ❑ 4. Prior to, or concurrently with the recordation of the Final Map, pay the applicable drainage fees in effect at the time of recordation of the Final Map for the I drainage area. We request that a focused traffic impact study (TIS) be prepared that analyzes the intersection of SR 162 and Miners Ranch Road. The TIS should also include a signal warrant study at this intersection. Depending on the results of the analysis a traffic signal or roundabout, a right-turn lane onto Miners Ranch Road, and lengthening of the left-turn lane onto Kelly Ridge Road may be required. In order to increase safety for pedestrians who may walk to nearby services, full improvements will be required along the project's frontage on SR 162 that includes curb, gutter, and sidewalk. A second lane in the eastbound direction on SR 162 will be required between Miners Ranch Road and Old Olive Highway for right-turn site access deceleration and for right turns onto Old Olive Highway. In addition, a continuous center left-turn lane will be required between Miners Ranch Road and Old Olive Highway for site access. We also suggest that the County consider requiring the widening of Miners Ranch Road to provide a two-lane northbound approach. The lane configurations can be determined at a later date. Hydrology: The project should be designed to insure that the amount of storm water run-off into the State highway drainage facilities that will be generated by the project does not exceed the pre-project amount unless mitigation is provided. Once formally submitted, the tentative subdivision map should identify the existing and proposed drainage patterns. Right-of-Way: The dimensions on the project map for the northerly boundary line do not match the record distance and bearing our Right-of-Way Surveys Office has. Therefore, we request that a record of survey with complete survey notes be performed and submitted to us prior to map recordation. The SR 162 highway right-of-way just west of the project site is recorded at 86 feet from the centerline to the south and 56 feet from the centerline to the north for a total of 142 feet. The existing highway right-of-way along the project's frontage on SR 162 is 100 feet. Additional right-of-way,may be required for dedication to Caltrans to accomodate the center left-turn lane and right-turn deceleration lane.
