Based on available information, we concur with the estimate of waters of the United States, as depicted on�the_May 2006, Mt. DATE: December 13, 2005 This document is intended to offer a"first blush"overview of the negative consequences that will likely accrue to law enforcement due to the construction of the two housing developments identified. It is not intended to be comprehensive or all inclusive, but merely a recognition of the likely future. It is our understanding that the two subdivisions described in the attached IDR's will consist of 450 new single family residences. Using the current LAFCO formula would mean an increase in the area population of approximately 1,215 people. The existing state ratio of deputy to population is 2.77 deputies per thousand individuals. This would result in the need for two additional deputies. However, as the Butte County ratio is not close to the state's norm, one additional deputy would be a reasonable accommodation. A population increase of any significance will likely result in a concomitant increase in calls for service, and potentially crime rates. Such increase will affect not only the uniform patrol force, but the areas of investigations, dispatch,jail, courts, civil law matters and all support functions. Highway 162, which consists of Oroville Dam Boulevard, Olive Highway and Oroville Quincy Highway, will be significantly impacted by the additional vehicular traffic realized due to this development. The impacted surface streets, particularly Foothill Boulevard., Miners Ranch Road., Mount Ida Road., Hilldale Avenue i and Oakvale Avenue will be seriously affected. At the present time, Highway 162 and Oakvale Avenue both experience serious backup issues during peak hours and when children are being dropped off or picked up from school. Ophir School on Oakvale realizes horrendous traffic at these times. The school, which presently has 600 students, has had an attendance close to 800 in the past, and the school authorities'state that they cannot effectively deal with that number. The anticipated subdivisions may create that numerical imbalance, as they are both in the Ophir School district. There is no question that the amount of vehicular and pedestrian traffic resulting from these subdivisions will increase the number of traffic accidents/incidents, calls for service related to the schools and a reduced response time for emergency vehicles. Our comments are as follows: Potential transportation/traffic impacts: mitigation requested: • The proposed project will generate approximately 4,500 average daily trips and approximately 450 peak hour trips(ITE Trip Generation Manual). Based on the anticipated traffic volumes and proximity to SR 162, the proposed projects may generate potentially significant traffic impacts to SR 162. • Therefore, a Traffic Impact Study(TIS), which contains appropriate mitigation measures, should be prepared and included with the project application or in the environmental document prepared for the project in accordance with the December 2002 edition of the Guide for the.preparation of Traffic Impact Studies. Mitigation measures in the form of specific improvements or in-lieu fees that will reduce both project specific and cumulative the traffic impacts to SR 162 to a less than significant level. If impact fees will be required for mitigation, then the pro-rata share of the estimated improvements cost and estimated construction dates must be identified. If placement of traffic signals is proposed as mitigation, a 5-year analysis from the estimated completion date will be required to determine if the traffic operations will be adequate for the 5-year design life of the traffic signal. • Prior to commencing with the preparation of the TIS, we would like to meet with the - County and the County's traffic consultant to review the assumptions including the trip distribution that will be utilized and intersections.that will be analyzed in the study. As you know, we sent both projects out for review together so as to allow agencies and departments to review them in a comprehensive manner. Included with this letter are two sets of documents, one for each project. These documents are from all the agencies and departments making comment on the projects. Note that there are several duplicates. The additional purpose of this letter is to summarize the major issues raised by the projects. These include: • Traffic: Both projects raise traffic issues. When taken together, and when combined with other projects we are aware of,the traffic issue becomes a"global" one, and one of significance. In addition, there may be significant design changes required if access to Mt. Ida is the only access for the Mt. Ida project. • Sewer and Water: You are aware of the issues regarding annexation to appropriate service districts. Service line extensions, pump stations and lift stations will most likely be involved in one or more of the projects. These facilities will have site specific issues requiring environmental review. • Wetlands: The projects, especially Miners Ranch, may have significant wetland issues. • Honcut Creek: The West Fork North Honcut Creek bisects the Miners Ranch project. This is a significant drainage, wetland and biological sensitive system. • Oak Tree Habitat: The Miners Ranch project has significant viable oak tree woodland that is self generating, and provides a major habitat for flora and fauna. • Schools: Note the letter from Oroville City Elementary School District. • Growth inducing: Your project when coupled with others in the area we are aware of raises concern regarding the inducement of additional growth. This is especially important regarding properties not currently designated for urban growth. • Cumulative impact: Taken together, there is a significant cumulative impact. This is especially true of traffic impacts. • General Plan/Rezone: The Miners Ranch project will require a general plan and rezone in order to meet the density you propose for this project. • Rezone: You propose a PUD for the Mt. Ida project. The PUD designation is actually a County zone designation and therefore will require a rezone application. I suspect that an EIR may be required.to address these and other possible issues. You might keep these issues in mind when preparing your applications. Note that the subdivision, rezone and General Plan amendment applications for the Miners Ranch project can be processed as one application.
