The biggest issue discussed was that the parcels are within a flood zone, which under BCC 24-82 requires that any area in a flood zone be designated as open space. Staff is looking into the wording of the Ordinance, but does believe that area designated in flood zones must be put into open space. 2. Alternative options, such as a PUD or transfer of development credits were discussed. The PUD option does have certain requirements, one or which is a percentage of the area shall be utilized for recreation or park areas available for use by al the residents. Prior to or concurrently with the recordation of the Final Map, provide a fully executed road maintenance agreement for all non-publicly maintained access roads on the County approved form. A note shall be placed on a separate document which is to be recorded concurrently with the map or on an additional map sheet of the Final Map stating: "In accordance with Civil Code Section 845, maintenance of the road as shown hereon shall be shared by those properties with a legal interest in it." ® 2. All access rights shall be reserved by deed per County Ordinance, offered for dedication, and depicted on the Final Map. Prior to recordation of the Final Map, provide street name signs per requirements of the Department of Public Works. A) One 1.5+/- acre parcel with the existing Lorenz home on it which shall be retained by the Lorenz's. B) One lot which shall consist of the remainder of the Lorenz parcel once the above mentioned parcel is removed along with a contiguous approximate four tenths of an acre of the Cooper property for the construction of a home thereon,which shall transfer to the Lorenz's for compensation as set forth below in this agreement. C) Seven lots of various sizes all on the parcel now owned by the Coopers. Background and Reasoning: After consultation with the Butte County Planning department,developer believes that the Lorenz parcel is within the 300 foot required setback from the"established green-line"which would not allow new lots to be created on their parcel. However, such lots can be developed upon the Cooper property under the existing guidelines of the"flexible lot" ordinances of the county which allows for the cluster of smaller lots on the developable portion of a project. The participant would then be allowed some benefit from their current zoning that would otherwise not be possible. The developers would benefit in that a previously unviable project would become profitable to them as well. Developer's efforts towards this goal shall constitute the consideration for this agreement. Such a development would require that the entire existing Lorenz property,and perhaps eight feet of the Cooper property,would not be allowed for future residential development and would be restricted to an "open space" buffer from agricultural operations on the adjacent lands now owned by Vernoga. No more than three dogs or cats may be kept upon any property within the development. All cats shall be neutered or spayed as kittens and no more than one litter of dogs per calendar year shall be permitted. Dogs shall be securely kept within a fenced area to the rear of the front edge of the home and leashed when not therein. Uncontrolled and unreasonable barking shall not be allowed,which shall be determined by any majority of owners within this subdivision. Farm animals may not be kept or bred on the properties except temporarily for FFA or 4-11 purposes and then only at the furthest point from adjoining neighbors in a pen not to exceed 250 square feet. No livestock ponds or mud holes shall be allowed. Prior to the Final Map, provide a community services district or other legal (government) entity adequate to insure the operation, maintenance or repair of the sewage collection, treatment and disposal facilities. At a minimum, creation of the entity shall: a. Insure financing of operation, repair and maintenance. b. Provide qualified individuals and operational procedures for facility operations, repair and maintenance. C. Provide adequate resources to comply with all monitoring and other Regional Water Quality Control Board Waste Discharge Requirements. d. Provide adequate resources for facility inspections and reports. e. Provide adequate resources and/or mechanism to insure adequate funding of a major sewage treatment and a disposal facility replacement or reconstruction if necessary. f. Provide a liability risk assessment for review by the County of Butte. g. Indemnify the County of Butte and community services district or other government entity for all claims and liability that may occur relative to the sewage disposal facilities. ❑ 4. Locate wastewater ponds separate, as required, from areas of residential development. Meet design requirements for control of mosquitoes and nuisance insects in the wastewater ponds to the satisfaction of the appropriate Mosquito and Vector Control District. ❑ 5. If a homeowners association is provided, obtain approval of the By-laws and CC & Rs by Butte County Environmental Health, and, if required, by the California State Regional Water Quality Control Board. Approval shall be obtained prior to recordation of the Final Map. J. COMMUNITY SEWER SPECIAL NITRATE AREA ❑ 1. In accordance with the Chico Area Nitrate Action Plan, provide for a connection to the public sewer, if practical and feasible. A determination that connection is not practical and feasible shall be made with the concurrence of the Central Valley Regional Water Quality Control Board and the Environmental Health Division. NOTE: Board staff is currently requiring a density of no greater than one equivalent residential unit per acre for development on septic tanks where sewer is not available. ❑ 2. If connection to a public sewer is not feasible prior to recordation of the Final Map: a. Provide the minimum required sewage disposal area as required by the Butte County Subdivision Ordinance and the Nitrate Action Plan. b. In conformance with the City of Chico Sanitary Sewer Master Plan, dated December 20, 1985, construct dry line sewer mains to serve the project and stubbed out to the property line to for future public sewer connection. C. Provide a community services district or other legal (government) entity adequate to ensure the maintenance of the dry sewer main and, when necessary, the activated sewer main. d.
