The applicant has approximately 40 years experience as a professional golfer and instructor. The plan calls for a three-phase development. 1)The first phase will be the Golf school and driving range. The range will be covered, lighted,heated, and cooled with a state of the art"misting" system. There will be both grass and mats in the hitting area with multiple targets to choose from. The golf school will have a separate,unique, real world full swing and short game practice area. The plan requires the hiring and training of more teachers to handle the expected volume of students seeking to enroll in the classes for both adults and juniors. Seniors and ladies will be especially welcome. The school will be offering all levels of golf classes from beginners to advanced students,to local and out-of-towners. A parking lot and service roads will also be installed. 2)The second phase will be to construct the clubhouse and maintenance facility. A respected local architect,John Anderson,has created a beautiful, functional and innovative design for the Clubhouse and attendant facilities. The clubhouse will house the golf course starter and pro-shop, indoor hitting bays for computerized swing analysis, snack bar, a fitness and stretching area, and a full size restaurant, and an area to be used as a meeting room/classroom/lounge,complete with TV's and video presentation capabilities. The clubhouse will also have lockers and shower facilities. Adjacent to the clubhouse will be a swimming pool and a regulation size tennis court. This is to encourage total family participation and provide some activity for non-golfing family members. The maintenance facility will house the equipment&vehicles needed to maintain the golf course and house the golf carts used to play golf. 3)The third phase will be to construct a full size 9-hole golf course, with multiple tees in order to vary the length of the hole, accommodating the various skills levels, as well as, differentiating the front side from the back. Water features are also being considered, to be commensurate with the irrigation system. The course has been designed utilizing the natural features of the land and keeping the playing abilities of all golfers in mind. Sunset Hills Golf Course in Chico is being closed and will create a void. This creates an urgent need for another golf course and driving range in the Chico community, especially at the north end of Chico. The introduction and teaching of golf to young people is invaluable is establishing character,responsibility and self- confidence. Youngsters learn to be competitive without being loud, rude or, vulgar. Self-esteem is implanted at an early age and the instances of drug, alcohol, substance abuse, and gang related activities are minimized through the sport of golf. The golf training and playing facility is uniquely compatible with most environmental considerations, in that it is quiet and aesthetically appealing,preserves open space, provides wildlife habitat, stimulates agricultural activity in turf grass management, stimulates development of water resources and enhances the environment with trees and plants. This generally provides an environmentally sound recreational area. A golf training and playing facility also provides jobs within the community. In that email (3/10/06) 1 wanted to know if T could use the older application if T already had signatures. At my end, I collect necessary signatures whenever I can. This packet for example required several signatures for the submittal. I collected them over many weeks. In a perfect world, this would not present a problem, but the real world is different. I still have several projects that I've collected signatures on the older application that I'm waiting to submit. Dear Mr. Dobbs: This letter is intended to provide a summary of the information provided in the meeting held on May 03, 2006, regarding your proposal for a Golf Course in the M-1 zone. Specific questions should be addressed to the appropriate agency or department. The following is a summary of the comments from the meeting. 1. Planning Division: A. The proposed use is not listed as a permitted use, or as a conditionally permitted use, under the North Chico Specific Plan (NCSP) for the M-1 zone. The NCSP will have to be amended. The Department of Development Services is evaluating minor amendments to the NCSP, but-there is no time frame for this task. The applicant can proceed with an amendment application for this proposal, and must be completed before an application can be accepted and processed. B. The north end of the property is bounded or bisected by Mud Creek. This presents wetland and drainage issues to be addressed by the project. C. Staff to the Airport Land Use Commission has determined that the project is consistent with the B-1 and B-2 zones of the Chico Airport. However, note that clubhouse may exceed the maximum persons per acre requirement. 2. Public Works: A. An on site detention pond will be required. B. Fill in the flood plain will not be allowed. C. Dedication of 40-feet of right-of-way, and curb, gutter and sidewalks will be required. I have attached what is considered a major land use action for your review. The Butte County Airport Land Use Compatibility Plan does :have requirements on the number of people (intensity) permitted on the parcel at any given time and on any given acre. I have attached a copy of the table that regulates the intensity allowed on the parcels based on the Compatibility Zone. ALUC staff is requesting to include the following conditions: 1. Locate structures a maximum distance from the extended runway centerline. 2. The proposed use shall not exceed the average number of people per acre and the number of people on any given single acre as stated in Table 2A of the Butte County Airport Land Use Compatibility Plan. 3. Airspace review required for objects greater than 35 feet tall in the 131 Compatibility Zone and 70 feet tall in the B2 Compatibility Zone. 4. The project will also be required to record a deed notice notifying purchasers of the proximity of the airport and the potential for possible noise-related impacts in an ALUC-approved disclosure notice. 1 5. Prior to issuance of the Use Permit record an Avigation Easement granting the right of continued use of the airspace above the proposed parcels by the Chico Municipal Airport and acknowledging any and all existing or potential airport operational impacts. With clustering,some parcels may be much smaller than others as long as the maximum overall density criterion is not exceeded. Clustering of units is encouraged in Compatibility Zones B2 and C—see Policy 4.2.6 for limitations. 2 Usage calculations shall include all people who may be on the property(e.g.,employees,customersivisitors,etc.) both indoors and outside. These criteria are intended as general planning guidelines to aid in determining the accept- ability of proposed land uses. Additional guidance is provided by Appendix D. 3 .Open land requirements are intended to be applied with respect to an entire zone. Community general plans and/or implementing policies shall indicate how and where the requirements will be met. Application of open land require- ments to individual development proposals is at the discretion of the local jurisdiction and is dependent upon the size of the development(some Individual parcels may be too small to accommodate the minimum-size open area require- ment)and whether the requirements can be made solely on public property. See supporting compatibility policies on safety(Policy 4.2.5)for definition of open land. 4 The uses listed here are ones which are explicitly prohibited regardless of whether they meet the intensity criteria, unless such prohibition is precluded by applicable state statutes.In addition to these explicitly prohibited uses,other uses will normally not be permitted in the respective compatibility zones because they do not meet the usage intensity criteria. 5 Airport proximity and the potential for aircraft overflights should be disclosed as part of all real estate transactions in- volving property within any of the airport influence area zones. Easement dedication and deed notice requirements apply only to new development. 6 The total number of people permitted on a project site at any time,except rare special events,must not exceed the indicated usage intensity times the gross acreage of the site. Rare special events are ones(such as an air show at an airport)for which a facility is not designed and normally not used and for which extra safety precautions can be taken as appropriate. 7 Clus�terimof nonresidential development is permitted except in Zone A. However,no single acre of a project site shall exceed the indicated number of people per acre. See Policy 4.2.6 for details. 8 An intensipLbonus may be allowed in Zones B2 and C if the building design includes features intended to reduce risks to occupantsthe event of an aircraft collision with the building. Storage of up to 2,000 gallons of nonaviation flammable materials is also exempted. 13 NLR=Noise Level Reduction;the outside-to-inside sound level attenuation which the structure provides. See the supporting compatibility policy on interior noise(Policy 4.1.5)for details. 14 Objects up to 35 feet in height are permitted;however,the Federal Aviation Administration may require marking and lighting of certain objects. See supporting compatibility policy on height restrictions(Policy 4.3.2)for details. 15 Two options are presented for residential densities in Compatibility Zone C. Option(1)requires an average parcel size of at least 5.0 gross acres. Option(2)requires a density of at least 4.0 dwelling units per acre(an average parcel size no greater than 0.2 gross acres). In locations where only one of these options is considered acceptable,the compati- bility maps in Chapter 3 show either a C(1)or a C(2)symbol. In locations Where either option is allowed,the map is marked with just the letter C. In the latter locations,the choice between the two options is at the discretion of the local land use jurisdiction. All other criteria for Zone C apply to both the C(1)and C(2)designations. This two-option criterion is based upon a determination that the intrusiveness of aircraft noise is the most significant compatibility factor in Zone -safety is only a minor concern The concept is that noise concerns can be minimized either by limiting the number of dwellings in the affected area or by allowing high densities which tend to have com- paratively high ambient noise levels. (Also see Policies 2.4.3, 2.4.4.(b), and 2.4.4.(c).) (d) Proposed land use actions covered by Paragraphs (a), (b), and (c) above shall initially be reviewed by the ALUC Secretary. If the Secretary determines that significant compatibility issues are evident, the proposal shall be forwarded to the Commission for review and decision. The Commission authorizes the Secretary to approve proposed actions having no apparent compatibility is- sues of significance. 1.5.3. Major Land Use Actions—The scope or character of certain proposed major land use actions, as listed below, is such that their compatibility with airport activity is a potential concern. Even though these actions may be basically consistent with the local general plan or specific plan, sufficient detail may not be known to en- able a full airport compatibility evaluation at the time that the general plan or specific plan is reviewed. To enable better assessment of compliance with the compatibility criteria set forth herein, ALUC review of these actions may be war- ranted. The circumstances under which ALUC review of these actions is to be conducted are.indicated in Policy 1.5.2 above. (a) Actions affecting land uses within an airport influence area. (1) Any proposed expansion of the sphere of influence of a city or special district. (2) Proposed pre-zoning associated with future annexation of land to a city. (3) Proposed residential development,.including land divisions, consisting of five or more dwelling units or parcels. (4) Any discretionary development proposal for projects having a building floor area of 20,000 square feet or greater. (5) Proposed land acquisition by a govemment entity for any facility ac- commodating a congregation of people (for example, a school or hospi- tal). (6) Any off-airport,'nonaviation use of land within Compatibility Zone A. (7) Proposals for new development (including buildings, antennas, and other structures) having a height of more than: ► 35 feet within Compatibility Zone 81 or a Height Review Overlay Zone; 2-7 Countywide Policies/Chapter 2 ► 70 feet within Compatibility Zone B2; or ► 100 feet within Compatibility Zones C or D. (8) Any obstruction reviewed by the Federal Aviation Administration in ac- cordance with Part 77 of the Federal Aviation Regulations which re- ceives a finding of anything other than "not a hazard to air navigation." (9) Any project having the potential to create electrical or visual hazards to aircraft in flight, including: ► Electrical interference with radio communications or navigational signals; ► Lighting which could be mistaken for airport lighting; ► Glare in the eyes of pilots of aircraft using the airport; and ► Impaired visibility near the airport. (10) Projects having the potential to attract an increased number of birds to the vicinity of an airport. (b) Proposed nonaviation development of airport property if such development has not previously been included in an airport master plan or community general plan reviewed by the Commission. (See Policy 1.2.6 for definition of aviation-related use.) (c) Regardless of location within Butte County, any proposal for construction or alteration of a structure (including antennas) taller than 200 feet above the ground level at the site. (Such structures also require notification to the Fed- eral Aviation Administration in accordance with Federal Aviation Regulations, Part 77,.Paragraph 77.13(a)(1).) (d) Any other proposed land use action, as determined by the local planning agency, involving a question of compatibi'ity with airport activities. 1.5.4. Intercounty Coordination —Where an airport influence area crosses-the Butte County line, affected jurisdictions outside But,--e County are asked to maintain coordination with the Butte County ALUC on airport land use compatibility is- sues.
